Tesla generally sells vehicles directly to customers rather than through independent franchised dealerships. It also operates its own retail and service locations, so “no dealerships” does not mean “no physical locations.” The distinction matters because state franchise laws can restrict where and how an automaker may sell directly.

How Tesla’s sales model differs from a traditional dealership

In a conventional franchise model, an automaker sells vehicles through independently owned businesses that operate as authorized dealers. Tesla describes a different arrangement: it sells directly to customers and operates its own retail locations. That puts the manufacturer, rather than an independent franchisee, in the direct sales relationship with the buyer. Tesla’s FY2025 Form 10-K describes its direct-sales model and retail network.

Question Traditional franchised sales Tesla’s described model
Who sells the vehicle? An independent franchise dealer sells to the customer. Tesla generally sells directly to the customer.
Who operates the retail location? The franchise dealer operates its business. Tesla operates its own retail locations, subject to state-specific restrictions.
How does state law affect sales? Franchise laws govern the relationship between automakers and dealers. State laws may limit direct sales or manufacturer-owned stores; rules and outcomes vary by jurisdiction.
Who provides service? Service arrangements vary by automaker and dealer. Tesla identifies company-owned service locations and Mobile Service technicians; access and arrangements are not established as identical everywhere.

Why the model is contentious

State motor-vehicle franchise laws are a central constraint. Tesla says some laws may be interpreted to limit its direct-to-consumer model or its ability to sell through company-owned stores. The company has also reported legal and administrative challenges to its operations. Those statements describe Tesla’s position in its filings; they are not a state-by-state legal opinion. Tesla’s FY2025 Form 10-K

Because the rules differ by state, it would be inaccurate to say a single restriction applies across the United States. Tesla’s FY2024 filing described states where licensing was required for direct sales and said the company used educational “galleries” in some places where sales could not take place. That is useful background, not proof that galleries are used everywhere or remain the current arrangement in every affected state. Tesla’s FY2024 Form 10-K

A Wisconsin example shows how state rules can matter

On March 26, 2025, the Associated Press reported that Tesla was suing to seek an exemption from a Wisconsin restriction on manufacturer-owned dealerships. The report said Wisconsin statutes generally prohibited manufacturers from owning or operating dealerships. This is a dated example of the kind of legal conflict the direct-sales model can encounter—not a complete account of state law, or confirmation of the lawsuit’s current status or outcome. Associated Press, March 26, 2025

Sales and service are separate questions

Not using independent franchised dealerships for sales does not mean Tesla has no customer-facing locations or service operations. Tesla says it has company-owned service locations and Mobile Service technicians. Those details describe the types of service channels the company operates; they do not establish that service access, coverage, or convenience is the same in every area. Tesla’s FY2025 Form 10-K

What the available evidence does—and does not—establish

Tesla’s filings explain how the company sells and identify state-law restrictions and challenges, while the Wisconsin report gives one dated example. These sources do not provide a complete state-by-state legal map, the current outcome of every dispute, or quantified evidence comparing buyer outcomes under direct sales and franchised sales. Tesla has not given a single universal explanation in these cited filings for why it chose this structure, so claims about a particular executive’s rationale or a specific consumer benefit should not be inferred from the model alone.
