A civil summons usually tells a defendant about a lawsuit and how to respond; a subpoena commands someone to appear, provide information or records, or allow an inspection. The deadlines and procedures depend on the court, case type, and how the document was served—there is no single response deadline for every summons or subpoena.
How to tell a summons from a subpoena
Start with the document’s title, case caption, issuing court or agency, case number, recipient, service details, and required action. The word “summons” does not always mean a civil lawsuit: federal courts also issue criminal summonses, and people may receive jury-service, family-court, state-court, or administrative papers. The United States Courts’ forms list distinguishes a civil summons from civil subpoenas for different purposes.

These are general distinctions, not a substitute for reading your particular document. State, territorial, local, criminal, family, administrative, and jury-service matters may use different rules from the federal civil examples below.
What to do immediately
- Keep the entire document and delivery details. Save the envelope, attachments, and any related records. Note when and how it arrived. Service and the identity of the recipient can affect what happens next.
- Pin down the required action. Determine whether you are being told to file a response, attend a hearing or deposition, produce records, or permit an inspection. Do not treat a request to appear as though it were only a request for documents.
- Calendar the date stated on the document and check the governing rule now. Do not use a deadline from another case or assume a general online answer applies. The federal civil handbook discussed below says the time can depend on who the defendant is and how service occurred.
- Verify suspicious communications independently. If a call, text, or email seems unusual, locate the court’s official website or contact details yourself rather than relying on a link or number in the message.
- Contact qualified local help if the instructions or deadline are unclear. Depending on where you are and your eligibility, options may include a court self-help or legal help center, legal aid, or a lawyer referral service.
If you receive a civil summons
Do not assume the deadline is the same in every court
As a federal civil example, the United States District Court for the District of Columbia’s 2022 pro se handbook describes a general deadline of 21 days after service of the summons and complaint for a defendant to file a written response, unless an applicable statute sets a different time. The handbook also describes different timelines in some situations, including a returned waiver of service, certain government defendants, and amended complaints. The actual summons, service date, applicable law, and current court rules matter.

Understand the possible consequence of missing the response deadline
The handbook explains that a response may generally be an answer or a motion challenging an aspect of the complaint. It also warns that missing the deadline can expose a defendant to default proceedings and a possible default judgment. Which response is appropriate depends on the case and rules; do not choose or file one based only on a general article.
If you receive a subpoena
Read the command and compliance details closely
Check whether the subpoena requires testimony, document production, another form of information, or an inspection. Note the compliance time and place, the materials described, and who issued or served it. The federal civil subpoena form distinguishes these purposes; procedures can differ outside federal civil cases.

For a federal civil document or inspection subpoena, check the objection procedure promptly
The United States Courts’ AO 88 civil subpoena form reproduces Federal Rule of Civil Procedure 45 text with an effective date shown as December 1, 2013. For a subpoena requiring production or inspection, that text permits a recipient to serve a written objection on the designated party or attorney before the earlier of the compliance time or 14 days after service. If an objection is made, the serving party may ask the court to compel production; production may then be required only as the court directs. Verify the current rule and local procedure before relying on this federal example. Do not assume this document-subpoena process applies to a command to testify.
Know when a court may quash or modify a federal civil subpoena
Under the Rule 45 text reproduced on AO 88, on a timely motion a court must quash or modify a subpoena on specified grounds, including insufficient time to comply, exceeding geographic limits, requiring disclosure of privileged or protected matter without an applicable exception or waiver, or imposing undue burden. Other circumstances may allow a court to quash, modify, or condition compliance. Applying these grounds requires the actual subpoena and the governing procedure.

Preserve responsive material and handle privilege carefully
The cited rule text says documents may be produced as kept in the usual course of business or organized and labeled to match the demand. Electronically stored information should be produced in the form specified or in a reasonably usable form, subject to the rule’s provisions. Do not delete, alter, or conceal material that may be responsive. Privilege claims have procedural requirements, so get legal guidance rather than assuming that withholding material requires no further action.
The form also states that a person who has been served and fails without adequate excuse to obey a subpoena or related order may be held in contempt. That does not mean you should comply blindly with a potentially defective demand; it means you should promptly use any applicable objection or motion procedure instead of letting a deadline pass.

How to check whether a court-related message is a scam
The United States District Court for the District of Oregon’s public notice, last updated August 20, 2026, warns about fraudulent calls, texts, and emails that impersonate court officials, threaten prosecution or fines over jury service, subpoenas, or warrants, and seek banking details or payment by gift card, credit card, or similar methods. The notice states: “Federal officials do not demand payment of money in lieu of being arrested.” It also says that federal courts will not serve a summons or warrant, or notify someone of one, by email, phone, or fax.
Pause before paying or sharing sensitive information, and verify through independently located official court contact details. That notice is from one federal district; it is not a complete statement of how every court communicates. If you have an actual paper document, verify it with the issuing court using contact details found independently.
When to get legal help
Seek qualified help promptly if you cannot identify the issuing forum, do not understand what is demanded, believe service was improper, need to raise an objection, or may miss a stated date. The District of Columbia federal court handbook directs people who need help responding to a lawsuit to court legal help centers. Availability and eligibility for court assistance, legal aid, or referral services vary by location.
