Nova Scotia’s announced $25,000 fine for violating its 2025 woods restrictions could total $28,872.50 once the victim-fine surcharge and court costs were included. The surcharge was not the entire difference, and the Province’s figure was a possible total—not a separate $28,872.50 fine. Later, the Supreme Court of Nova Scotia reportedly ruled the ban unreasonable and invalid; the Justice Centre for Constitutional Freedoms also reported that the Crown withdrew one man’s ticket.
Why could the fine total $28,872.50?
On May 2, 2025, the Government of Nova Scotia said the wildfire fine was set permanently at $25,000 and that the total could reach $28,872.50 with the victim-fine surcharge and court costs. Nova Scotia’s regulation sets the victim-fine surcharge at 15 percent of a fine or other monetary penalty. Applied to $25,000, that rate is $3,750. The remaining difference between $25,000 and the announced possible total is $122.50, but the announcement does not provide an itemized cost calculation. What did the 2025 woods restrictions prohibit?
The restrictions took effect at 4 p.m. on August 5, 2025. The Province prohibited hiking, camping, fishing and vehicle use in woods; camping in campgrounds remained allowed. The restrictions were imposed under a fire proclamation whose period began July 30, 2025, and was set to run until October 15 unless revoked or amended. The proclamation cited section 24(1) of the Forests Act and said violations were subject to prosecution. Nova Scotia fire proclamation.
When did the restrictions end?
On September 18, 2025, the Province said woods restrictions had been lifted in the remaining counties except Annapolis. A provincewide burn ban remained in effect until October 15, 2025, or until conditions improved. These are historical dates; they do not establish what restrictions, if any, apply now. Reported ruling on the ban
The Justice Centre for Constitutional Freedoms reported that the Supreme Court of Nova Scotia found the 2025 ban unreasonable and invalid on April 17, 2026. According to the organization’s account, the court found that the government had failed to properly consider Charter rights and values, including mobility rights. Separately, the Justice Centre reported that the Crown withdrew Jeffrey Evely’s ticket on June 24, 2026, ending enforcement proceedings that had been scheduled for July 22.
