Irish broadcaster Dave Fanning sued Microsoft entities and article producer BNN Breaking after his photograph appeared beside an MSN headline about a different broadcaster facing trial for alleged sexual misconduct. Fanning was not the person involved in that trial. Early court reporting described his position as clear, but did not establish that Microsoft or any other defendant was liable.
What did the MSN article say, and why was Fanning’s photo there?
In January 2024, The Irish Times reported that Fanning had begun defamation proceedings after his photograph appeared with an MSN article headlined “Prominent Irish broadcaster faces trial over alleged sexual misconduct.” The headline referred to another broadcaster; that person was later acquitted. The trial was not Fanning’s. The Irish Times report covered the early court proceedings.
Futurism later described BNN Breaking as the producer of the article and MSN as the aggregator that carried it. The Irish Times said the article was removed the day after publication; Futurism reported that it appeared on MSN’s homepage for several hours before removal. Those accounts describe the timing differently, so they do not establish one exact duration. Futurism’s June 6, 2024 report also linked the incident to AI-assisted news production.
What did Fanning allege, and what did the court say?
Fanning’s case was a defamation action. At an early hearing, High Court Justice Cian Ferriter was considering an application to serve proceedings outside Ireland. The Irish Times quoted him saying Fanning’s position that he had “absolutely nothing” to do with the trial “cannot be gainsaid,” based on the material before him.

That reported remark concerned the procedural application and Fanning’s connection—or lack of one—to the trial. It was not a final ruling on whether the article was defamatory, whether any defendant was legally responsible, or what damages might be due. The available reporting does not establish that Microsoft was found liable.
What role did AI play—and what remains unknown?
Futurism, drawing on a New York Times investigation, reported that BNN employees used generative AI to paraphrase material from other news services and that the site produced thousands of articles daily, most reportedly without human fact-checking. This describes the reported publishing process generally; it does not prove exactly how Fanning’s photograph came to accompany this particular story.

- With 16 GB of memory, runs as many programs as you want without losing the execution
- The 13.5" 2256 x 1504 screen provides a great movie watching experience
- 512 GB SSD is enough to store your essential documents and files, favorite songs, movies and pictures
- 8 Hours battery run time helps you stay unwired and work longer non-stop
The reporting connects the case to AI-assisted production and the aggregation of news, but does not provide a definitive technical finding about the image mismatch. Nor does the reported scale of BNN’s output quantify the harm from this incident.

Futurism described the case as pending in June 2024. A procedural update dated April 29, 2026, described the matter as ongoing before Ireland’s High Court and said no final judgment or resolution had been publicly reported as of that update. The update says it relies on public reporting and does not independently verify the material. The April 2026 status update therefore supports describing the case as reported ongoing as of April 2026—not making a claim about its status after that date.
