U.S. traders should not assume profits from sports contracts on prediction markets are tax-free—even if no tax form arrives. The IRS says income can be taxable without a Form 1099-K, but that general guidance does not settle how sports event contracts are classified. As of October 2026, the federal tax treatment described by tax professionals remains unsettled, and the classification can affect how gains are reported and what losses may be deductible.
What the IRS guidance does—and does not—answer
The IRS’s general Form 1099-K FAQ says, “All income, no matter the amount, is taxable unless the tax law says it isn’t – even if you don’t get a Form 1099-K.” That means the absence of a form is not, by itself, a reason to leave income off a return. The FAQ is general guidance; it does not specifically classify prediction-market sports contracts or prescribe how to report their proceeds. Read the IRS Form 1099-K FAQ.

The unresolved question is what kind of transaction the contract represents for federal tax purposes. KPMG’s 2026 analysis examines sports event contracts offered by CFTC-regulated contract markets, but does not give an opinion on whether they are derivatives or wagers. Its discussion should not automatically be applied to offshore, crypto-native, or differently structured venues. Read KPMG’s 2026 analysis.
Why classification matters
Different legal characterizations can change the character and timing of taxable income and, especially, the treatment of losing positions. These are possible frameworks discussed in the reviewed tax analysis—not settled, universal instructions for retail traders.

| Possible treatment | Potential effect | What is not established |
|---|---|---|
| Section 1256 regulated-derivative treatment | If a contract qualifies, this framework can involve mark-to-market treatment and a 60% long-term / 40% short-term capital-gain split. | The reviewed sources do not establish that retail sports event contracts automatically qualify or that the IRS has approved this treatment for them. |
| Other capital-asset treatment | General capital-asset principles could make holding period and capital-loss rules relevant. | The sources do not establish this as the universal treatment for sports contracts. |
| Wagering treatment | If a contract is treated as a wager, winnings are generally ordinary income and wagering-specific loss limits may apply. KPMG says that, beginning in 2026, the federal deduction for gambling losses is limited to 90% of such losses under the OBBBA. | This conditional loss rule does not establish that prediction-market sports contracts are wagers. The reviewed sources identify no IRS ruling classifying all such contracts that way. |
These alternatives can affect whether gains are recognized when a position is closed or potentially under a mark-to-market approach, how gains are characterized, and where and to what extent losses can offset income. The right analysis may depend on the contract terms, venue, taxpayer’s circumstances, and final legal classification. KPMG’s paper assumes financial-derivative treatment for parts of its analysis while expressly declining to resolve whether that assumption is legally correct.
What tax forms a platform may provide
Forms are not a complete substitute for a trading ledger, and one platform’s documentation should not be generalized to all venues. Kalshi’s Help Center says that users who meet applicable reporting thresholds may receive a 1099-INT for interest, a 1099-MISC for credits or rewards, a 1099-B for broker transactions involving crypto transfers, and a 1099-DA for digital-asset transactions reported by ZeroHash. The stated 1099-B category is not a claim that Kalshi issues that form for sports-contract trades.

- Trade date and contract name, including the side and quantity.
- Entry and exit prices, settlement or sale proceeds, and the settlement outcome.
- Fees, rebates, credits, or rewards associated with the activity.
- Annual trade-history exports and any year-end open-position information relevant to the approach used for the return.
- Every information return received from the platform or a payment or brokerage provider.
Save the original platform exports and reconcile them against any tax forms and account statements. Kalshi’s P&L, for example, may help organize activity, but the platform itself says it is not tax advice. A tax-service guide likewise recommends retaining trade dates, contracts, prices, fees, and proceeds; that is recordkeeping guidance, not an authoritative determination of tax law. - Collect the full-year record. Download trade history, account statements, platform P&L data, and all tax forms. Include fees and rebates rather than relying only on gross deposits or withdrawals.
- Reconcile the activity. Match reported amounts to the underlying transactions and investigate gaps, duplicate entries, or differences in how a platform presents cash flows and trading results.
- Identify the classification question before choosing a form. The sources do not support telling every trader to use a particular IRS form or schedule. A form name should follow a defensible treatment of the trader’s contracts and facts, not a platform label or the absence of a tax form.
- Get individualized tax help when the stakes warrant it. Ask a qualified tax professional familiar with derivatives and wagering rules how the contract terms and venue affect reporting, gain character, timing, and losses. Tax software can organize transactions, but it cannot make the legal classification settled.
Scope: federal versus state tax
This discussion concerns U.S. federal income tax and relies in part on analysis focused on CFTC-regulated contract markets. It does not resolve state tax treatment, every platform’s reporting practices, or the facts of an individual return. Traders should check current rules for their state and seek jurisdiction-specific advice when state treatment or substantial gains and losses are involved.
