Why Elon Musk Mocked Jeff Bezos Over Space Lawsuits—and What SpaceX Is Suing

Elon Musk’s 2021 jab at Jeff Bezos followed Blue Origin’s challenge to NASA’s decision to award SpaceX a lunar-lander contract. Blue Origin’s federal procurement case was dismissed. A later lawsuit by SpaceX, reported as settled in 2026, was against the California Coastal Commission, a state regulator—not the federal government. The available reporting does not establish whether that is the later case implied by the headline.

What Musk said—and what prompted the taunt

In 2021, Musk mocked Bezos as Blue Origin pursued legal challenges involving SpaceX. Fox Business reported Musk’s social-media remark: “Turns out Besos retired in order to pursue a full-time job filing lawsuits against SpaceX…” The spelling “Besos” is reproduced as it appeared in the reported quote; the remark was a taunt, not a factual description of Bezos’s work. Fox Business reported the exchange.

The context included two separate disputes. Blue Origin challenged NASA’s selection of SpaceX for the Human Landing System (HLS), part of the Artemis program. Separately, Amazon subsidiary Kuiper Systems filed with the Federal Communications Commission concerning SpaceX’s proposed second-generation Starlink system. The FCC matter was not Blue Origin’s NASA procurement case.

How Blue Origin challenged NASA’s SpaceX award

The Government Accountability Office protest

Blue Origin and Dynetics first protested NASA’s award at the Government Accountability Office (GAO). On July 30, 2021, GAO denied the protests. It found NASA could make a single award because the solicitation made the number of awards dependent on available funding and allowed for one, multiple, or no awards. GAO considered NASA’s evaluation reasonable.

GAO did identify a limited instance in which NASA waived a requirement for SpaceX, but concluded the protesters had not shown a reasonable possibility that the discrepancy prejudiced their competitive chances. GAO reported SpaceX’s total evaluated price as $2,941,394,557 and said its proposal was the lowest-priced and highest-rated. That is GAO’s figure for the 2021 evaluation, not a current contract price. Read GAO’s statement on the protests and evaluated price.

The Court of Federal Claims case

Blue Origin then sued in the U.S. Court of Federal Claims, naming the United States as defendant; SpaceX intervened as a defendant. Blue Origin alleged, among other things, that NASA waived requirements for SpaceX, held unequal discussions, failed to revise the solicitation when funding was lower than anticipated, evaluated proposals improperly, and breached an implied duty of good faith and fair dealing.

The court dismissed the case. It concluded Blue Origin lacked a substantial chance of receiving the award even if its allegations were true, and also rejected its arguments on the merits: Blue Origin had not shown that NASA’s procurement decisions were arbitrary, capricious, or contrary to law. The opinion noted that Blue Origin’s proposal exceeded NASA’s available funding and was noncompliant. Read the Court of Federal Claims opinion.

NASA’s announcement that day said GAO had denied the protests and upheld the selection of SpaceX to continue developing its human landing system. NASA’s July 30, 2021 statement.

What SpaceX’s later lawsuit was about

The later case identified in available reporting concerned the California Coastal Commission, a state body, not a federal agency. The Associated Press reported that SpaceX sued over the commission’s opposition to expanding Falcon 9 launches from Vandenberg Space Force Base. SpaceX alleged political discrimination and violations of its free-speech and due-process rights. Read the Associated Press account of the settlement.

AP reported in 2026 that the parties settled. Under the reported terms, the commission agreed not to consider Musk’s perceived political beliefs, speech, or SpaceX’s labor practices when taking regulatory action; the case would be permanently dismissed, and the commission would not require a state coastal-development permit for the launch program. The commission continued to cite concerns about coastal access, sensitive species and habitat, and sonic booms. These are AP-reported settlement terms; they do not establish that this is the federal-government lawsuit suggested by the headline.

How the two legal episodes differ

Does this establish that SpaceX is suing the federal government?

No. The 2021 action was Blue Origin’s challenge to a federal procurement decision. The later SpaceX lawsuit identified in the available account was against a state commission. That account does not verify a separate SpaceX lawsuit against the federal government, nor does it establish that the commission case is the lawsuit intended by the headline.
