Why Disney+ Was Tied to a Wrongful-Death Lawsuit

Disney+ entered the case through Disney’s arbitration argument based partly on a trial signup. Disney later waived arbitration; the case was reported dismissed in 2026.

Disney+ entered a wrongful-death case not because of anything shown on the service, but because Disney argued that terms Jeffrey Piccolo accepted when he signed up for a Disney+ trial could require his claim to be decided in arbitration rather than court. Disney later waived that argument, and the case proceeded in court. News 12 reported that Piccolo dismissed it on February 27, 2026; available reporting does not establish whether the dismissal involved a financial settlement.

What happened at Disney Springs

Kanokporn “Amy” Tangsuan, who had severe dairy and nut allergies, dined with her husband, Jeffrey Piccolo, at Raglan Road Irish Pub at Disney Springs on October 5, 2023. The details about the meal and restaurant are allegations in the complaint, not findings that a court made.

As the Associated Press reported from the complaint, the couple repeatedly asked about allergens, and a waiter allegedly checked with the kitchen about whether certain foods could be made allergen-free. The complaint said the waiter guaranteed the food was allergen-free, although some dishes did not carry allergen-free flags. It alleged that about 45 minutes after eating, Tangsuan suffered an allergic reaction, used an EpiPen, collapsed, and later died at a hospital. The medical examiner’s investigation determined the cause of death was “anaphylaxis due to elevated levels of dairy and nut in her system.” (Associated Press report)

Piccolo brought the case on behalf of Tangsuan’s estate, alleging wrongful death. The Associated Press reported that he sought more than $50,000. That was the amount requested in the complaint, not a court award or a disclosed settlement.

Why Disney+ became part of the lawsuit

In a May 31, 2024 motion, Walt Disney Parks and Resorts U.S., Inc. asked a Florida court to compel arbitration and pause the court case. Disney argued that Piccolo had accepted terms broad enough to cover the dispute. Its argument relied in part on a Disney+ trial signup in 2019 and on terms Piccolo accepted later when using a Disney account to buy park tickets. That was Disney’s contract interpretation in a motion—not a court ruling that the terms applied to Tangsuan’s estate or that the case had to go to arbitration. Piccolo’s lawyers argued that the estate did not exist when he accepted the account and ticket terms, according to the Los Angeles Times. That, too, was an argument by a party; the available reporting does not show a court resolving the arbitration dispute.

Disney dropped its arbitration demand; the case was later dismissed

On August 19, 2024, Disney Experiences chair Josh D’Amaro said Disney would waive arbitration and allow the case to proceed in court: “As such, we’ve decided to waive our right to arbitration and have the matter proceed in court.” The Los Angeles Times reported Disney said the case’s “unique circumstances” warranted a “sensitive approach to expedite a resolution for the family who have experienced such a painful loss.” (Los Angeles Times report)

News 12 reported that court documents show Piccolo dismissed the case on February 27, 2026. A later CourtDocket summary described the dismissal as with prejudice and quoted attorney Brian Denney saying the case “has been resolved.” The reporting reviewed does not disclose whether money changed hands or provide settlement terms, so it does not support stating that a financial settlement occurred. What the story does—and does not—show

  • Disney+ was connected through a contract argument. Disney invoked terms associated with Piccolo’s trial account, along with later park-ticket terms, to seek arbitration.
  • The arbitration request was not a ruling. Disney waived its demand before the reported dismissal, so the sources reviewed do not establish that a court decided whether the terms controlled the case.
  • The restaurant allegations remain allegations. The complaint described assurances about allergen-free food; those claims should not be presented as a court’s finding.
  • The reported dismissal is not proof of a disclosed payout. The sources reviewed do not establish financial settlement terms.
