The amount is a damages demand in her lawsuit, not money a court has awarded. Her complaint accuses Costco of negligence, premises liability and products liability; those are allegations, not findings of fault.
What Novotny says happened
Novotny’s complaint says she and her husband were shopping for a liquor cabinet at the Santa Rosa Costco when the floor model fell on her “suddenly and without warning.” She says she was holding a flatbed at the time.
As reproduced by Global News, her incident report stated: “My husband and I were buying a liquor cabinet. I was holding the flatbed when the floor model fell on top of me. I caught the cabinet and pushed it back. My right shoulder, forearm, hand, fingers, and lower back hurt after the accident.” This is her reported account, not a court finding about how the fall occurred.
What the lawsuit alleges about the display and injuries
The complaint alleges the cabinet had thin legs and was positioned on a worn, defective or inadequate wooden pallet. It asserts general negligence, premises liability and products liability against Costco Wholesale Corporation and Costco Wholesale Membership, Inc. The available materials do not establish that Costco was legally responsible or independently verify the display’s condition.
