Re:

Are Mortgage Spam Texts Illegal, and How Can You Report Them?

An unwanted mortgage text is not automatically illegal. Whether federal rules apply depends on the message, sender, technology, consent, and whether it concerns an existing debt. Here is how to assess and report it.

Not every unsolicited mortgage text is illegal just because you did not ask for it. The legal answer depends on what the text says, whether it is marketing or debt collection, how it was sent, who sent it, and whether the sender had the consent required by the applicable rules. You can report unwanted texts to the Federal Communications Commission (FCC); suspected fraud can also be reported to the Federal Trade Commission (FTC) or the FBI’s Internet Crime Complaint Center (IC3).

When a mortgage text may be unlawful

“Spam” is a useful everyday description, not a legal verdict. A message can be annoying, unwanted, or suspicious without the available facts establishing a violation of federal law. Conversely, a text that looks polished or uses a real lender’s name is not necessarily legitimate. The first step is to work out what kind of message you received and what rules may apply.

For federal law, two important questions are whether the text is covered telemarketing sent using certain technology and whether it concerns collection of an existing debt. Fraud or impersonation raises a separate reporting issue. A single message may involve more than one concern, but each should be evaluated on its own facts.

Marketing and lead-generation robotexts

The Telephone Consumer Protection Act (TCPA) and FCC rules require consent for certain calls and texts made using an autodialer or an artificial or prerecorded voice. For a covered robotext that introduces an advertisement or constitutes telemarketing, FCC materials describe a prior express written consent requirement. That is not the same as saying every marketing text, however sent, always requires written consent: coverage depends on the technology, the content, the circumstances, and the applicable rules.

A mortgage text could advertise a lender, invite you to apply, or offer a refinancing or rate inquiry. It could also be a lead-generation message from a company seeking to connect you with a lender. The label the sender uses does not settle whether a message is covered telemarketing. The relevant facts include how the message was placed, what it offered, and whether you consented to receive that kind of message.

What to check about consent

  • Whether you opted in: Consider whether you entered a phone number on an application, quote form, contest, or other online form and agreed to receive texts. A text arriving after you shared your number does not by itself show what you agreed to.
  • Who received permission: Identify the company named in the form or consent language, if you can find it. Permission given in one context does not automatically establish that a different sender had permission for its message.
  • What the consent covered: A general request for information and permission for marketing messages are not necessarily the same thing. The wording and circumstances matter.
  • How the text was sent: The TCPA analysis can depend on whether the message used an autodialer or artificial or prerecorded content. A recipient may not be able to determine that from the text alone, so avoid treating a guess about the sending technology as proof.
  • What happened after an opt-out: Keep a record if you asked the sender to stop and further messages arrived. Whether the request was received and honored can be relevant, but it does not resolve every other question about the message.

These are questions for assessing a possible issue, not a checklist that proves a violation. The FCC materials do not determine whether an individual mortgage text broke the law without the facts about its sender, content, delivery method, and consent.

Texts about collecting an existing mortgage debt

A text about an overdue payment or other existing mortgage debt raises a different issue from an advertisement for a new loan. The Consumer Financial Protection Bureau (CFPB), in its interpretation of Regulation F under the Fair Debt Collection Practices Act (FDCPA), explains that the general prohibition on conduct whose natural consequence is harassment, oppression, or abuse can apply regardless of the communication medium, including text messages.

The CFPB’s example describes numerous unsolicited texts over several consecutive days as likely to violate that general prohibition in the circumstances assumed by the example. It is not a universal numerical limit on texts. The separate call-frequency presumptions do not simply apply to text messages, so a reader should not infer that a particular number of mortgage texts automatically makes a collector’s conduct illegal.

Frequency and context matter, but they are not the only possible facts. Consider whether the messages are connected to collecting an existing debt, how often and over what period they arrived, what they say, and whether they continued after you asked the sender to stop. A message claiming you owe money may also be fraudulent or impersonate a servicer; verify the sender independently rather than using the message’s link or phone number.

How to assess the text you received

Before deciding what to report, preserve the message and separate what you know from what you suspect. A screenshot can help you remember the wording, dates, and sender details, but do not forward a suspicious link or open it to investigate. The following questions organize the relevant facts without assuming that an unsolicited message is automatically unlawful.

  1. Is it an offer or a collection message? An invitation to apply, refinance, or request a quote is different from a demand for payment on an existing debt. If it contains both, note both features.
  2. Does it identify a company or account? Record the displayed sender, any company or servicer named, and any account reference. A familiar name can be impersonated, so its appearance does not authenticate the message.
  3. Do you recognize the interaction that preceded it? Think about whether you recently sought mortgage information or submitted a form and what permission you may have given. Do not assume a prior inquiry explains every later message.
  4. Does the text press you to act urgently, open a link, or disclose information? Those are reasons to use caution and independently verify the claim. They are not, by themselves, a complete legal finding.
  5. Have you received similar texts or asked for them to stop? Record dates and any opt-out request. That history may help an agency understand the pattern and may matter to an assessment of the circumstances.
  6. Could it be impersonation or fraud? If the sender claims to be a lender or servicer you use, contact that institution through a phone number or website you already know to be official. Do not use contact details supplied only in the suspicious text.

State law may provide additional protections, and the federal information summarized here does not resolve every state-specific question. If you need a legal assessment of your particular messages, the facts and applicable law may require advice specific to your situation.

Report an unwanted mortgage text to the FCC

The FCC accepts complaints about unwanted texts. In its complaint form, select “unwanted calls/texts”, then “all other unwanted calls/messages.” Describe the message accurately: for example, say whether it was an unsolicited mortgage offer, a message about an existing debt, or a text you believe impersonated a company. Include the dates and sender information you recorded.

Set the right expectation: the FCC says it does not resolve individual unwanted-call or text complaints. Its Consumer Inquiries and Complaints Center explains that complaints provide information used to inform policy decisions and may serve as a basis for potential enforcement actions against those violating its rules. Filing is therefore a way to report a pattern or possible violation, not a promise that the FCC will investigate your individual message, contact the sender for you, or obtain a particular result.

Report suspected mortgage-text fraud

If you think the message is a scam, report it to the FTC through ReportFraud or to the FBI through IC3. CFPB scam guidance also identifies your state attorney general and local police as possible contacts. These are additional options for a suspected fraud concern; they do not replace the FCC complaint route for an unwanted text or guarantee an individual resolution.

Go directly to official agency sites or use contact details you locate independently. Do not rely on a link, phone number, or reply instruction in the suspicious message to reach an agency or a supposed lender. Reporting becomes more useful when you can describe what was sent, when it arrived, what identity the sender claimed, and what action—if any—you took.

Protect your information while you verify the message

FCC consumer guidance warns against clicking suspicious links or providing personal or financial information through a text or a website reached from that text. A mortgage-related message may mention an application, payment, rate, or account, but that subject matter is not a reason to trust its link. Do not submit credentials, financial details, or other sensitive information through an unverified path.

If a text appears to come from a lender or servicer you actually use, check the claim by independently contacting that institution through a known official number or site. If the institution confirms that it sent a message, you can ask it about the communication through that separate channel. If it does not recognize the text, tell the institution that someone may be using its name and consider reporting suspected fraud to the FTC or IC3.

Keep the original message and sender details for your records, especially if you plan to complain or if similar messages continue. A record of the wording, dates, and any reply or opt-out request can make your description more precise. Do not engage with a suspicious sender merely to gather evidence.

Which reporting channel fits?

Concern Where to report What to expect
Unwanted mortgage text or possible communications-rule violation FCC complaint form: “unwanted calls/texts,” then “all other unwanted calls/messages” The FCC says complaints inform policy and may support potential enforcement; it does not resolve individual complaints.
Text that appears to be a scam or impersonation FTC ReportFraud or FBI IC3 CFPB guidance lists these as fraud-reporting options; use official contact details located independently.
Additional local or state fraud reporting Your state attorney general or local police CFPB guidance names these as possible contacts. The appropriate route depends on the circumstances.

You may have more than one concern: for example, a text can be unwanted and also appear fraudulent. Reporting to the relevant channels describes the conduct to agencies with different roles; it does not establish in advance that a law was violated.
