What to Do If You Receive GST Notices from Officers in Different Jurisdictions

Different GST officers may have authority to contact you, but proceedings on the same subject matter can raise a separate legal issue. Learn what to check and how to protect your deadlines.

If Central and State GST officers both contact you, do not assume that one communication is invalid—or that one cancels the other. Compare each communication’s legal basis, subject matter, tax period, procedural stage and issuing authority, then protect the response deadline for every live notice while you get case-specific advice. Under the CGST Act, cross-empowerment allows officers from different administrations to have roles, while section 6(2)(b) restricts proceedings on the same subject matter in specified circumstances.

Why officers from different GST administrations may contact you

India’s GST system gives Central and State or Union Territory administrations cross-empowerment roles. Section 6 of the CGST Act provides, subject to applicable conditions, for State and Union Territory tax officers to act as proper officers for CGST purposes; corresponding State GST provisions address Central officers. GST Council material also describes intelligence-based enforcement by either administration across the value chain.

That means an officer from an administration different from the one you usually deal with is not automatically unauthorized. The Supreme Court of India’s judgment dated 14 August 2025 explains that cross-empowerment supports a single-interface system, but also distinguishes ordinary administrative work from intelligence-based enforcement. The authority and circumstances of each action still matter.

Can two GST officers issue notices for the same issue?

Section 6(2)(b) addresses a particular kind of overlap: where a State or Union Territory proper officer has initiated proceedings on a subject matter, a Central proper officer must not initiate proceedings on the same subject matter, subject to the statutory scheme and applicable conditions. The Supreme Court described the provision as guarding against multiple proceedings on the same subject matter.

This is not a blanket rule that two communications about the same business, tax type or broad period are necessarily duplicates. Compare the actual GSTIN, transaction or issue, tax period, legal provision and procedural stage. Different labels or different officers do not by themselves settle whether the subject matter is the same.

Situation What the legal distinction means What to check
Audit or detailed scrutiny of returns The Supreme Court says this work is to be initiated by the administration to which the taxpayer is assigned. Your assigned jurisdiction, the provision cited, the tax period, the records requested and the stage of the communication.
Intelligence-based enforcement The Court says either Central or State administration may initiate this kind of action, subject to applicable law. The stated enforcement basis and whether proceedings on the same subject matter have already been initiated.
Registration jurisdiction changed during a matter CBIC Circular 255/01/2026-GST, dated 25 June 2026, addresses the handling of action after migration or transfer. The effective transfer date, which authority acted at each stage and the official CBIC circular text.

Does a GST summons count as proceedings?

Not by itself for the section 6(2)(b) restriction. In its 14 August 2025 judgment, the Supreme Court held that “the issuance of summons under Section 70 of the CGST Act is not hit by Section 6(2)(b) of the CGST Act”. The Court distinguishes an inquiry from proceedings for this statutory purpose. That holding concerns the summons/proceedings distinction; it does not establish that every summons or any later notice is valid in every case.

Read the communication carefully to identify whether it is a section 70 summons, an audit or scrutiny communication, a show-cause notice, an order, or another procedural step. A summons and a formal proceeding are not interchangeable simply because both require you to respond or provide information.

What to do when you receive communications from different jurisdictions

  1. Preserve the record. Save the complete communication and enclosures, envelope or email details, and any GST portal service record. Note when and how it was served.
  2. Make a notice-by-notice list. For each item, record the GSTIN, issuing officer, Central, State or UT administration, jurisdiction shown, provision invoked, communication type, tax period, alleged transaction or issue, date received and response deadline.
  3. Put the communications in date order and mark the stage. Separate summonses or inquiries from audit or scrutiny communications, show-cause notices, orders and appeal or review steps. The stage matters because a section 70 summons alone is not initiation of proceedings for section 6(2)(b).
  4. Compare the substance, not just the officer names. Check whether the communications concern the same GSTIN, issue or transaction and period, and preserve evidence of any earlier response or proceeding. A tax professional can assess whether the subject matter actually overlaps.
  5. Check for a jurisdiction change. If your registration moved between jurisdictions, record the effective date and identify which authority acted before and after it. The transfer framework is discussed below.
  6. Get prompt case-specific advice and protect each deadline. Ask a qualified GST professional or lawyer to assess the authority, any same-subject-matter objection and the appropriate procedural response. Do not ignore a communication or assume that another one cancels it; the cited legal sources do not establish a universal objection format or guarantee relief.

What changes if your GST jurisdiction changed?

CBIC Circular 255/01/2026-GST is dated 25 June 2026 and addresses migration or transfer from one jurisdiction to another. A reproduced version describes a framework under which valid action taken by the authority with jurisdiction at the time remains valid after the move; the new jurisdiction handles later stages and takes over a matter pending at transfer; and the former authority should not initiate new action after the transfer.

This point is limited to a jurisdiction change by migration or transfer; it is not a general rule for every dispute between Central and State officers. Before relying on the framework in a live matter, check the circular on the official CBIC portal and confirm the current text, your effective transfer date and the status of the proceeding. The CBIC portal listing identifies the circular’s title and date, while the reproduced full text is not a substitute for verifying the official version.

How to assess a possible duplicate proceeding

If two formal communications appear to pursue the same subject matter, assemble the full chronology and ask an adviser to compare them against section 6(2)(b). Include the first communication and proof of service, any replies, later notices or orders, and the factual issue and tax period each addresses. A meaningful assessment depends on the substance and procedural history, not only whether the officers belong to different administrations.

Continue to track each stated deadline while the overlap is assessed. The sources establish the relevant distinction between cross-empowerment, same-subject-matter proceedings and summonses; they do not prescribe one response format or determine the result for every pair of communications.
