Yes, some low-cost imports may cost more or take longer to arrive, but the end of the U.S. duty-free de minimis treatment does not add one identical charge to every online order. The treatment was suspended for covered commercial shipments from all countries starting August 29, 2025, and a U.S. Court of International Trade opinion dated August 13, 2026 upheld that suspension in the case before it. What you pay now depends on the product and how it enters the country, as well as any other customs measures that apply.
What changed for low-value imports?
Before the change, the de minimis provision generally allowed qualifying imported goods valued at $800 or less to enter the United States duty-free. A July 2025 executive order suspended that treatment for covered commercial shipments globally, subject to exceptions and customs procedures. The suspension took effect August 29, 2025; U.S. Customs and Border Protection subsequently issued implementation rules for international mail and other shipment modes. The executive order and CBP’s e-commerce guidance describe the change and its administration.

The scale helps explain why the policy matters to online retail. CBP figures reported by the White House put de minimis shipments at more than 4 million per day on average. The same source says shipments grew from 134 million in 2015 to more than 1.36 billion in 2024. Those are shipment counts, not estimates of consumer price increases, and they do not show that every parcel came from a discount shopping platform. The White House fact sheet attributes the figures to CBP.
Does this mean every order has the same tariff?
No. Removing a duty-free entry route is not the same as imposing one universal tariff rate on every online purchase. The amount, if any, due on a particular shipment depends on customs treatment and other measures applicable to it, including product, origin, classification and shipment channel. The available legal and agency sources do not establish a single present-day landed cost for an ordinary shopper’s order.

Also, the temporary 10% surcharge under Section 122 was limited to February 24 through July 24, 2026, according to CBP’s implementation guidance. It is not a current rate to add to a purchase. CBP’s Section 122 guidance gives the dates and implementation details.
What is the legal status of the suspension?
In an August 13, 2026 opinion in Axle of Dearborn, the U.S. Court of International Trade upheld the rescission of de minimis treatment in the case before it. The court treated the suspension as distinct from the administration’s IEEPA tariffs, which the Supreme Court had invalidated in February 2026. That ruling on IEEPA tariffs did not, by itself, restore de minimis treatment. The court opinion also notes that Congress separately set July 1, 2027, as the statutory repeal date for de minimis. What might shoppers notice at checkout?
The policy can mean that a shipment that previously qualified for duty-free entry no longer uses that route. But the policy alone does not establish the specific charge for a given item or show how much a retailer has passed through to its prices. The sources available do not quantify current price changes at Temu, Shein or other individual retailers.
Associated Press reporting in 2025 described the prospect of higher consumer prices or delivery delays and included examples of retailers displaying import charges or saying tariffs were reflected in listed prices. Those examples show how retailers presented costs at that time, before the global suspension took effect; they do not establish each retailer’s policy in October 2026. In April 2025, Circana chief retail advisor Marshal Cohen said, “Shoppers had a full array of product and options of timing.” That was a historical observation about the choices consumers faced before the change, not a current assessment. The Associated Press reported on retailer examples and likely effects; its April 3, 2025 coverage included Cohen’s comment.

How to compare the real cost of an order
When comparing a low-priced item, look beyond its sticker price. Retailer practices and delivery estimates can change, so check the information attached to the specific order you are placing.
- Final checkout total: Compare the amount due before placing the order, including any import or delivery charges the retailer shows.
- Delivery estimate: Compare the promised arrival window; a lower item price may not be as attractive if delivery is slower or less certain.
- Fulfillment location: Check where the item is stated to ship from. The product’s origin and the shipment channel can affect customs treatment, so a seller’s location alone may not answer how the parcel will be handled.
- Unstated charges: If the retailer does not explain whether import charges are included or could be collected later, do not assume the displayed item price is the final cost.
What this means for the “death blow” headline
The duty-free route for covered low-value commercial imports has ended, so the policy can put pressure on some of the prices and delivery advantages associated with inexpensive cross-border shopping. But the evidence does not support saying that cheap online shopping is over, that every order now carries the same surcharge, or that any named retailer has raised prices by a particular amount. For a shopper, the practical test is the actual total and delivery terms for the order—not a blanket tariff percentage.
