A federal judge in Rhode Island ruled on September 18, 2026, that the EPA unlawfully terminated Solar for All and vacated the agency’s action. That ruling did not establish that grants have restarted: the latest confirmed reporting says EPA was reviewing the decision and considering its options, while the available sources do not establish whether it appealed, whether the order was stayed, or whether funding resumed. A separate lawsuit brought by 23 states had a different district-court result and was on appeal.
What is Solar for All?
Solar for All was a $7 billion grant program within the $27 billion Greenhouse Gas Reduction Fund created under the Inflation Reduction Act. The program was intended to support solar power for lower-income households. EPA described the intended reach as more than 900,000 households; that figure is a program target, not a count of households that received solar installations or savings. EPA’s Greenhouse Gas Reduction Fund page describes the fund and the agency’s position on the program.
The grants were awarded to program recipients to develop and deliver projects; the headline amount does not mean that individual households were each promised a direct payment. For example, a congressional statement said a $250 million Harris County award was planned to support solar and battery storage for more than 28,000 low-income and working-class households. It projected average savings of $468 per household per year before the program was terminated. Those are planned reach and estimated savings, not verified installations or realized bill reductions. Why did the EPA end the program?
On August 7, 2025, EPA announced it would no longer implement Solar for All. The agency argued that the 2025 Working Families Tax Cut repealed its authority for the program and rescinded the remaining funds. That was EPA’s stated rationale, not a final judicial finding that its interpretation was correct. EPA Administrator Lee Zeldin characterized the spending by saying, “The days of ‘throwing gold bars off the Titanic’ are over.” The quotation is the administrator’s political characterization, not a neutral description of the grants. What did the Rhode Island judge decide?
In Rhode Island AFL-CIO et al. v. EPA, a case brought by the Rhode Island AFL-CIO, Rhode Island Center for Justice, Solar United Neighbors, businesses and individuals against EPA and Administrator Lee Zeldin, U.S. District Judge Mary S. McElroy ruled on September 18, 2026, that the termination was unlawful and vacated it. The order is listed as Doc. 48 in case 1:25-cv-00510 in the District of Rhode Island’s opinions index; the memorandum and order is the primary court record. The Associated Press reported that EPA was reviewing the decision and considering options for appeal.
Vacating the termination is a court ruling against EPA’s 2025 action. It should not be read as confirmation that grants are already available again or that planned household benefits have been delivered. The sources available for this account do not establish whether EPA subsequently appealed or obtained a stay, or whether implementation resumed. How is the separate 23-state lawsuit different?
The Rhode Island case is not the only Solar for All litigation. A separate case, Arizona et al. v. EPA, was filed by 23 states in the Western District of Washington. Its district-court outcome was different: on June 1, 2026, the court granted summary judgment to the federal defendants. The states appealed to the Ninth Circuit on July 30, 2026, according to the Oregon Department of Justice litigation tracker.

What does the ruling mean for households?
For households, the key distinction is between a legal decision about EPA’s termination and actual access to a solar project or lower energy bills.
