Why did the Justice Department sue California over eggs?
On July 9, 2025, the U.S. Department of Justice (DOJ) announced a lawsuit against California and state officials over state rules governing eggs and egg products. The defendants named in the complaint were the State of California, Governor Gavin Newsom, California Agriculture Secretary Karen Ross, California Department of Public Health Director Erica Pan, and Attorney General Rob Bonta. DOJ sought declaratory and injunctive relief.
The government’s central legal argument was that the federal Egg Products Inspection Act (EPIA) preempts state requirements that add to or differ from federal requirements for egg quality, inspection, and packaging. The complaint argued that California’s rules burdened producers and raised egg prices. Those were the United States’ claims in its complaint, not conclusions reached by a court. What California rules were at issue?
The complaint focused on California measures including Proposition 12, a 2018 ballot initiative that amended or supplemented standards established through earlier measures, including Proposition 2 and AB 1437. As described in the complaint, the rules included housing requirements for egg-laying hens: they must be able to lie down, stand up, fully extend their limbs, and turn around freely.

DOJ’s complaint also quoted a California Department of Food and Agriculture regulatory analysis concerning space allowances. The agency analysis said the allowances were not based on particular peer-reviewed studies or accepted scientific standards for reducing foodborne illness or other human-safety concerns. That is a statement from an agency analysis quoted in the federal complaint; it is not a court’s finding about the law’s effects or validity. The DOJ complaint provides the attribution.
Did California’s egg law make prices go up?
The DOJ alleged that California’s requirements increased costs and contributed to higher egg prices. The available evidence does not establish a reliable causal estimate isolating how much the rules affected what consumers paid. The complaint’s price claim should therefore be understood as the federal government’s allegation, not as a proven or quantified effect.

DOJ Assistant Attorney General Brett Shumate said when the suit was announced that “Bureaucratic red tape and unnecessary regulations implemented by the State of California have made the cost of everyday goods, like eggs, less affordable for Americans.” That statement expressed the administration’s position; it was not a judicial finding. The reviewed material does not provide a verified consumer egg-price figure or percentage attributable to Proposition 12.
What happened to the lawsuit over Proposition 12?
On March 20, 2026, California Attorney General Rob Bonta announced that the U.S. District Court for the Central District of California had dismissed the Trump administration’s challenge to Proposition 12. Bonta characterized the decision as affirming that the administration had no valid case, but that is his description, not quoted language from the court. The state’s release did not explain the court’s reasoning, and the dismissal order’s reasoning and any later procedural developments are not established by the available account. California Attorney General’s announcement reports the dismissal.

Is the egg price-fixing settlement the same case?
No. The lawsuit against California concerned state regulation and the federal government’s preemption and price claims. A separate federal and state antitrust case involved allegations that egg producers coordinated bids affecting Urner Barry egg-price quotes, a private benchmark. It was not a challenge to California’s laws.
On June 30, 2026, California announced that Cal-Maine Foods, Versova, and Hickman’s had settled that separate case with DOJ and a coalition of 17 state attorneys general. California said the settlement included $3.3 million paid to states, a commitment to refrain from illegal price-fixing conduct, and donations of more than 53 million eggs to food banks in coalition states, including 8.9 million eggs—741,666 cartons—for California food banks. These are settlement terms resolving allegations, not a trial verdict or proof of the claims in the California-lawsuit case. The payments and donations were not announced as direct consumer refunds or price savings. California’s settlement announcement gives the terms, and DOJ’s announcement describes the separate resolution.
