The rules turn on who paid, whether a candidate authorized or coordinated the ad, what it says, where and when it runs, and how much the spender has spent. A “paid for by” disclaimer identifies the payer; it does not, by itself, tell you whether the campaign authorized the ad or whether the spending is independent.
The distinction matters financially and legally: spending coordinated with a campaign can be treated as a contribution, while a qualifying independent expenditure is not contribution-limited. Independent spending still has source, disclaimer and reporting rules. This guide covers federal elections; state and local races may follow different or additional requirements.

Who pays for political ads?
There is no single kind of political-ad payer. A candidate’s authorized committee can pay for campaign communications. Outside spenders can include political parties, PACs, corporations, labor organizations, other groups and individuals. The name on the disclaimer tells you who the communication says paid for it, but the legal treatment of the spending depends on more than that name.

Did the candidate or campaign authorize it or coordinate with the spender? And does the content qualify as an independent expenditure, an electioneering communication or another kind of regulated communication? Those categories are not interchangeable, and a communication that mentions a candidate does not automatically qualify as an independent expenditure.

| Arrangement | Who pays | How the spending is generally treated |
|---|---|---|
| Campaign-paid communication | The candidate’s authorized committee | The committee pays for its own communication and uses the applicable campaign disclaimer. |
| Outside communication authorized or coordinated with a campaign | An outside payer, such as a party, PAC, group or individual | It may be treated as an in-kind contribution, subject to applicable contribution limits, source prohibitions and reporting rules. The disclaimer must identify the payer and authorization as required. |
| Qualifying independent expenditure | An outside spender acting independently | It is not a contribution and is not subject to contribution amount limits, but source prohibitions, disclaimers and reporting requirements can still apply. |
This is a federal overview, not a determination about a particular ad. The legal category depends on the applicable facts and rules, not simply on whether an ad supports or criticizes a candidate.
What counts as an independent expenditure?
The Federal Election Commission (FEC) defines an independent expenditure by both its content and its relationship to the campaign. It must expressly advocate the election or defeat of a clearly identified candidate, and it must not be made in consultation or cooperation with, or at the request or suggestion of, a candidate, the candidate’s authorized committee, a political party committee or their agents.
If those conditions are met, the expenditure is not a contribution and has no contribution amount limit. That does not mean the spender can ignore the rest of federal election law. Applicable prohibitions on sources, disclaimer rules and disclosure requirements still matter. Corporations and labor organizations may make independent expenditures, while prohibited sources—including foreign nationals and federal government contractors—may not make expenditures in connection with federal elections.

“Unlimited” therefore describes only the absence of a contribution amount limit on a qualifying independent expenditure. It does not mean unlimited access to all funding sources, no disclosure, no disclaimer or permission to coordinate with the candidate while treating the spending as independent.

Why coordination changes the rules
Under the FEC’s coordination framework, the analysis has three parts: payment, content and conduct. Payment asks who financed the communication. Content asks whether it concerns a regulated subject under the applicable rules. Conduct examines interactions between the spender and the candidate, campaign or party. A communication can be coordinated when all applicable parts of the test are met; not every ad mentioning a candidate meets that standard.
- Payment: Identify the person or committee that paid for the communication.
- Content: Determine whether the communication meets the relevant subject-matter criteria.
- Conduct: Examine the interactions between the spender and the candidate, campaign or party.
When an outside communication meets the applicable coordination test, it may be treated as an in-kind contribution. That can bring contribution limits, source restrictions and reporting obligations into play. A disclaimer that accurately names an outside payer does not make coordinated spending independent.
A vendor firewall can matter under specified conduct standards, but the mere absence of direct contact does not automatically establish independence. The applicable regulation and FEC guidance govern how a firewall is set up and whether it is effective. A specific arrangement should be assessed against those standards rather than inferred from a disclaimer or a public claim that the groups operated separately.

What a “paid for by” disclaimer tells you
A disclaimer is meant to identify who paid for a covered communication and, where required, whether a candidate or campaign authorized it. These are separate facts: the payer may be an outside organization, and the communication may or may not have campaign authorization. The FEC requires disclaimers to be clear and conspicuous in every medium where they apply.

For a communication that is not authorized by a candidate, FEC guidance calls for the payer’s full name, any abbreviated name used to identify it, a permanent street address, telephone number or website address, and a statement that the communication was not authorized by a candidate or candidate committee. The exact applicable wording and presentation depend on the communication and medium.
The FEC’s July 6, 2026 treasurer reminder stated: “Remember that any public communication made by a political committee, including communications that do not expressly advocate the election or defeat of a candidate or solicit a contribution, must display the proper ‘paid for by’ disclaimer.” In other words, a political committee’s covered public communication may require a disclaimer even if it is not an explicit “vote for” or “vote against” message.
How requirements vary by medium
Public communications include broadcast, cable and satellite messages; newspapers and magazines; outdoor advertising; certain mass mailings and phone banks; and paid placements on another person’s website, digital device, application or advertising platform. Political committee websites and certain committee email communications can also require disclaimers even when they do not fall within the public-communication definition.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesRadio and television communications that are not authorized by the candidate have an additional spoken “stand by your ad” statement from a representative of the payer. Small or impracticable items may qualify for exceptions, so the general requirement should not be treated as a claim that every political message, no matter how it is delivered, must display the same disclaimer.

How registration and reporting thresholds differ
Disclaimer obligations, political committee registration and spending reports are separate compliance questions. A spender may have to meet a disclaimer requirement even if it has not crossed a registration or reporting threshold. Conversely, crossing a monetary threshold does not by itself answer what disclaimer a particular ad needs.
| Federal rule or reporting test | Threshold or timing | What it applies to |
|---|---|---|
| Political committee registration | More than $1,000 in contributions or expenditures in a calendar year; registration is due within 10 days after crossing the threshold | FEC guidance says a group whose major purpose is federal campaign activity must register as a political committee when it crosses this threshold. |
| Electioneering communication reporting | More than $10,000 in disbursements during a calendar year | Individuals and other persons making qualifying electioneering-communication disbursements must report them on FEC Form 9 when statutory and regulatory requirements apply. |
| Independent-expenditure reporting by party committees | $10,000 or more in aggregated independent expenditures can trigger 48-hour reporting up to and including the 20th day before an election; expenditures in the final 20 days can trigger 24-hour reporting | The FEC’s party-committee guidance describes these rapid-reporting rules. Filer type, timing, aggregation and current filing instructions matter. |
These figures are different tests, not steps on one shared scale. The $1,000 test concerns political committee registration for a group whose major purpose is federal campaign activity. The $10,000 electioneering-communication test concerns qualifying disbursements and Form 9. The independent-expenditure figure concerns aggregation and rapid reporting for party committees under the cited FEC guidance. Do not assume that meeting one test automatically meets another.
The timing and filer-specific details matter. In particular, a rapid-reporting deadline should not be applied to every outside spender without checking the current instructions for that type of filer and the dates of its expenditures. The rules described here do not establish a complete schedule for every committee or communication.
What changed for political-party coordinated spending in 2026?
On June 30, 2026, the Supreme Court decided National Republican Senatorial Committee v. Federal Election Commission, No. 24-621. The Court held that the Federal Election Campaign Act’s limits on political-party coordinated expenditures violate the First Amendment. The majority opinion stated: “In short, constitutional text, history, and precedent establish that the political-party coordinated-expenditure limits violate the First Amendment.”

The holding concerns statutory limits on political parties’ coordinated expenditures in federal campaigns. It should not be read as a general elimination of contribution limits, disclaimer duties, reporting requirements or restrictions on prohibited sources. The cited decision establishes no such broad change.
There is an important practical qualification for readers consulting FEC explanatory material: the Commission’s pages on advertising and coordinated party expenditures carried notices that they had not yet been revised to reflect the decision and would be updated after the Commission regained a quorum. As a result, older FEC explanations of party coordinated-expenditure caps may not reflect the June 30, 2026 ruling. The FEC reported the decision and directed readers to the Court’s opinion, but procedural guidance can lag behind a court decision.
How to assess a political ad or spending arrangement
If you are trying to understand who paid for an ad—or whether a proposed arrangement is likely to be treated as campaign spending—work through the questions in order. A single label on the ad cannot answer all of them.
- Identify the contest and jurisdiction. Confirm whether the ad concerns a federal election, a state race or a local contest. The FEC rules described here are federal rules.
- Read the disclaimer. Note the named payer and whether the communication says it was authorized by a candidate or committee. For a nonauthorized communication, look for the required identifying details and statement of nonauthorization.
- Classify the communication. Ask whether it expressly advocates the election or defeat of a clearly identified federal candidate, could be an electioneering communication, or is another public political communication. Different categories have distinct tests.
- Check the relationship to the campaign. Consider payment, content and conduct, including relevant interactions among the spender, campaign, party and their agents. Do not treat a lack of direct contact or an outside-payer disclaimer as proof of independence.
- Check each compliance obligation separately. Determine whether the communication needs a disclaimer, whether a group must register as a political committee, and whether a specific reporting form or rapid deadline applies. The monetary thresholds and reporting triggers are not interchangeable.
- Verify the rule in force for the relevant date. This is especially important for political-party coordinated expenditures after the Supreme Court’s June 30, 2026 ruling, because some FEC explanatory pages warned that they had not yet been revised.
Federal rules do not settle every state or local race
The FEC guidance discussed here concerns U.S. federal elections. State and local campaign-finance laws may add requirements or use different definitions, thresholds, disclaimers and filing schedules. A federal rule should not be presented as a complete answer for a governor, state-legislative, mayoral or other local race.
For a particular nonfederal contest, identify the office and jurisdiction, then consult the responsible state or local election regulator and current law. Without that information, a reliable state-specific answer is not possible.
