The broader issue is clear: unauthorized workers are a substantial share of the hired crop workforce, while the H-2A visa program is a separate, regulated channel for temporary agricultural jobs—not an instant replacement for the workers already on farms.
What farmers’ concern about deportations is about
Farm work can be seasonal, physically demanding, and tied to narrow planting and harvest windows. When workers who already know a farm’s crops and routines are removed, employers may struggle to find replacements quickly enough to keep work on schedule. That is the economic concern behind public appeals to limit enforcement affecting farms; it is not proof that every farm depends on unauthorized labor or that every immigrant worker lacks authorization.
In June 2025, the Associated Press reported that the Trump administration directed a pause in certain immigration arrests or investigations involving farms and other industries. The report followed President Donald Trump’s public acknowledgment that employers said long-time workers were difficult to replace. That was a dated policy episode, not evidence of current enforcement practice. AP’s June 14, 2025 report quoted Trump’s post saying that employers had described “very good, long time workers” being taken away and their jobs as “almost impossible to replace.”
In a separate June 13, 2025 report, California Farm Bureau senior policy advocacy director Bryan Little said the state’s agriculture depends on and values its workforce, and warned that continued enforcement in that direction could make it harder to produce and move food to grocery shelves. Those comments represent the California Farm Bureau official, not the unidentified farmers behind the headline. AP’s report on Little’s comments provides that context.

How many crop farmworkers lack work authorization?
The most useful national estimate is specific to hired crop workers. USDA’s Economic Research Service reports that 42% had no work authorization in 2020–22, based on the U.S. Department of Labor’s National Agricultural Workers Survey. That estimate is not a count of all immigrants, all farmworkers, or all agricultural employees. The survey excludes H-2A workers and livestock workers, and USDA cautions that legal status is difficult to measure. See USDA ERS’s farm labor overview.
Uncertainty around the estimate matters. The Congressional Research Service summarizes the survey’s 2021–22 estimate as a range: 37% to 47% of crop farmworkers lacked work authorization at a 95% confidence interval. CRS also gives a lower-bound extrapolation of roughly 327,000 unauthorized workers on crop-producing farms, but that figure depends on the survey remaining applicable when extrapolated. Why H-2A does not simply replace existing workers
H-2A is a temporary or seasonal hiring program for agricultural employers who anticipate a shortage of available U.S. workers. It does not give employers a general-purpose pool of workers to substitute for anyone removed from a job. Employers must recruit U.S. workers and complete a process involving state workforce agencies, the Department of Labor, U.S. Citizenship and Immigration Services, and consular processing. Farmers.gov says the standard application path generally takes 60–75 calendar days. Details are available in Farmers.gov’s H-2A guidance.
The scale of the program is significant, but it remains distinct from the established workforce. CRS reports that DOL approved temporary labor certifications for approximately 363,000 H-2A farmworkers in fiscal year 2024. A certification is part of the program’s process; it should not be confused with an estimate of all agricultural workers or a count of unauthorized workers.

H-2A can help fill some seasonal shortages, but its recruitment steps and costs make it different from retaining an experienced workforce already in place. It also does not answer every agricultural labor need: the crop-worker survey estimate cannot be generalized to livestock operations, and eligibility depends on the temporary or seasonal nature of the job.
What farm employers must know about H-2A wages
H-2A wage requirements can vary by state and are subject to policy changes. USDA ERS lists fiscal year 2025 examples ranging from $14.83 in Arkansas, Louisiana, and Mississippi to $19.97 in California, $20.08 in Hawaii, and $22.23 in the District of Columbia. These are historical FY2025 figures, not current rates. ERS says employers must meet the highest applicable benchmark among the relevant federal, state, prevailing-wage, and AEWR requirements.

As of the Department of Labor’s September 2, 2026 notice, currently issued Adverse Effect Wage Rates remain in effect. A court found the methodology established by the October 2025 interim final rule unlawful but did not vacate it, and DOL says it must develop a new methodology. The department says some employers may later need to adjust wages for the notice’s defined backpay period if new methodology-based rates exceed what they paid; the notice does not establish that a final backpay obligation already exists. Employers should consult DOL’s September 2, 2026 notice for the operative details.

The practical distinction is between a workforce already doing the work and a temporary visa program with eligibility rules, recruitment requirements, costs, and wage protections. Immigration enforcement can disrupt farms that depend on workers who are hard to replace quickly, while H-2A offers a regulated option for some seasonal needs—not a universal or immediate replacement for all immigrant farm labor.
