What to Do If a Casino Wrongly Flags You as a Problem Gambler or Banned Guest

A casino “flag” can mean several different restrictions. Get the decision in writing, preserve evidence of any mistake, and confirm the review route before taking action.

If a casino has labelled you a problem gambler or banned you, first get the decision and its review process in writing. Find out who issued it, what kind of restriction it is, what places and dates it covers, and which authority—if any—can review that specific decision. Keep relevant records and do not return while the restriction may still be active.

Start by identifying the decision

“Flag” is not a precise legal category. A notice might concern a formal exclusion order, a self-exclusion, a casino’s withdrawal of your licence to enter, an account restriction, or another venue ban. These actions can have different issuers, scopes, durations and review routes. Do not assume that one label—or the fact that a casino imposed the restriction—settles what it means.

Contact the casino through an official channel and request a copy of the notice or order. Ask it to confirm in writing:

  • What action was taken and who issued it.
  • The stated reason or policy basis, including any facts the decision relied on.
  • When it began, how long it lasts, and whether it has an expiry date.
  • Which locations and areas it covers, such as one venue, several properties, or a gaming area.
  • How to request review, who handles that review, and any deadline or required form.
  • Whether the restriction remains in force while a review is pending.

These are useful information requests, not a claim that every jurisdiction gives patrons a universal statutory right to each detail. New Zealand Department of Internal Affairs guidance says an exclusion order should generally clearly state the date, venue, issuer, affected person, authorising legal provision, and expiry date or duration, and says providing the patron a copy is useful. That guidance concerns New Zealand orders; it is not a universal legal checklist.

Preserve records and pinpoint any mistake

Keep the original notice, emails, messages, account or membership details, and a dated note of calls that records who you spoke with and what was said. Save relevant material that could show a factual error, such as evidence that the casino may have confused you with another person. Keep originals unaltered and send copies unless the review process specifically requires otherwise.

When disputing the decision, be specific: identify the statement or detail you believe is wrong, explain why, and attach the records that support your account. Ask the casino to preserve records relevant to its decision and request a written review outcome. A focused factual challenge is more useful than unsupported claims about the casino’s motives.

Use the review route for your jurisdiction and decision type

Check the notice first, then verify the route with the body responsible for that kind of decision in your location. A regulator may handle some exclusions but not a separate venue or account decision. Do not assume that any regulator can overturn every casino action.

New South Wales

The NSW Independent Casino Commission (NICC) describes formal exclusion orders that may be issued by a casino operator, the NICC, or the NSW Commissioner of Police. Signs of problem gambling are among the possible grounds listed for an exclusion order. The Commission distinguishes such orders from a casino’s “withdrawal of licence,” which may be for a set period or indefinite.

In NSW, the NICC can consider review of casino-issued third-party exclusion orders through Liquor & Gaming NSW acting under delegation. It says it cannot review a withdrawal of licence; for that type of decision, contact the casino operator about its own process. Check the written notice to establish which decision you received before approaching a review body.

Australian Capital Territory

ACT Government guidance says a person who disagrees with a licensee exclusion can appeal by contacting the Commission’s Exclusion Support team: [email protected] or 02 6207 0359 (option 3). The government page links a review-process fact sheet, but its detailed steps are not set out here; ask the team for the current process and any applicable deadline.

Other locations

Procedures vary. If your notice does not explain how to seek review, ask the casino for the process in writing and contact the gambling regulator or consumer complaint body for your jurisdiction to confirm which body handles that category of decision. The New Zealand order-detail guidance above can help you understand what an order may identify, but it does not establish appeal rights or deadlines outside the applicable local rules.

Do not return while the restriction may apply

A challenge does not, by itself, show that a restriction has been suspended. Ask the issuer or review authority what happens while the case is considered, and wait for written confirmation that the restriction has ended or changed before returning.

In NSW, a person subject to an exclusion order generally commits an offence by entering or remaining in the casino; the stated exception is for a person who self-excluded. Consequences elsewhere depend on local law and the kind of restriction, so do not treat the NSW rule as universal.

Make the request clear and keep a copy

You can adapt this message to request details and the correct review process. It is a drafting aid, not a statutory form or substitute for a jurisdiction-specific complaint procedure.

Subject: Request for written details and review process for casino restriction

I am writing about the restriction communicated to me on [date]. Please confirm in writing what type of restriction was imposed, who issued it, the reason or policy basis, the date it began, the period and locations it covers, and the process and deadline for requesting review.

I believe [brief factual issue, such as mistaken identity or incorrect information] may have affected the decision. Please tell me how to submit relevant evidence and confirm whether the restriction remains in force while it is reviewed. Please send me a copy of the decision or order and the written review outcome.

Keep a copy of what you send and any delivery confirmation. If the casino or authority gives you a form or specific submission instructions, follow those rather than relying on the sample wording.

When to get local legal advice

Consider contacting a locally qualified lawyer or legal assistance service if the restriction is connected to substantial funds, employment or accommodation, a criminal allegation, or a deadline that is close. The available procedures differ by jurisdiction and decision type; there is no single remedy, appeal deadline or compensation entitlement established across all casinos and locations.
