In 23 of those states, adult-use retail sales were allowed; Virginia had adult-use legalization, but retail sales were still for the legislature to determine. Separately, 41 states, three territories, and D.C. allowed medical cannabis use. These are distinct legal categories, and neither count means every purchase, possession, or use is permitted everywhere.
Which states allowed adult-use cannabis in 2025?
The National Conference of State Legislatures (NCSL) listed these 24 states as allowing or regulating nonmedical adult use as of June 26, 2025:

Does adult-use legalization mean stores could sell cannabis?
No. A state can allow adult use while retail sales are unavailable. NCSL’s table listed adult-use retail sales as allowed in all 24 states except Virginia, where the legislature had yet to determine retail sales. The distinction matters: a headline saying cannabis is “legal” does not by itself establish that a licensed shop can sell it or that a particular purchase is lawful.

Which states had medical cannabis programs?
As of the same June 26, 2025 date, NCSL counted 41 states, three territories, and D.C. as allowing medical cannabis use. This is a separate count from adult-use states: medical access can exist without general adult-use permission, and an adult-use state may also have a medical program. The figures should not be added together because the categories overlap.
NCSL distinguishes comprehensive medical cannabis programs from limited low-THC or high-CBD laws. Its criteria for a comprehensive program consider whether patients have protection from criminal penalties, a workable route to access, products beyond low-THC offerings, and something more than a limited trial. The NCSL page updated in September 2026 separately reported seven states with limited low-THC/high-CBD laws; that figure is not identified as a June 2025 snapshot.

What does “legal weed” mean for an individual?
State-level legalization is not blanket permission. Age limits, possession amounts, where cannabis may be used, cultivation rules, and licensed-sale conditions differ by state and can change. The Insurance Institute for Highway Safety’s cross-state table includes examples of age, possession, and retail rules, but warns that its general information is not guaranteed current. Use it as a starting point, then confirm the rules with the relevant state regulator before acting. Review IIHS’s marijuana laws comparison.

- For medical access: verify eligibility, registration or certification requirements, and approved access routes with the state program.
- For travel: do not assume that a state’s rules carry across state lines; check applicable state and federal law.
Was cannabis federally legal in 2025?
State legalization and federal law are separate. NCSL reports that federal action in April 2026 reclassified state-regulated medical cannabis products and FDA-approved marijuana products to Schedule III. That action occurred after the 2025 snapshot and must not be read as the federal status during 2025. NCSL’s medical cannabis law page describes the later federal action.

How to read the 2025 numbers
| Category | Count as of June 26, 2025 | What the count means |
|---|---|---|
| Nonmedical adult use | 24 states, three territories, and D.C. | Allowed or regulated adult use; it does not guarantee retail sales in every state. |
| Adult-use retail sales | Allowed in 23 of the 24 states listed for adult use | Virginia was the exception; retail sales remained for the legislature to determine. |
| Medical use | 41 states, three territories, and D.C. | A separate medical-access category that overlaps with adult-use states. |
| Limited low-THC/high-CBD laws | 7 states, as reported on NCSL’s page updated September 2, 2026 | The figure is not specified as a June 2025 count and should not be treated as one. |
For a historical comparison, the CDC published an earlier state medical cannabis overview on February 16, 2024; it is not a substitute for the June 2025 snapshot. CDC: State Medical Cannabis Laws.
