Who Can Legally Access Your IRS Tax Return Information?

IRS tax information is generally confidential, but your authorizations and specific legal exceptions determine who may receive it and what they may do.

Your IRS tax return information is generally confidential. The IRS may disclose it when you authorize the disclosure or when a law specifically permits it. Who can receive what—and whether that person can act for you—depends on the authority, purpose, tax matters, and periods involved. Federal law, including Internal Revenue Code Section 6103, sets the confidentiality baseline and its exceptions. The IRS describes the right this way: “Taxpayers have the right to expect that any information they provide to the IRS will not be disclosed unless authorized by the taxpayer or by law.”

Who can talk to the IRS or receive your information with your permission?

There is no single, all-purpose authorization. A person allowed to inspect specified information is not necessarily allowed to represent you, negotiate with the IRS, or make decisions on your behalf. Choose the authorization based on what you need that person to do. The authorized person, information, tax years, and permitted actions all depend on the form or other permission you use.

Authorization Who may be named What it permits Scope and duration
Form 2848, Power of Attorney An individual eligible to practice before the IRS, such as an attorney, CPA, or enrolled agent; limited exceptions apply for certain other people. Representation on the stated tax matters, including speaking for you and advocating or negotiating. Signing on your behalf is permitted only in circumstances allowed by IRS rules. Applies to the matters and periods listed. It remains in effect until revoked or withdrawn under IRS procedures.
Form 8821, Tax Information Authorization An individual, corporation, firm, organization, or partnership. Inspecting or receiving the tax information you specify. It does not authorize representation before the IRS. Applies to the tax matters and periods listed. It remains in effect until revoked or withdrawn under IRS procedures.
Third-party designee on a return A person you choose on that return. Discussing processing of that specific return, including refund status, and handling limited processing or notice issues. Limited to that form, period, and processing matters. It generally expires one year after the return’s due date; Form 709 follows a different expiration rule.
Oral disclosure authorization A person you bring into an IRS call or meeting. Discussing the information needed for that particular conversation. Normally ends when the conversation ends.

The IRS explains these options and notes that online-account workflows are available for some authorizations in its guide to powers of attorney and other authorizations. Check the current form instructions for how to submit, revoke, or withdraw an authorization; do not assume that one form grants the same authority as another.

When Form 2848 fits

Use Form 2848 when you want an eligible representative to deal with the IRS for you on specified matters and periods. It is the representation route: the representative may advocate or negotiate within the authority granted. Form 2848 does not create blanket authority over every tax year or issue; list the matters and periods relevant to the representation.

Eligibility matters as well as your consent. The IRS lists attorneys, certified public accountants, and enrolled agents among those who may practice before it, while allowing certain people to serve in limited special circumstances. If you need representation in an audit, collection matter, or dispute, confirm that the person is eligible for the role and that the form covers the relevant issues and years.

When Form 8821 fits

Use Form 8821 when someone needs to see or receive specified tax information but you do not want to appoint that person to represent you. A designee under Form 8821 can access only the information covered by the authorization, and cannot act as your representative merely because they can see it. For example, permission to receive records does not by itself authorize the designee to argue your position or negotiate with the IRS.

Form 8821 may name an individual or an organization, but the authorization still needs to specify the tax matters and periods. Consider whether the recipient needs all of the information listed before granting access, and review the current IRS instructions for changing or ending the authorization.

What short-term permissions cover

A return’s third-party designee is a narrow choice for questions about processing that return, not a standing power of attorney. The IRS says this designation generally expires one year from the return’s due date, with a different expiration rule for Form 709. It can be useful for a processing question, but it is not authorization to handle a separate tax year or a broader audit or collection matter.

Oral permission is narrower still: it normally covers the particular call or meeting rather than future conversations. It can allow someone you bring into the discussion to address the information needed in that conversation, but it does not give that person continuing access. See IRS Tax Topic 312 for these limited authorizations.

When can the IRS disclose information without your permission?

Taxpayer consent is not the only legal basis for disclosure. Section 6103 contains exceptions, and the IRS describes several examples. These categories are illustrative, not a complete list of every statutory exception. The requesting entity, legal authority, purpose, and applicable safeguards all matter. The IRS summarizes the general rule by saying, “IRC Section 6103 generally prohibits the release of tax information by an IRS employee.” The word “generally” is important: disclosure can be lawful when a specific exception applies.

  • State tax administration: Section 6103(d) permits disclosures to state agencies responsible for tax administration after a written request signed by an officially designated requester.
  • Non-tax criminal investigations: Under Section 6103(i)(1), return information may be disclosed for investigation or prosecution of non-tax criminal laws pursuant to a court order.
  • Information-gathering in tax investigations: Under Section 6103(k)(6), the IRS may make limited disclosures in official tax-administration investigations when necessary to obtain information that is not otherwise reasonably available.
  • Social Security Administration duties: Section 6103(l)(1) permits specified information concerning self-employment, FICA, and income-tax-withholding liabilities to be shared as needed for the Social Security Administration’s duties under the Social Security Act. The IRS says this authority does not permit sharing for other purposes, and receiving SSA employees remain subject to confidentiality rules.
  • Other government exchanges: Federal, state, and local information-sharing programs operate under legal authority. The IRS says it is prohibited from accessing returns or accounts to help administer a non-tax program unless legislation authorizes that agency’s access.

These examples do not mean that any government agency can request your return for any reason. The authority must cover the disclosure and the intended purpose; some categories also require a particular request, court order, or showing that the information is needed. Information received under an exception remains subject to applicable confidentiality rules and limits on use.

The IRS summarizes these and other rules on its disclosure laws page and describes government information-sharing programs. These pages describe selected rules, not every exception in the statute. For a disputed or unusual disclosure, the statutory details in Section 6103 and advice from a qualified tax professional may be important.

Can the IRS contact your employer, bank, or another person?

This is different from giving someone your return. To adjust or collect a tax liability, the IRS generally must provide reasonable advance notice before contacting an employer, neighbor, bank, or other third party to obtain information. The notice rule has exceptions; it is not a promise that the IRS will never contact someone else. A third-party inquiry to obtain information is not the same thing as sharing your entire return with that person.

Subject to exceptions, the Taxpayer Advocate Service says the IRS must periodically provide a list of third-party contacts and provide that list upon request. If you are concerned about an IRS contact, distinguish between whether the IRS contacted someone to obtain information and whether the IRS disclosed your information to them; the legal rules and questions are not identical. The IRS describes confidentiality and third-party-contact rights in its Right to Confidentiality guidance; the Taxpayer Advocate Service explains related taxpayer rights.

What about information shared with a tax preparer?

Your authorization for a preparer to use or disclose information is separate from the IRS’s statutory authority to disclose information. IRS guidance says preparers must explain with whom information will be shared and for what purpose, and obtain taxpayer consent as applicable. Before agreeing, ask what information will be disclosed, who will receive it, and why. You can also ask whether the proposed use is necessary for the service you requested and what consent is being sought. The IRS discusses these issues in its FAQ on taxpayer control over tax information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Taxpayer Advocate Service says preparer misuse may lead to civil penalties and, when knowing or reckless, criminal fines and imprisonment. That does not mean every use or disclosure is prohibited; the applicable rules depend on the circumstances and consent. The practical step is to understand the intended recipient and purpose before giving consent, rather than assuming that a preparer may freely share any information just because they prepared a return.

Does tax-professional privilege protect every conversation?

No. A limited federal tax-practitioner privilege may apply to certain confidential communications for tax advice with a practitioner authorized to practice before the IRS. The communication must be one that would be privileged between an attorney and a client, and the privilege applies only in defined noncriminal IRS matters or noncriminal federal tax proceedings in which the United States is a party. Communications about preparing a tax return are not privileged on that basis.

Privilege is not the same as IRS authorization: it concerns whether a communication may be protected from disclosure in a qualifying matter, not whether a professional can access your IRS account. Do not assume every conversation with a CPA, enrolled agent, preparer, or tax lawyer is protected. In particular, an authorization to receive tax records does not create privilege, and the fact that a professional is involved in preparing a return does not make preparation communications privileged.

How to choose the right access

  1. Decide what the person needs to do. If they only need specified records, consider Form 8821. If they need to represent you before the IRS, consider Form 2848 and confirm they are eligible to serve.
  2. Limit the scope deliberately. Identify the tax matters and periods the person needs rather than treating an authorization as open-ended.
  3. Use a return designee only for return processing. It is not a substitute for representation in an audit, collection case, or broader dispute.
  4. Review current IRS procedures. Use the current form instructions or the IRS authorization guide to submit or end the authorization. Online-account workflows are available for some authorizations.
  5. Get qualified help for a dispute. For an active audit, collection matter, or tax dispute, an attorney, CPA, or enrolled agent may be able to advise or represent you, depending on eligibility and the authority granted.

The IRS describes confidentiality as the right to expect that information supplied to it will not be disclosed unless the taxpayer authorizes the disclosure or the law permits it. That general rule is subject to the statutory exceptions above; it does not mean that every government request or third-party inquiry is automatically lawful. If you are unsure whether a request is covered by an authorization or legal exception, check the scope and purpose before assuming access is allowed.

Frequently Asked Questions

Who can the IRS share my tax information with?

The IRS may share specified information with someone you authorize, or disclose it when a statutory exception applies. Section 6103 includes examples such as certain state tax-administration requests, limited disclosures to the Social Security Administration for specified duties, and disclosures under a court order for non-tax criminal investigations. These are not the only exceptions; the authority, purpose, and safeguards matter.

Can someone else talk to the IRS for me?

Yes, but the authority depends on the permission. Form 2848 appoints an eligible representative for the tax matters and periods listed. Form 8821 allows a designee to inspect or receive specified information but does not authorize representation. A return designee or oral authorization is narrower and generally limited to return processing or a particular conversation.

Does Form 8821 let someone represent me?

No. Form 8821 authorizes someone to inspect or receive the tax information you specify. It does not let that person advocate, negotiate, or otherwise represent you before the IRS. Form 2848 is the IRS power-of-attorney route for eligible representatives.

Can the IRS contact my employer or bank?

Generally, before contacting an employer, bank, neighbor, or another third party to obtain information to adjust or collect a tax liability, the IRS must give reasonable advance notice. Exceptions apply, so this is not an absolute ban. Subject to exceptions, the IRS must also periodically provide a list of third-party contacts and provide it upon request.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is everything I tell my tax preparer protected by privilege?

No. A limited tax-practitioner privilege may cover certain confidential tax-advice communications in defined noncriminal matters, if the communication would be privileged between an attorney and client. Communications about return preparation are not privileged on that basis, and not every conversation with a tax professional is protected.

The Bottom Line

Your return information is confidential by default, but disclosure may be authorized by you or permitted by a specific law. Use Form 8821 for specified information access and Form 2848 when an eligible person needs to represent you; short-term permissions are narrower. Government exceptions and IRS third-party-contact rules depend on their legal authority, purpose, and safeguards.
