Under the Railway Labor Act, a strike becomes available only after the National Mediation Board (NMB) releases the parties from mediation and a 30-day cooling-off period ends, unless a Presidential Emergency Board intervenes. The dispute has since moved on: the Association of Flight Attendants-CWA (AFA) said members ratified a tentative agreement on May 12, 2026, and reported implementation work in September.
Why a strike authorization vote was not enough
A strike authorization vote shows that union members support a possible strike and can increase pressure at the bargaining table. It is not legal permission to stop work, does not release a dispute from mediation, and does not start the statutory 30-day countdown. AFA’s explanation of the Railway Labor Act (RLA) says a strike is available only after negotiations reach the self-help stage: AFA’s RLA overview.
The RLA covers airline carriers and their employees. In airline bargaining disputes, the NMB provides statutory mediation. As the Board explains, “Strikes, lock-outs, and other forms of self help in these industries may occur only after the NMB has determined that further mediation would not be successful and after a cooling-off period of 30 days following NMB release from mediation.” National Mediation Board, Mediation Overview & FAQ.
What has to happen before airline workers can legally strike?
- Mediation continues. The NMB works with the parties to resolve the dispute. While the parties remain in mediation, they cannot resort to a strike or lockout.
- The NMB releases the parties. If either side rejects the Board’s proffer of arbitration, the NMB may determine that further mediation would not succeed and release the parties from mediation. Rejection of arbitration alone is not the start of a strike: the Board’s release is the trigger for the cooling-off period.
- The 30-day cooling-off period runs. The parties have 30 days after release to reach an agreement. The NMB may bring them back for more discussions during that period.
- Self-help may become available. If there is no agreement when the cooling-off period ends, the parties may resort to self-help, such as a strike or lockout, unless a Presidential Emergency Board (PEB) is created. A PEB changes the next step in the process.
The NMB describes its role as fostering “the prompt and orderly resolution of collective bargaining disputes in the railroad and airline industries.” The statutory sequence means the timing of a strike is not something members or the union can set by vote alone.

What happened in United’s negotiations
Second tentative agreement
On March 26, 2026, AFA announced that it had reached a second tentative agreement with United during a mediated session. The union listed improved base-pay rates, restrictions on red-eye flying, sit pay for scheduled and rescheduled sits longer than 2.5 hours, increased retro pay, and improved hotel and electronic-notification language among the changes. Ratification and implementation
AFA reported that members ratified the agreement on May 12, 2026. The union said 88.85% of eligible members participated and 82% voted yes. AFA also described the agreement as providing an average base-pay increase of 31% and $741 million in retro pay. Those figures are AFA’s reported terms, not independently audited figures. In a September 9, 2026 update, AFA discussed processing payments for reboarding and cancellations and ongoing implementation of agreement provisions. That establishes that implementation work was still underway in September; it does not establish that every provision had been implemented by October 8, 2026. AFA’s September implementation update.

“Why can’t United flight attendants strike?” has two parts. During the bargaining impasse, the RLA’s mediation and cooling-off requirements meant that a strike authorization vote alone did not make a strike lawful. Since then, AFA has reported a ratified agreement, so the immediate dispute described by the strike question has moved beyond that impasse. The available September update documents ongoing implementation, not the completion date for every contract provision.
