What the Temporary DOGE Treasury Records Agreement Did—and What Happened Next

The D.C. parties agreed to temporary limits on DOGE access while their case proceeded. The court later denied a preliminary injunction; a separate New York case followed a different path.

In Alliance for Retired Americans v. Bessent, the U.S. Department of Justice and the plaintiffs agreed to an interim order preserving the status quo while the case proceeded. It temporarily limited DOGE-affiliated personnel’s access to Treasury records, but it was not a final ruling that the access was unlawful. The District of Columbia court later denied the plaintiffs’ request for a preliminary injunction.

Which lawsuit was the agreement in?

The headline refers to Alliance for Retired Americans v. Bessent, a case in the U.S. District Court for the District of Columbia. After the court encouraged the parties to confer, they agreed to an interim consent order intended to preserve the status quo. The court later described that agreement in its March 20, 2025 procedural account (Document 52).

The parties’ agreement was a temporary procedural arrangement, not a judicial finding on the legality of DOGE’s access. The plaintiffs converted their request for a temporary restraining order into a motion for a preliminary injunction, which the court decided separately.

What did the interim order do?

The agreement maintained temporary limits on access while the case continued. It did not resolve the underlying dispute. The parties later asked the court to modify the order to replace Marko Elez with Ryan Wunderly after Elez left Treasury, as recounted in Document 52.

Blue Pre Inked Final Stamp - for Office Desk Use - for Records - for Work
  • ONE PRESS, DONE — Press the blue pre inked final stamp once and the final mark lands square on the page, ready to hand off or file. Marking a full stack of files takes minutes, not an afternoon.
  • LOW MAINTENANCE — Re-ink occasionally and the blue pre inked final stamp keeps performing; no other upkeep needed. Expect up to 25,000 impressions before the first re-ink.
  • NONPROFITS AND CLUBS — Volunteers can mark final on paperwork with no training needed. It covers daily paperwork without software or labels.
  • STABLE BASE — The housing keeps the die square to the page for a straight final imprint. The base grips the page so imprints never skid.
  • READY OUT OF THE BOX — It arrives pre-inked, so it joins your treasury office stamp and starts marking final on the first press. No assembly, no priming: unbox and stamp final.

Did the D.C. court ultimately block DOGE from Treasury records?

Not through a preliminary injunction. On March 7, 2025, the D.C. court denied the plaintiffs’ motion, concluding that they had not shown irreparable harm as required under binding circuit precedent. That ruling followed the interim agreement; it did not turn the agreement into a permanent restriction. See the court’s March 7 opinion, Document 42, and its account of the earlier agreement in Document 42.

How was the New York case different?

A separate case, State of New York v. Trump, was heard in the U.S. District Court for the Southern District of New York. There, Judge Jeannette A. Vargas issued a court-ordered preliminary injunction on February 21, 2025. It barred Treasury and its Secretary, pending further order, from granting covered DOGE-affiliated personnel access to Treasury payment records, payment systems, or other Treasury data systems containing personally identifiable or confidential financial information of payees. The scope and terms are in Document 76.

What happened to the New York case?

On September 23, 2026, the S.D.N.Y. court dismissed the access claims as moot after the DOGE executive order had expired and the Treasury DOGE team had been disbanded. It dismissed the remaining claims under Rule 12(b)(6). Those later developments belong to the New York case and do not change the D.C. court’s separate ruling. See Document 191.
