What to Do If a GST Show-Cause Notice Relies on Third-Party Statements

If a GST show-cause notice relies on statements made by someone else, do not ignore the notice or treat cross-examination as automatic. Meet the response deadline stated in the notice, obtain the statements and other relied-upon material, identify the precise allegations you dispute, request a reasoned opportunity to cross-examine material witnesses, and answer the underlying tax allegations with your own records.

The strength of a cross-examination request depends on the facts, the procedural stage, the state jurisdiction and the law controlling the proceeding. The 2025 Karnataka, Kerala and Delhi High Court decisions discussed below support focused requests where third-party statements materially support an adverse finding; they do not guarantee the same result in every GST case.

First, protect your position before the deadline

A show-cause notice is both an allegation and a timetable. Start by preserving the notice exactly as received, including its annexures and electronic metadata. Read the provision cited, the tax period, the proposed tax, interest and penalty, the reply instructions and every hearing date. GST law does not provide one universal response period for every kind of notice, so use the deadline and procedure stated in your notice and verify the current rules applicable to that proceeding.

  1. Create a notice record. Note the notice number, date of issue, date and method of receipt, tax periods, statutory sections, amounts proposed, reply deadline and hearing date.
  2. Calendar every date. Allow time to obtain missing material, prepare evidence, obtain professional advice and upload or deliver the reply. Keep proof of filing and delivery.
  3. Separate allegations from evidence. Mark each paragraph that relies on a third-party statement, document, electronic record or investigation conclusion.
  4. Ask for a hearing if required. Attend the scheduled personal hearing or make a properly documented request if the stated procedure permits a change.

Do not wait for the department to decide whether a witness will be called before raising the issue. A request made during adjudication is easier to connect to the proposed finding than a complaint made for the first time after an order.

Map every third-party statement to the allegation it supports

Make a working table before drafting your reply. This forces you to distinguish a statement that is the foundation of the case from one that merely corroborates invoices, transport records or another independent source.

Item to record Questions to answer
Witness Who gave the statement? Is the person named, identified by role, or unknown?
Statement What is the date, format and location of the statement? Is the complete statement supplied?
Allegation Which proposed demand, classification, denial of input tax credit or penalty does it support?
Disputed proposition Which sentence or factual assertion do you contest, and what is your alternative account?
Independent material What invoices, movement records, payment evidence, returns or electronic data are said to confirm it?
Materiality Would the proposed finding be weakened if the statement were excluded, qualified or contradicted?

Use the paragraph numbers in the notice when available. If the notice refers generally to an investigation report without identifying the relevant passage, say that the reference is too broad to permit an effective response and ask the adjudicating authority to identify the relied-upon portions.

Request the material actually relied upon

An effective reply requires more than a bare demand for “all records.” Identify what you have not received and explain why each item is needed to answer the allegation. Ask for the full third-party statement, not only an excerpt, and for the relied-upon documents or electronic records that give the statement context.

  • List each statement by witness, date and reference in the notice.
  • Request copies or inspection of the statement and annexures that the notice relies on.
  • Identify missing pages, unreadable scans, untranslated material or documents referred to but not attached.
  • Ask how electronic records were generated and which portions are relied upon when context is unclear.
  • Distinguish material expressly relied upon from other departmental material. Do not assert an unconditional right to every internal record without checking the facts and applicable law.

State that you cannot provide a meaningful response to an allegation based on unidentified or incomplete material. Ask the authority either to supply the material or to refrain from relying on the undisclosed portion. Preserve your request and any response so the record shows when the issue was raised.

How to make a cross-examination request that can be decided

Cross-examination is most persuasive when it is specific, timely and tied to the proposed finding. Do not write only that natural justice requires cross-examination. Explain who must be questioned, what is disputed and how the answers could change the result.

  1. Name the witness. Use the name and designation in the notice or statement. If the identity is withheld, ask the authority to identify the person sufficiently for a fair request.
  2. Identify the relied-upon assertion. Quote or accurately describe the particular proposition attributed to the witness.
  3. Explain the factual conflict. Point to your invoice, ledger, e-way bill, delivery proof, bank entry, return or correspondence that conflicts with the assertion, where applicable.
  4. Show materiality. State why the proposed demand or penalty depends on the witness’s credibility or personal knowledge rather than on independent records.
  5. List focused topics. Identify the transaction dates, documents seen, source of the witness’s knowledge, persons present, method of recording the statement and any inconsistency with contemporaneous records.
  6. Ask for a decision before reliance. Request that the adjudicating authority decide the cross-examination request by a reasoned order before using the statement to reach an adverse finding.

Keep the request proportionate. If a statement concerns a peripheral fact and independent documents establish the same point, explain why questioning is unnecessary or, if the statement is still relied upon, why a limited examination is appropriate. Conversely, if the statement is the only substantial basis for the case, say that plainly and explain the prejudice caused by relying on it without testing the witness.

Answer the tax allegations on their merits

A procedural objection does not replace a substantive defence. File a complete response even while asking for cross-examination. Organise the evidence around the allegation actually made, rather than sending an undifferentiated document bundle.

Transaction and supply disputes

Where relevant, address purchase and sales invoices, purchase orders, contracts, delivery challans, goods-receipt records, e-way bills, transport documents, warehouse entries and correspondence. Explain discrepancies in dates, quantities, addresses or vehicle details instead of leaving the authority to infer an admission.

Input tax credit allegations

Set out the tax invoices, receipt or use of goods or services, payment trail, return entries, reconciliations and communications with the supplier that bear on the allegation. A document is not automatically decisive in every dispute; explain how each record answers the specific proposed finding.

Payment, valuation and classification issues

Provide ledgers, bank statements, debit or credit notes, agreements, price workings and the classification position where those matters are in issue. If a third-party statement asserts that no supply occurred or that a different value was paid, identify the contemporaneous records that contradict or qualify it.

Returns and reconciliations

Reconcile the figures in the notice with the relevant GST returns, books and previously filed explanations. Show the calculation, period and source for every adjustment. If the notice combines periods or entities, provide a schedule that separates them.

What Section 75 means for the hearing issue

The CBIC-hosted text of the Central Goods and Services Tax Act identifies Section 75 as the general provision for determination of tax. Section 75(4) provides an opportunity of hearing in specified circumstances, including when an adverse decision is contemplated or a hearing is requested. Check the version and amendments applicable to the relevant tax period and the corresponding state GST enactment before relying on the wording.

Section 75(4) is not, by itself, a promise that every witness can always be cross-examined. The practical question is whether the authority proposes to rely materially on a person’s statement and whether refusing a focused request would prevent an effective representation under the procedure governing the case.

What the 2025 High Court decisions show—and what they do not

JSW Steel Limited v. The Joint Commissioner of Central Tax

In a Karnataka High Court decision dated 13 August 2025 concerning a Section 74 proceeding, the court considered an argument that the statute does not expressly provide for cross-examination. On the facts before it, the statements of third parties were the entire basis of the authority’s adverse view. The court treated cross-examination as imperative for effective representation and held the writ petition maintainable despite an alternative remedy in those circumstances.

This is a fact-specific holding from Karnataka. It is strongest for a taxpayer who can show that the disputed statements materially or wholly support the adverse conclusion, that the request was made in time and that denial caused procedural prejudice. It is not a rule that every GST order based in part on a third-party statement must be quashed.

The Joint Commissioner v. Nishad K.U.

The Kerala High Court addressed a Section 74 case on 17 February 2025 and likewise treated natural justice as requiring cross-examination where third-party statements formed the basis of the finding. The court discussed why the Supreme Court’s older decision in Kanungo & Co., arising under the Sea Customs Act, 1878, should not be treated as a universal answer to a later statutory procedure.

The decision is jurisdiction-specific. The governing state enactment, the evidence actually relied upon and the stage at which the request was made still matter.

Delhi High Court judgment dated 29 July 2025

In its discussion of the hearing required under Section 75(4), the Delhi High Court stated: “before condemning a person that too on the basis of a statement of third party, the party against whom such statements have been relied upon is to be granted an opportunity to cross examine the person who gave that statement.” The sentence must be read in the context of that judgment and its facts; it does not establish a nationwide automatic procedure for every notice.

Choose the next remedy by stage, evidence and jurisdiction

There is no single correct next step for every taxpayer. Use these decision axes:

Question Why it matters
Is the statement central or merely corroborative? A central statement gives a stronger explanation for why credibility testing could affect the finding.
Do you have the complete statement and relied-upon material? Without the material, you may be unable to identify the disputed proposition or prepare questions.
Is adjudication still pending? A prompt request can be decided before the authority makes the finding and helps preserve the procedural objection.
Has an order already been passed? You must assess statutory appeal deadlines, available relief and whether the record shows denial of a fair opportunity.
Which state and precedent control? High Court decisions are persuasive or binding within their legal hierarchy and territorial context; outcomes can differ elsewhere.
What relief is available? An appeal, remand request or exceptional writ challenge may serve different purposes and have different limitation consequences.

A High Court may entertain a writ challenge where denial of cross-examination causes a serious natural-justice problem, as in the circumstances considered by the Karnataka decision. That does not make a writ petition the universal first step or eliminate the need to examine an available statutory appeal. Obtain advice from an Indian GST professional who can assess the exact notice, order, limitation period and controlling law.

If an order has already been passed

Act promptly. Obtain the signed order, the relied-upon statements, hearing records, your filed reply and proof of every request. Compare the order with your cross-examination request: did the authority identify the witness, decide the request, explain why it was refused and state whether the disputed statement was material to the result?

  1. Calculate the applicable statutory appeal limitation from the legally relevant date, not merely the date you opened an email.
  2. Check whether a stay, pre-deposit or other condition applies to the relief you need.
  3. Identify whether the order addresses your substantive evidence or simply reproduces the third-party account.
  4. Ask counsel whether the record supports an appeal, remand, rectification where legally available, or an exceptional writ remedy.

Do not assume that a successful procedural challenge ends the tax dispute. A remand may return the matter for a fresh hearing, where the underlying invoices, movement, payment and return evidence will still be examined.

A practical reply structure

Use clear headings so the adjudicating authority can see both the procedural and substantive positions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Preliminary particulars: notice number, date, tax period, provisions and a concise statement of the relief requested.
  2. Documents not supplied: a numbered list of each missing statement, annexure or relied-upon record, with the reason it is necessary.
  3. Cross-examination request: witness-by-witness allegations, disputed propositions, materiality, proposed topics and a request for a reasoned decision before reliance.
  4. Reply on facts: allegation-by-allegation response supported by indexed documents and reconciliations.
  5. Reply on law: the statutory provisions and authorities applicable to the tax period and state jurisdiction.
  6. Hearing and reservation: request the stated personal hearing, reserve the right to supplement after disclosure of missing material where permitted, and ask that no adverse finding be made on undisclosed evidence.
  7. Verification and filing proof: sign through the authorised person, submit by the prescribed channel and retain the acknowledgement, upload receipt and complete filed copy.

Mistakes that weaken an otherwise valid objection

  • Missing the notice deadline while waiting for documents or professional advice.
  • Requesting cross-examination without naming a witness or identifying the statement relied upon.
  • Demanding every departmental file without distinguishing relied-upon material from unrelated investigation material.
  • Filing only a natural-justice objection and failing to answer invoices, movement, payment, returns or calculation issues.
  • Assuming a High Court decision from another state automatically controls the proceeding.
  • Ignoring the hearing date because a written reply was uploaded.
  • Failing to preserve proof that the request and substantive reply were filed before the authority passed the order.

This article is general information, not case-specific legal advice. The result depends on the exact notice, evidence, statutory provision, procedural stage and jurisdiction.
