Your first paycheck usually arrives on the regular payday for the pay period that includes your first days of work, and your last paycheck is governed by the regular payday for the final pay period unless your state sets a faster deadline. Federal law does not, by itself, require an employer to pay final wages immediately. The exact dates depend on your employer’s payroll calendar and on the labor law of the state where you worked.
How the first paycheck date is set
A paycheck pays wages for a defined period of work, and the payday often falls after that period ends. The employer has to close the time record, check hours, and process payroll before money moves. That is why “I started today” does not tell you the date of your first check. There is no universal rule such as “first pay within one week.”
Pay period and cutoff
Ask payroll or HR for three things: the pay-period start and end dates, the regular payday, and the payroll cutoff that applies to new hires. If your start date falls just after a cutoff, your first hours may roll into the next pay period, and your first check may land on the following scheduled payday rather than the one you expected.
Regular payday as the baseline
The U.S. Department of Labor’s Handy Reference Guide to the Fair Labor Standards Act states: “Wages required by the FLSA are due on the regular payday for the pay period covered.” The FLSA covers federal minimum wage and overtime, so this is the baseline for covered wages. Your employer’s schedule and your state’s payday rules determine the concrete date.

How the last paycheck date is set
Federal law does not generally require an employer to pay final wages on your last day. The Department of Labor’s Last Paycheck guidance puts it this way: “Employers are not required by federal law to give former employees their final paycheck immediately.” The same guidance notes that some states do require immediate or faster final payment.
So for a final check, the federal floor is usually the regular payday for the last pay period. Whether that is the deadline for you depends on your state and on how your employment ended.

Quit versus discharge
Some state rules treat a worker who quit differently from one who was fired or laid off. Do not assume the same deadline applies to both. Check the rule for each separation type in your state.

The Department of Labor’s state payday requirements table is a 2023 edition. It shows that payday frequency requirements vary by state and sometimes by worker category, with footnotes describing exceptions. Treat it as background that points you to your state’s current labor agency guidance, not as a current deadline.
What to do when a paycheck is late
- Confirm the pay-period dates and the scheduled payday with payroll or HR.
- Ask whether your hours and direct-deposit or payment details were submitted correctly.
- For a final check, look up the final-wage deadline published by the labor department of the state where you worked.
- If the regular payday has passed and wages are still unpaid, contact the U.S. Department of Labor’s Wage and Hour Division or your state labor department.
