Caroline Ellison was sentenced to two years in prison on September 24, 2024, for her role in the FTX fraud. U.S. District Judge Lewis A. Kaplan credited her extensive cooperation with prosecutors, but concluded that the seriousness of her participation still required prison. The Associated Press reported that she was ordered to report on November 7, 2024; that historical report date does not establish her current custody status.

What was Caroline Ellison sentenced for?

Ellison pleaded guilty to seven counts, according to the U.S. Department of Justice: two counts of conspiracy to commit wire fraud, two wire-fraud counts, one commodities-fraud conspiracy count, one securities-fraud conspiracy count, and one money-laundering conspiracy count. Judge Kaplan imposed a two-year prison sentence in Manhattan federal court on September 24, 2024.

The sentence should not be confused with the higher statutory maximum penalties attached to individual charges. Those maximums describe potential legal exposure, not the sentence Ellison actually received.

Why did she receive prison despite cooperating?

Ellison’s cooperation was extensive, but the court weighed it against her own culpability and the scale and seriousness of the fraud. The AP reported that Kaplan called her cooperation “very, very substantial” and “remarkable,” while finding that the case warranted imprisonment. He said cooperation could not be a “get-out-of-jail-free card” in a case of this gravity.

Prosecutors described her assistance as crucial to their successful prosecution of FTX founder Sam Bankman-Fried. They said she met with them, reviewed records, gave information about Alameda and FTX, disclosed her own misconduct, and testified at Bankman-Fried’s trial. They also noted that the investigation was complicated by the destruction of evidence.

Ellison’s defense had asked for time served. In a September 10, 2024, sentencing memorandum, her lawyers emphasized her acceptance of responsibility, cooperation, and the consequences of her conduct. That was the defense’s request, not the sentence the judge ultimately imposed.

What was Ellison’s role in the FTX fraud?

The criminal sentence followed her guilty plea to fraud-related offenses. Separately, the Securities and Exchange Commission described allegations that Bankman-Fried, with Ellison’s and other executives’ knowledge, directed FTX customer funds to Alameda for investments and loans to executives. The SEC said the executives consented to judgments without denying the Commission’s allegations. This is the SEC’s account of its civil case, not a finding by the sentencing judge.

At sentencing, Ellison apologized. The AP reported her statement: “I’m deeply ashamed with what I’ve done.”
