Re:

Who Can See Your Federal Tax Returns—and What Privacy Protections Apply?

The IRS generally must keep federal tax returns confidential, but taxpayer authorization and specific statutory exceptions can permit access. The recipient, purpose, and scope determine what may be disclosed.

For U.S. federal tax returns, the default is confidentiality: the IRS generally may not disclose your returns or tax return information unless you authorize disclosure or a law permits it. That protection has specific exceptions, so it does not mean that only you can ever see the information. Who may receive it depends on the recipient, the purpose, the information requested, and the legal authority or consent involved. State tax returns are governed separately by state law.

What federal tax-return confidentiality protects

Internal Revenue Code §6103 generally makes federal returns and return information confidential, subject to disclosures authorized by Title 26. The IRS puts the principle this way: “Taxpayers have the right to expect that any information they provide to the IRS will not be disclosed unless authorized by the taxpayer or by law.” The IRS’s Taxpayer Bill of Rights 8: The Right to Confidentiality and the current text of 26 U.S.C. §6103 describe the rule and its exceptions.

Confidentiality applies to information held by the IRS and, in some circumstances, to recipients subject to restrictions. It does not make every fact about your finances secret. A lender could ask you to provide a return or transcript, and another person might hold financial information independently. Those situations are different from the IRS improperly disclosing your tax information.

Who may receive your information

Section 6103 is not a general public-records law or a blanket permission for agencies to browse returns. Each disclosure must fit an applicable statutory route, including its conditions on recipient, purpose, and information. The categories below are broad descriptions, not a substitute for checking the specific law governing a particular request.

Recipient or route Why access may be allowed Important boundary
A person you designate You can authorize disclosure of specified tax information through an IRS authorization, or give limited oral authorization during an IRS conversation. The authorization determines the recipient and scope; it does not automatically grant unrestricted or permanent access.
A tax return preparer or tax professional A preparer receives information needed to prepare a return; separate authority may apply to certain tax-advice communications. Preparers face restrictions on use and disclosure. A preparer relationship does not create a universal privilege.
A state tax agency Section 6103(d) permits specified federal tax information to be provided for state tax administration. Disclosure is limited to what is necessary for that administration and is subject to safeguards and restrictions on onward disclosure.
Another government agency, court, or law-enforcement actor A particular provision of §6103 may authorize disclosure for a defined government purpose or proceeding. There is no blanket agency, police, or court access. The applicable subsection, purpose, information, and any required process matter.
Specified congressional tax committees Section 6103(f) provides a route for specified committees under statutory conditions. This does not make ordinary taxpayers’ returns public.

The IRS’s IRS information sharing programs page and servicewide policy state that government access must be authorized by law; agencies do not have general access to federal returns for non-tax programs without statutory authorization. The current §6103 text controls the details for any named recipient or disclosure.

How to let someone deal with the IRS

Choose the authorization based on whether you want someone to receive information or represent you. The IRS’s Topic no. 312, Disclosure authorizations explains that “You can use Form 8821 to allow the IRS to disclose your confidential tax return information to designated third parties for tax or non-tax purposes.”

Use the current IRS form instructions to identify the information, tax matters, and periods covered, along with any expiration or revocation terms. A one-time authorization to discuss a matter should not be treated as ongoing access to every return or transcript.

What tax professionals may do with your information

Receiving information to prepare a return does not give a preparer free rein to use or disclose it for unrelated purposes. The Taxpayer Advocate Service’s Taxpayer Rights explains that unauthorized use or disclosure may lead to civil penalties and, when knowing or reckless, criminal penalties.

Confidentiality duties are not the same as evidentiary privilege. Federal law provides a limited tax-practitioner privilege for qualifying confidential tax advice communications with practitioners authorized to practice before the IRS, but only where attorney-client privilege would otherwise apply and only in specified noncriminal IRS or federal-court matters. The special privilege does not cover communications made to prepare a return. An attorney’s attorney-client privilege is a separate doctrine whose application depends on the communication and context; it is not a guarantee that every tax-related exchange is protected.

What state and local access means

Under §6103(d), specified federal return information may be made available to a state tax agency for administering state tax laws, only to the extent necessary for that work. IRS manual guidance describes safeguards such as access controls, records, secure storage, and limits on onward disclosure. Federal tax information cannot simply be relabeled as state information and passed to local authorities.

When the IRS may contact someone else

Third-party contacts are a separate issue from disclosure of a return already held by the IRS. For certain adjustment or collection work, the IRS generally must give reasonable advance notice before contacting an employer, neighbor, bank, or other third party to obtain information, subject to exceptions. The notice rule does not mean that third parties can never be contacted, nor does it make information they already hold confidential under §6103.

If you suspect a specific breach, consult the IRS’s current reporting instructions and consider qualified legal advice. The available sources establish the confidentiality rule and potential consequences, but do not specify one universal complaint process or guarantee a particular remedy.
