Eight former SpaceX employees sued the company and Elon Musk in June 2024, alleging workplace harassment and discrimination and claiming they were fired after raising concerns. The allegations have not been established by a court. The latest appellate activity documented in the cited materials is from February 2026, when SpaceX was appealing a denial of its motion to compel arbitration; those materials do not establish the appeal’s later outcome or the case’s status on October 8, 2026.
What do the former SpaceX employees allege?
The eight former employees—Paige Holland-Thielen, Yaman Abdulhak, Scott Beck, Rebekah Clark, Deborah Lawrence, Claire Mallon, Tom Moline, and André Nadeau—filed suit against SpaceX and Musk in Los Angeles Superior Court on June 12, 2024. Their complaint alleges that Musk’s conduct contributed to a hostile workplace and that the company retaliated against employees who raised concerns about harassment and discrimination. These are plaintiffs’ claims, not court findings. The Associated Press reported on the filing and allegations.
The plaintiffs connect their concerns to a June 2022 internal open letter urging management to address workplace conduct. AP reported that four plaintiffs alleged they were fired the day after the letter and that other terminations followed an internal investigation. That account describes the allegations; it does not establish why any individual employee was dismissed.
AP also quoted the open letter: “As our CEO and most prominent spokesperson, Elon is seen as the face of SpaceX — every tweet that Elon sends is a de facto public statement by the company.” That is the employees’ statement as quoted by AP, not a judicial finding. The report says the plaintiffs sought unspecified monetary damages.

What claims are in the lawsuit?
An October 24, 2024 opinion by the U.S. District Court for the Central District of California summarizes eight causes of action in the complaint. They arise under California law and include:
- Hostile-work-environment and sexual-harassment claims under the Fair Employment and Housing Act (FEHA).
- FEHA retaliation and failure to prevent harassment and discrimination.
- Sex discrimination.
- Whistleblower retaliation under California Labor Code section 1102.5.
- Wrongful termination in violation of public policy.
- Unlawful business practices.
The court opinion records what the complaint pleaded; the list is not a determination that the alleged conduct occurred. The October 24, 2024 district-court opinion also describes how the case moved from state to federal court.

Why did the case move to federal court?
SpaceX and Musk removed the lawsuit to the U.S. District Court for the Central District of California on August 16, 2024, invoking diversity jurisdiction. The plaintiffs sought to send it back to state court, and the district court opinion describes a dispute about SpaceX’s principal place of business at the time the case was filed. The removal and remand dispute is a question of court jurisdiction, separate from whether the workplace allegations are true.
What is the status of the lawsuit?
As of the latest dated appellate materials identified here, SpaceX was appealing a lower-court denial of its motion to compel arbitration in Ninth Circuit case 25-4811. In an update dated February 25, 2026, Equal Rights Advocates described SpaceX’s arguments, including its position that employees who were not direct targets of harassment could not bring hostile-work-environment claims. Equal Rights Advocates and other civil-rights organizations filed an amicus brief supporting the former employees. A separate amicus brief filed February 24, 2026 urged the Ninth Circuit to affirm the denial of SpaceX’s motion. These are arguments by the parties and amici, not appellate holdings. The cited February 2026 materials do not establish whether the Ninth Circuit later ruled, whether the case settled or was dismissed, or what further proceedings occurred. They therefore do not verify the lawsuit’s exact status on October 8, 2026. A later status requires a dated court-docket entry or other reliable subsequent reporting.

AP noted that Musk denied earlier sexual-harassment allegations referenced in the employees’ open letter. Those separate allegations are not the same as the claims being adjudicated in this case. The National Labor Relations Board proceeding mentioned in 2024 reporting is also separate from this civil lawsuit; developments in one should not be treated as rulings in the other.
