If a business in India does not reply to a GST show-cause notice, the proper officer may decide the matter using the information already available and issue an adverse order. Silence is not automatically an admission of every allegation, and the outcome depends on the notice’s legal basis and type. Check the notice’s provision, deadline, tax period or application at issue, and any hearing details before deciding what to do.
Why the kind of notice matters
“GST show-cause notice” is not one single procedure. The notice should identify the statutory provision and explain what action the officer is considering. A tax-demand proceeding and a registration proceeding can have different forms, deadlines and consequences. The CGST Act text hosted by CBIC and the CGST registration rules hosted by CBIC set out different procedures; the notice itself should guide you to the one that applies.

| Notice type | What to check if there is no reply |
|---|---|
| Tax demand | Identify the cited provision, tax period, allegations, proposed tax, interest and penalty, and the response and hearing instructions. The officer may determine the matter on the available record; the applicable procedure and safeguards are set out in the Act. |
| Registration-related | Identify the rule and form involved, and whether the notice concerns an application, amendment or cancellation. The registration rules give specific consequences for particular procedures, including rejection of an application in a specified amendment procedure when no reply is furnished within the prescribed period. |
| Other GST proceeding | Use the provision and instructions in that notice. Do not assume a deadline or response form from a different kind of proceeding applies. |
For example, the CBIC registration rules prescribe a seven-working-day reply window in certain registration procedures. That is not a general deadline for every GST notice. Use the date and deadline stated in your notice, and verify the rule it cites.
What can happen in a tax-demand proceeding
The Act describes tax-demand notices under sections 73 and 74 as calling on a person to show cause against proposed tax, interest and penalty. If the business does not respond, the officer may proceed to determine the matter from the material available. That creates a practical risk: the record may not include the business’s explanation, supporting documents or challenges to the calculations.

The result is not necessarily an automatic confirmation of everything alleged. For a tax determination under the cited Act text, section 75 provides safeguards. Subsection (4) says: “An opportunity of hearing shall be granted where a request is received in writing from the person chargeable with tax or penalty, or where any adverse decision is contemplated against such person.” Subsection (6) requires the order to state the relevant facts and the basis of the decision. These protections do not make ignoring a notice harmless: the officer can still decide the case on the available record.
Section 75(7) also limits the order: the tax, interest and penalty demanded must not exceed the amounts specified in the notice, and the order cannot confirm a demand on grounds outside the notice. The CGST Act text is available on the CBIC website. Check that the provision and version applicable to the tax period match the notice, including any relevant amendments.

What to check and do promptly
- Verify the notice. Record its number, issuing authority, date and mode of service, cited provision, tax period or registration matter, and stated reply deadline.
- Identify the procedure. Determine whether it is a demand, registration or cancellation matter, or another proceeding. Confirm the prescribed reply form and submission method rather than reusing instructions from another notice.
- Review the case being made. Note each factual and legal allegation, proposed calculation, requested record, portal instruction and hearing date. Gather relevant returns, invoices, payment records and correspondence.
- Address the deadline and hearing. Follow the notice’s filing instructions and, where appropriate, make any hearing request in writing. If time is short or the matter is complex, promptly assess available options with a qualified Indian GST practitioner; professional representation is not asserted to be legally required in every case.
If an order has already been issued
Section 107 of the CGST Act provides an appeal to the Appellate Authority within three months after the decision or order is communicated. It permits admission within a further month if the authority is satisfied that sufficient cause prevented filing during the initial period. This is an appeal period after communication of an order, not extra time to answer the original notice. Check the communication date, applicable appeal requirements and current amendments promptly. See the CGST Act text hosted by CBIC.
