If your Social Security payment was reduced because of a government pension, first check whether you were already receiving the affected benefit or still need to apply. The Social Security Fairness Act ended the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) for benefits payable beginning January 2024. If you were already entitled, SSA generally says no action is needed when it has your correct address and direct-deposit details—but check your account and contact SSA if your record or payment does not reflect the change. If you never applied, do not assume repeal created a claim automatically: your filing date can affect when benefits begin and their amount.
What changed, and who may be affected?
The Social Security Fairness Act was signed on January 5, 2025. It repealed two provisions that could reduce Social Security benefits for people whose work histories included pensions from jobs that did not pay Social Security taxes. The change applies to benefits payable for months after December 2023: December 2023 was the final month the reductions applied, and January 2024 was the first payable month without them. SSA describes the change in its Social Security Fairness Act update and January 6, 2025 legislative bulletin.

The repeal does not mean every person with a government pension qualifies for an increase. The pension had to be based on work not covered by Social Security, and the person’s Social Security benefit had to have been reduced under one of the repealed provisions. Many state and local government employees paid Social Security taxes on their work and were not affected. Having a pension, by itself, is not enough to establish entitlement or an increase.

The Windfall Elimination Provision could reduce certain retirement or disability benefits based on a worker’s own earnings record when that worker also received a pension from work not covered by Social Security. The WEP concerned the worker’s benefit, not a spouse’s benefit merely because the worker had a pension.

GPO: a reduction to certain spouse or survivor benefits
The Government Pension Offset could reduce certain benefits received as a spouse or survivor when the beneficiary also received a pension from non-covered work. SSA’s spouse-benefit FAQ addresses the pension-related reduction to spousal benefits. The two provisions applied to different benefit situations; it is useful to identify which benefit on your record was reduced before asking SSA to review it.
If you already receive a reduced benefit
SSA says most people who were already entitled to affected benefits do not need to take action to trigger an adjustment. That depends on SSA having correct contact and payment information. Start with your my Social Security account and check the latest benefit amount, notices, mailing address, and direct-deposit account. If you cannot use the account, call SSA at 1-800-772-1213.
- Look for the latest benefit notice and payment information. Compare what SSA currently shows with any notice explaining an adjustment. SSA says it mails a notice when a payment changes or a past-due amount is due.
- Confirm your address and bank details. Correct information helps SSA deliver notices and payments; if something has changed, use my Social Security or contact SSA by phone.
- Contact SSA if the record still appears reduced or an expected amount is missing. Ask the agency to review your specific record and explain whether you were entitled to an adjustment, whether it has been processed, and whether any past-due amount is due. A national processing announcement cannot answer those individual questions.
For people entitled to the affected benefit during earlier months, an adjustment may include amounts back to January 2024. Social Security benefits are generally paid one month after the month for which they are due, so the January 2024 benefit was generally paid in February 2024. Keep the benefit month distinct from the deposit date when reading a notice or comparing payments.

If you call, make the issue specific: say whether the affected payment is a benefit on your own record or a spouse or survivor benefit, identify the months you believe were affected, and ask whether SSA has reviewed eligibility and any past-due amount. Have the latest notice available so you can ask about the benefit amount and effective month shown there. These questions help distinguish a missing adjustment from a case in which SSA determines that the pension or benefit did not meet the conditions for a change. Only SSA can confirm your individual entitlement and calculation.

If you never applied or are unsure whether you applied
Repeal of WEP or GPO does not itself file an application on your behalf. If you did not apply for the retirement, spouse, survivor, or disability benefit you may be eligible for, you may need to submit a claim. If you are uncertain whether an application exists, ask SSA to check before assuming that an automatic adjustment covers you. The date you apply can affect both when entitlement starts and the amount payable.
Application rules are separate from adjustments to benefits someone was already receiving. SSA says some retirement and survivor benefits generally allow up to six months of retroactivity, while some disability claims may allow up to 12 months. These are general limits, not a guarantee that a particular applicant can receive that many months; benefit type, eligibility, and claim circumstances matter. The Social Security Fairness Act did not change those application retroactivity rules.
Use SSA’s current Fairness Act guidance to follow the appropriate application route or contact the agency at 1-800-772-1213. Retirement and spouse applications are available online, and SSA accepts certain applications by phone. Survivor applications are not available online and should be started by phone. If you are dealing with more than one possible benefit, tell SSA which benefit you are asking about rather than assuming the repeal automatically establishes all claims.

A past-due adjustment for an existing beneficiary may reach back to January 2024 for months of entitlement. A new application is governed by its own filing and retroactivity rules. Do not treat the January 2024 effective month as a promise that every person who applies later will receive benefits back to that date.

What to do about a separately billed Medicare premium
Continue paying a Medicare premium bill according to its instructions until SSA sends notice that your Social Security record has been updated. Do not stop payments solely because you expect an adjustment. SSA says that after the record is updated, the premium will generally be deducted from Social Security if the benefit is sufficient to cover it. If the benefit is not enough, Medicare will bill the remaining balance. See SSA’s implementation guidance and spouse-benefit FAQ for the premium information.
A change in your expected Social Security amount does not by itself mean that a separately issued premium bill has been cancelled or that the billing arrangement has changed. Follow the bill’s due-date and payment instructions unless SSA confirms the record update. Afterward, check whether the premium is being deducted from your benefit or whether a remaining balance is still being billed.
If the beneficiary has died
A family member or another potential claimant can sign in to SSA and submit Claim for Amounts Due in the Case of a Deceased Beneficiary, Form SSA-1724-F4, with available supporting documents. The form concerns amounts due in a deceased beneficiary’s case; it is not the same as filing a new benefit application for a living person. SSA’s government and foreign pensions guidance provides the agency’s related information.
How to interpret SSA’s national payment figures
SSA’s administrative figures show the scale of the change, but they do not establish whether a particular person qualifies or whether their case is complete. SSA reported that more than 2.8 million existing beneficiaries had benefits reduced by WEP or GPO when the Act became law. That count describes beneficiaries identified at that point; it is not a count of everyone who may eventually apply under the law.

The agency reported that by March 4, 2025, 1,127,723 people had received more than $7.5 billion in retroactive payments, with an average retroactive payment of $6,710. That is a dated implementation snapshot, not a forecast or promised average for an individual. SSA later reported that more than 3.1 million payments totaling $17 billion had been completed by July 7, 2025. Those milestones are useful context, not confirmation that your own record was adjusted. The figures appear in SSA’s March 4, 2025 press release and July 10, 2025 implementation update.
Monthly increases also differ from person to person. SSA says some may be under $1,000 and others may be over $1,000; neither figure is a typical payment or a personal estimate. Your benefit record and the months for which you were entitled determine your result. Ask SSA to explain your own calculation rather than using the aggregate averages to estimate it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.A practical checklist before contacting SSA
- Identify whether the affected benefit is your own retirement or disability benefit, or a spouse or survivor benefit.
- Check whether you were already entitled to that benefit or need to apply; the repeal does not substitute for an application.
- Review your current SSA notice and account details, including address and direct-deposit information.
- If there is no expected change, or your record still shows a reduction, call 1-800-772-1213 and ask for an individual review.
- Continue paying any separately billed Medicare premium until SSA confirms the record update.
- For a deceased beneficiary’s amounts due, ask about Form SSA-1724-F4 and supporting documents.
SSA’s FAQ summarizes the effective change this way: “Starting in January 2024, your Social Security benefits will no longer be reduced or eliminated if you receive a retirement or disability pension from work not covered by Social Security.” The key practical distinction is that an already-entitled beneficiary may receive an adjustment, while a person without an existing claim may still need to apply and have SSA determine entitlement.
Frequently Asked Questions
Will Social Security lower my benefit if I get a pension from work not covered by Social Security?
The Social Security Fairness Act ended WEP and GPO reductions for benefits payable beginning January 2024. A pension alone does not guarantee an increase: the pension must be based on non-covered work and your Social Security benefit must have been affected. Ask SSA to confirm your specific record.

Will my spouse’s Social Security benefit be reduced if I get a government pension based on my own earnings?
The former Government Pension Offset applied to certain spouse or survivor benefits when the beneficiary received a pension from non-covered work. The Fairness Act ended GPO reductions for benefits payable from January 2024. Check with SSA about the benefit on your record and your individual entitlement.
How many months of benefits could I receive?
For someone already entitled to an affected benefit, an adjustment may include months back to January 2024. A new application has separate rules: some retirement and survivor benefits generally allow up to six months of retroactivity, while some disability claims may allow up to 12 months. These are general limits, not a guarantee.
Do I need to apply for the Social Security Fairness Act adjustment?
If you already receive an affected benefit, SSA generally says no action is needed if it has your correct mailing and direct-deposit information. If you never applied or are unsure whether an application exists, you may need to file; repeal does not automatically create a claim. Contact SSA or check your account.
