The European Commission announced a €200 million fine against Temu on 28 May 2026, saying the marketplace had failed to properly assess systemic risks linked to illegal products and consumer harm under the Digital Services Act (DSA). The case began with formal proceedings in October 2024 and a preliminary finding in July 2025. It is separate from a parallel EU consumer-law action concerning practices such as discounts, refunds and reviews.
What the EU’s Temu case is about
The DSA proceeding concerns how Temu assessed and managed the risk that illegal products could be offered through its marketplace. The Commission’s July 2025 preliminary finding said Temu’s October 2024 risk assessment was inaccurate and relied on general industry information rather than details specific to Temu. The Commission said that could lead to inadequate mitigation.

The Commission’s mystery-shopping analysis found a high risk that EU consumers would encounter non-compliant products on the platform, citing baby toys and small electronics as examples. These were regulator-reported examples, not a finding that every product in either category—or every Temu listing—is illegal or unsafe. The Commission’s May 2026 announcement said the assessment also failed to account properly for how recommender systems and affiliated influencers’ promotions could amplify risks. That is the Commission’s stated reasoning, not an independently measured causal finding.

Why the Commission opened broader DSA proceedings
The illegal-product risk assessment was one part of a wider inquiry. When proceedings opened in October 2024, the Commission also identified suspected issues involving the effectiveness of Temu’s risk mitigation, potentially addictive design, recommender-system transparency and access to data for researchers. The July 2025 preliminary announcement said those other parts remained under investigation.

The Commission’s May 2026 announcement said Temu’s assessment did not properly account for risks that recommendations and affiliated-influencer promotions could amplify the spread of illegal products. This describes the regulator’s stated basis for enforcement; it should not be read as a separate finding that every recommendation or promotion caused harm.
The consumer-law action is a separate track
The CPC Network action is not the DSA proceeding and addresses different concerns. In November 2024, national consumer authorities and the Commission said they were examining practices they considered potentially contrary to EU consumer-protection law. The concerns included:

Product-safety rules also apply
The Commission’s 2024 announcement described the General Product Safety Regulation (GPSR), applicable from 13 December 2024, as requiring an EU-established responsible economic operator for covered products. It also said national market-surveillance authorities can order unsafe products to be taken offline. This product-safety framework complements the DSA; it is not the same enforcement track. What is known about the next steps
The Commission said Temu had until 28 August 2026 to submit an Article 75 action plan. That deadline has passed, but the information available here does not establish whether a plan was filed. It also does not confirm whether Temu paid the fine or appealed. No outcome on those points should be assumed.
The May 2026 Commission page was not accessible in the reviewed materials; the fine, the action-plan deadline and the details about recommender and influencer amplification are attributed to the Commission’s search-result text. The announcement is therefore reported as the Commission’s position, without adding an unverified payment date, appeal result or later procedural development.
