Stop HSA contributions—including employer payroll deposits—and confirm the Part A effective date on your Medicare record. If Part A began earlier than you expected, some deposits may be excess even if they were made before you knew coverage had started. Work out the limit for the affected tax year, then ask your HSA custodian about correcting any excess and follow that year’s IRS filing instructions.
Why a Part A start date can make HSA contributions excess
For an HSA contribution, Medicare enrollment matters even if you keep working, have an employer health plan, or did not apply for Medicare until later. IRS Publication 969 (2025) says the contribution limit is zero beginning with the first month you are enrolled in Medicare. That includes months of retroactive Part A coverage. So a deposit made before you received notice of your effective date may still count against a contribution limit that was already reduced.

This does not automatically make every contribution for that calendar year excess. The limit depends on the months you were eligible to contribute and the other HSA eligibility requirements that applied to you. You need the right Part A date, your coverage and eligibility details, and the total contributions from every source before you can calculate an excess.

The Medicare & You 2027 handbook says premium-free Part A generally reaches back six months from the application or an application for Social Security or Railroad Retirement Board benefits, but not earlier than the first month you were eligible for Medicare. The applicable period can depend on how you qualified. Treat that as a reason to verify your own record—not as a substitute for the effective date Medicare assigned you.

First actions to take
- Stop new contributions. Tell your employer’s payroll or benefits team to stop HSA deductions and employer deposits, and stop making direct deposits yourself. A contribution that is still being sent while you sort out the dates can add to a potential excess.
- Confirm the Part A effective date. Check your Medicare notice or Medicare account and record the exact effective date. Do not calculate from the day you applied or assume coverage began only when you received your card. If the record is unclear or appears inconsistent, contact Medicare to clarify it before finalizing your tax calculation.
- Gather the year’s contribution records. List HSA deposits for the affected tax year, with date, amount, and source: your own direct contributions, payroll contributions, employer contributions, and contributions made by anyone else. Reconcile the list against HSA statements and payroll or tax records so that no source is omitted.
- Establish your eligible months and annual limit. Use the Form 8889 instructions for the tax year at issue and consider the Part A enrollment month alongside your HDHP coverage and all other HSA eligibility conditions. The Medicare rule sets the limit to zero beginning with the first enrolled month; the remaining-month calculation is not necessarily zero for the whole year.
- Ask the HSA custodian how to correct an excess. Explain that you are seeking a return of excess contributions, not an ordinary withdrawal, and ask what forms and processing dates it requires. If there is attributable earnings, the correction generally includes withdrawing those earnings too.
- Prepare the tax reporting for that year. File Form 8889 and, if required, Form 5329 using that year’s instructions. If you already filed, check the applicable Form 5329 instructions for the post-filing correction procedure before submitting a withdrawal or amended return.
How to determine whether you have an excess
Use the effective month, not just the deposit date
Start with the month Part A coverage took effect. Under the IRS rule, your contribution limit becomes zero beginning in that month. Compare that with the months in the same tax year in which you otherwise met HSA eligibility rules. The result is a year-specific limit, not a simple test of whether a deposit arrived before or after you received Medicare paperwork.
For example, if you made payroll contributions while working and later learned that premium-free Part A had been backdated, the date you learned about coverage does not by itself settle whether the earlier deposits were allowed. The assigned Part A effective month and your eligibility in each relevant month drive the calculation. Do not infer an individual result from the general six-month retroactivity rule: the handbook notes a first-eligibility-month boundary and qualification-dependent timing.
Count every contribution source
Compare the allowable amount with all contributions for the tax year, not only deposits you initiated. Include employer contributions and amounts routed through payroll. The IRS instructions use Form 8889 contribution amounts in the excess-contribution reporting process. Keep a record that separates contributions by source and date, because the reporting and income treatment of employer amounts may depend on how they were handled on your W-2.

If employer contributions were not already reflected in W-2 box 1, the IRS says excess employer contributions may also have to be included in gross income. Review the W-2 and coordinate with payroll or benefits rather than assuming every employer deposit was already taxed or that stopping future deposits corrects deposits already made.
Use the instructions for the tax year involved
Contribution limits, forms, deadlines, and correction procedures are tax-year-specific. Use the Form 8889 and Form 5329 instructions for the year of the contributions, not simply the latest form you find. IRS Publication 969 (2025) explains the general Medicare and excess-contribution rules; the detailed reporting path should be checked against the relevant year’s forms. This article cannot determine a personal excess without the effective date, deposit totals, HDHP coverage, other eligibility details, and filing facts.
Correcting excess contributions
Before the tax return deadline
IRS Publication 969 says excess contributions can generally be withdrawn by the due date of your tax return, including extensions, along with attributable earnings. Contact the custodian early enough to learn its process and processing time. Ask it to identify the transaction as a return of excess contributions and to calculate or report the earnings attributable to the returned amount. Keep its confirmation and any tax statements with your records.

Do not treat an ordinary HSA distribution as an automatic correction. A regular distribution can have different tax consequences, especially if it is not used for qualified medical expenses. Confirm with the custodian that the transaction is processed under the excess-contribution correction rules and check the tax-year instructions for how to report it. Earnings withdrawn with the correction are included in income for the year received, according to Publication 969.
If you already filed or the ordinary deadline passed
The path may differ if you filed a timely return but did not withdraw the excess by the original deadline. The 2025 Instructions for Form 5329 describe a possible six-month correction period after the tax return due date, excluding extensions, for a timely filer. They also specify amended-return requirements: the amended return is marked “Filed pursuant to section 301.9100-2” and includes an explanation. Eligibility and precise steps depend on the facts and the instructions for the tax year involved.
If that period has passed, or you already filed an amended return, do not assume the same route remains available. Consult the Form 5329 instructions for the specific year and consider help from a tax professional familiar with HSAs and amended returns. A custodian can explain its transaction process, but it cannot determine every part of your tax filing obligation.

What happens if the excess remains in the HSA
The IRS general excise tax on excess contributions that remain in an HSA is 6% for each year the excess remains. It is an annual tax, so leaving an uncorrected amount in the account can create consequences beyond the year the deposits were made. The applicable Form 5329 instructions explain the reporting calculation; do not estimate your bill by applying 6% to total account value or to all deposits without determining the excess under the year’s rules.
Employer excess not already included in W-2 box 1 may also have to be included in gross income. That income question is separate from the excise-tax reporting. Review both when deciding how to report the year, and keep any custodian records showing the amount returned and attributable earnings.

How to avoid the same problem when planning Medicare
If you expect to apply for Social Security or RRB benefits, retire, or otherwise become entitled to Medicare, plan HSA deposits around the possible Part A effective date rather than the date you expect to receive your Medicare card. Medicare.gov advises people with an HSA to have both themselves and their employer stop contributions six months before retirement or applying for Social Security or Railroad Retirement Board benefits. This is preventive guidance tied to the possibility of retroactive Part A; your actual assigned date and eligibility still determine your tax-year calculation.

That recommendation concerns HSA contributions. It does not decide when you should enroll in Part B or whether you qualify for a particular enrollment period. Medicare’s sign-up guidance discusses an eight-month Special Enrollment Period that may apply after employment or qualifying job-based coverage ends, but eligibility is individual. Check the Medicare enrollment rules separately so that an HSA correction does not lead you to assume an enrollment decision has also been resolved.
For future planning, tell payroll the date you intend contributions to stop and ask when the final payroll deposit will reach the HSA. Recheck employer contributions as well as your own deposits: a payroll election may stop employee deductions without stopping an employer contribution under the plan. Save the Medicare notice, HSA statements, payroll confirmation, custodian correction record, and filed forms together so the effective-date and contribution trail is clear.
