What to Do If Someone Else Claimed Your Child as a Dependent

If someone else claimed your child as a dependent, check your federal eligibility first. Here is how to handle an e-file rejection, a CP87A notice, IRS proof requests, and the Form 8332 exception for separated parents.

If someone else has claimed your child on a federal return, a rejected e-file or a CP87A notice does not by itself decide who is entitled to the child. Start by checking whether you qualify under federal rules for the tax year in question. Then follow the filing and notice steps in the order below. This guidance covers U.S. federal income tax only. State consequences can differ and are not covered here.

Step 1: Confirm you are actually eligible to claim the child

A child generally cannot be claimed as a dependent on two federal income tax returns for the same tax year. The IRS states the rule this way in its dependent guidance: a child can be claimed on only one return per year. When more than one person could claim the child as a qualifying child, the federal tiebreaker rules decide which person may claim the child. The IRS’s Publication 3211 (Rev. 1-2025) explains that tiebreaker.

Eligibility depends on facts, not on who filed first. The questions that matter include:

  • Relationship: Is the child your son, daughter, stepchild, foster child, sibling, or another relative the rules cover?
  • Age: Did the child meet the qualifying-child age test for the year?
  • Residence: Did the child live with you for more than half of the year, and for how many months?
  • Support and joint returns: Did the child provide more than half of their own support, or file a joint return?
  • Parents’ situation: If the parents are divorced or separated, which parent is the custodial parent (see the separate section below)?

Check the child’s name, date of birth, and Social Security number against the return you are filing. A mismatch can cause a rejection even when your claim is valid.

Step 2: Understand what an e-file rejection means

When a return is rejected because the dependent is already claimed, the rejection tells you that the IRS’s systems already have a return claiming that child. It does not tell you who is right. The IRS identity-theft guidance says taxpayers should verify the information they entered and determine whether they are entitled to claim the dependent before doing anything else.

Once you have confirmed your eligibility, you have two ways to file:

  1. Electronic filing with an Identity Protection PIN. For Tax Year 2024 and later returns, the IRS says an eligible taxpayer may e-file if the primary taxpayer has a current-calendar-year Identity Protection PIN (IP PIN). An IP PIN issued for a prior year will not work for a return filed in the current calendar year. Use the instructions for the specific tax year you are filing.
  2. Paper filing. If you do not have a current-year IP PIN, you can file a paper return. The IRS guidance cited for this article gives six to eight weeks as a possible processing time for paper returns. Processing estimates change, so check the IRS page before relying on that timeline.

Do not attach extra documents to prove eligibility with the initial return. The IRS says it will ask for proof if it needs it.

Step 3: Know what happens after you file

Once your return is in, the IRS may contact you for proof of the child’s relationship and residence. If it does, answer by the deadline in the letter and send the evidence it requests, complete and on time. Do not mail sensitive documents unless the IRS asks for them and gives instructions.

Useful records include official documents that show the child’s name, a common address, and dates. The IRS lists examples such as:

  • school enrollment or attendance records
  • medical records
  • daycare records
  • social-service records
  • place-of-worship records
  • a birth certificate and proof of your identity

Keep copies of anything that establishes the child’s relationship to you and where the child lived. Store them with your return so you can produce them quickly if the IRS asks.

What a CP87A notice means

It is a duplicate-claim notice, not an audit

A CP87A notice reports that the same dependent or qualifying child was claimed on another return. It does not mean you are under audit. The IRS’s CP87A guidance, updated January 30, 2025, makes this distinction clear: the notice flags a duplicate claim so the IRS can determine which return is correct.

The IRS will not identify the other taxpayer. The CP87A FAQ states: “Disclosure laws prohibit us from revealing the name of the taxpayer who used the same Social Security number as your dependent or qualifying child.”

If your claim was correct

Follow the instructions in the notice and wait for further IRS contact. You may still be asked for proof under Step 3, so keep your records ready.

If you claimed the child incorrectly

If you review the facts and find that you were not entitled to claim the child, the IRS says you may need to file Form 1040-X to amend your return. Amending corrects your original claim; it is not a penalty by itself, but it should be done carefully, using the form instructions for the year you are correcting.

When you do not know who claimed your child

Most duplicate claims come from confusion, a former partner or relative claiming the child in good faith, or a parent who did not know the other parent had already filed. A duplicate claim is not automatically identity theft.

However, if you did not file a return claiming the child, you cannot identify the other claimant, and you suspect someone is using the child’s identity, follow the IRS identity-theft guidance for dependents. That guidance explains how to report the misuse and what to send. Treat it as a separate process from the duplicate-claim notice.

Divorced or separated parents and Form 8332

For a child of divorced or separated parents, the custodial parent is generally the parent with whom the child lived for the greater part of the year. Under the general rule, the custodial parent is the one who may claim the child as a dependent.

There is a special rule. The custodial parent can release the claim to the noncustodial parent by signing Form 8332 or a qualifying similar statement. The noncustodial parent then attaches that release to their own return. Publication 504 (2025) explains this separated-parent exception.

The release has limits:

  • It covers certain dependent-related and child-related benefits. It can allow the noncustodial parent to claim the dependency and certain child-related credits. It does not transfer every child-related benefit.
  • It does not transfer head-of-household status. The noncustodial parent does not become eligible for head-of-household filing status on that basis alone.
  • It does not transfer the earned income credit, the child and dependent care credit, or the dependent-care-benefit exclusion. Those remain governed by the separate federal rules for each benefit.

A state court order that allocates the child’s tax benefits does not by itself meet federal requirements. The IRS states: “Federal tax law is what determines who may claim a child as a dependent on a federal income tax return.” A parent with a custody or divorce order still needs a valid Form 8332 or equivalent release, signed by the custodial parent, to use the exception. Form 8332 is not a general way for a relative or former partner to claim a child. Its use depends on the facts and the tax year.

Check the tax year before you act

The IRS’s e-file rules and business requirements are updated each year. The guidance cited here includes Tax Year 2025 e-file rules and a Form 8332 revised in December 2025, so the rules and forms that apply to your return depend on the year you are filing. If you are preparing an earlier return, use the instructions for that year rather than this article’s dates.

A rejected e-file, a CP87A, and an IRS examination are separate events with different responses. Keep them distinct in your records, and answer each one under its own notice or letter.

Bottom line: confirm your federal eligibility before you respond, use the correct filing route, and keep the records that prove the child’s relationship and residence.
