Apple has not lost the App Store. As of August 16, 2026, the Epic litigation has weakened Apple’s ability to stop U.S. developers from directing customers to outside payment options. It has not created a U.S. right to sideload apps, invalidated Apple’s in-app-payment system, or established that Apple can never charge a fee. The unresolved question is how much Apple may lawfully charge when an app sends a customer to a purchase completed elsewhere.
The ruling changed payment choice, not App Store ownership
The legally precise result is an anti-steering requirement. A 2021 injunction bars Apple from prohibiting developers from including buttons, links, or calls to action that direct users to alternative purchasing mechanisms. That is narrower than an order requiring alternative app stores or unrestricted installation of apps from any source.

- Apple billing remains available. The company’s in-app-purchase system was not invalidated.
- Apple still controls distribution. App review, hosting, updates, account integration, discovery, and security processes remain central to iOS distribution.
- The commission question is open. The courts did not declare that Apple may charge any rate, nor that it must charge zero for transactions initiated through an app.
Apple’s fiscal filings describe the injunction and related proceedings as a risk to its business, while also reporting that Services sales increased, driven primarily by advertising, the App Store, and cloud services. The filing does not isolate App Store profit. (Apple Form 10-Q, fiscal Q2 2026)
How the case reached its current position
| Date | Event | Practical significance |
|---|---|---|
| September 2021 | District court issued the original anti-steering injunction. | Developers had to be allowed to communicate alternative payment mechanisms. |
| January 16, 2024 | Apple’s Link Entitlement framework took effect. | Apple’s implementation became the focus of later contempt proceedings. |
| April 30, 2025 | District court found Apple in violation of the injunction and issued broader restrictions on fees and interference with external purchasing. | The decision directly challenged Apple’s implementation. |
| December 11, 2025 | Ninth Circuit largely upheld the injunction, modified details, and allowed consideration of a reasonable commission. | Apple retained an argument for a fee, but not necessarily its former 27% structure. (Ninth Circuit opinion) |
| March 30, 2026 | Rehearing denied. | Apple could seek Supreme Court review. |
| May 21, 2026 | Apple filed its Supreme Court petition. | The dispute moved to the next appellate stage. |
| June 30, 2026 | Supreme Court granted review, limited to Question 1. | The merits remain undecided. (Supreme Court docket) |
Apple’s merits brief is due September 14, 2026, and Epic’s response is due November 13, 2026. Those are briefing deadlines, not a scheduled decision date. The Court’s question presented is listed in its certiorari materials. (Question presented)

What the fee fight actually involves
Three figures are often blended together even though they describe different things:
| Figure | What it describes | Status |
|---|---|---|
| 30% | Apple’s traditional headline in-app-purchase commission, subject to reduced rates and program-specific terms for eligible developers. | Not a universal rate for every developer or transaction. |
| 27% | The commission in Apple’s former Link Entitlement structure for certain external-link purchases. | Part of the policy that triggered the contempt dispute; not a settled future rate. |
| Reasonable or cost-based fee | A possible charge for transactions initiated in an app but completed externally. | Unresolved. The Ninth Circuit allowed the lower court to consider it. |
The legal test is therefore not simply whether Apple can collect “30%.” Apple must persuade the courts that any external-transaction charge corresponds to services or costs rather than operating as a disguised penalty that makes steering uneconomic. Apple argues that external purchases can still benefit from app review, hosting, distribution, updates, search, developer tools, account infrastructure, and security systems. (Ninth Circuit PDF)
Apple’s likely strategy: keep the platform valuable, make the fee defensible
The following are strategic scenarios, not announced company plans.

Apple can continue emphasizing the convenience of Apple billing and the services surrounding distribution: editorial discovery, review and malware screening, updates, Apple-account integration, subscription management, refunds, privacy messaging, and a unified purchase experience. The commercial goal would be voluntary use rather than relying entirely on a prohibition against links.
2. Replace a blanket commission with service-based charges
Apple could propose a lower charge for external transactions and tie it to services a developer continues to use. A defensible structure might distinguish whether Apple handles payment processing, subscription management, refunds, account features, or other platform functions. The final fee would still require legal and factual scrutiny; no rate has been approved.

3. Segment the economics
Terms could vary by one-time versus recurring purchases, developer size, use of Apple-hosted entitlements, or reliance on third-party processors. Such segmentation could make web checkout viable for some high-value subscriptions while preserving more revenue from developers that use Apple’s full billing stack.
4. Monetize more of Services outside commissions
If payment commissions decline, Apple could place greater emphasis on advertising and search placement, developer tools and APIs, subscription-management services, cloud services, games merchandising, and enterprise distribution. Apple’s earnings release identifies advertising, the App Store, and cloud services as contributors to Services growth, but does not disclose a standalone App Store profit figure. (Apple fiscal Q2 2026 earnings release)
When external checkout makes financial sense for a developer
Permission to add a link does not automatically create a profitable alternative. A practical calculation is:
Net benefit = Apple commission avoided − payment processing − tax and compliance costs − fraud and chargebacks − customer-support costs − conversion loss.
Costs that move outside Apple’s system
- Payment processing and payment-method fees.
- Sales-tax or VAT collection, registration, and remittance.
- Fraud screening, disputes, refunds, and chargebacks.
- Subscription renewals, failed payments, cancellations, receipts, and customer support.
- Account linking so a web purchase immediately unlocks the correct iOS entitlement.
- Engineering, analytics, security, and compliance work.
External checkout is most attractive when the transaction value and potential commission savings are large enough to cover those costs, and when sending a user to a browser does not materially reduce conversion. The result varies by category, geography, price, and customer relationship; there is no universal break-even percentage.

Which apps are likely to experiment first?
Likely early experimenters
- Large games with high purchase volume.
- Streaming video and music services.
- Dating applications.
- Cloud-storage and productivity subscriptions.
- Digital news and magazine publishers.
- Creator, education, and other high-priced subscription platforms.
These businesses can have enough transaction value, engineering capacity, and direct customer relationships to test a web funnel.
Likely to move slowly
- Low-price or infrequently purchased apps.
- Small teams without payment-operations staff.
- Products whose users strongly prefer Apple Pay or App Store billing.
- Apps requiring complex family sharing, multi-device entitlements, or tightly integrated subscription management.
- Apps where browser redirection could cause a significant conversion drop.
Will consumers pay less?
Not necessarily. A developer may pass commission savings through as a web discount, retain the savings as margin, or maintain separate Apple-billed and web-billed prices. It may also add payment, tax, support, or fraud costs. The legal permission to steer, the business incentive to steer, and the consumer benefit from steering are separate outcomes.
Users should also verify that an external payment page is clearly branded, uses secure connections, explains cancellation and refund rules, and links the purchase to the correct account. A cheaper advertised price is not useful if a subscription fails to appear in the app or the customer cannot find the support and cancellation path.

If Apple wins
The contempt finding or the injunction’s scope could be narrowed or overturned. Apple could seek to restore more restrictive conditions on payment links. Developers might delay investment in external checkout, while Apple’s commission model would gain substantial legal protection. Other litigation and regulations would still apply.
If Epic wins
The finding that Apple’s implementation violated the injunction would be harder to undo. Apple would likely operate under a more durable external-payment regime, but the lower court would still need to determine the permissible fee and operating rules. Developers would gain leverage without receiving an automatic guarantee that web checkout is cheaper or easier.

If the Court sends the case back
The district court could remain the practical venue for deciding the fee and implementation details. The anti-steering principle could survive while the economics continue through additional proceedings for years.
What developers should decide now
- Model the commission actually avoidable. Use the developer’s applicable Apple program terms, not a generic 30% assumption.
- Measure conversion risk. Test how many users abandon the app-to-web journey before payment.
- Map operational ownership. Assign responsibility for taxes, fraud, refunds, renewals, support, and receipts.
- Design entitlement synchronization. Confirm that web purchases, cancellations, family access, and cross-device use update reliably in the app.
- Check geography. The injunction concerns the U.S. storefront; European, South Korean, Dutch, and other market rules may differ.
- Plan for legal change. Supreme Court review and further district-court orders could alter link, pricing, and fee requirements.
Alternatives include continuing with Apple In-App Purchase, offering a web subscription without actively steering where permitted, using account-based web entitlements, adopting a hybrid model, or emphasizing advertising, physical goods, services, and enterprise contracts that do not depend on digital in-app purchase rules.
The larger strategic test for Apple
Apple’s challenge is to shift the value proposition from “pay Apple because the App Store requires it” to “pay Apple because its integrated distribution, discovery, billing, trust, account, and security services are worth the fee.” The ruling makes that proposition more important, but it does not remove Apple’s control over the core iOS distribution layer.
This is a U.S.-specific development tied to the Epic injunction. It should not be described as a worldwide opening of iOS, a general U.S. sideloading mandate, or proof that Apple’s entire Services business is in decline. Apple’s public filings show Services growth, while warning that legal and regulatory changes can affect the segment.
