What the Epic v. Google Remedy Hearing Changed—and What It Means for Android

The August 2024 hearing was only the beginning. The final injunction, appeals, and Google’s 2026 onboarding program shape what rival Android app stores can do.

At an August 2024 remedy hearing, U.S. District Judge James Donato rejected Google’s argument that technical complexity and security concerns should keep Android’s app-store system largely as it was. He signaled that the remedy had to make competition possible, not merely permit sideloading. The hearing was not the final order: a permanent injunction followed on October 7, 2024, and by August 2026 Google said U.S. third-party app-store platforms could begin onboarding to a new Play program.

What was the hearing about?

Epic Games sued Google over the rules governing Android app distribution and payments. In December 2023, a jury found Google liable on Epic’s antitrust claims, including claims that Google unlawfully maintained monopoly power in Android app distribution and used contracts, payments, and relationships with developers and device makers to suppress competition. The jury decided liability; Judge Donato was responsible for deciding the equitable remedy. The court’s July 2024 order describes the verdict and post-trial proceedings.

The August 15, 2024 hearing concerned what changes should follow. Donato pushed back on Google’s contention that opening Android to competing stores would be too difficult, costly, or risky to implement. Contemporary coverage reported his remark that he intended to “tear the barriers down” and his view that Google should be able to make changes faster. Those comments signaled his direction; they were not themselves the enforceable remedy. Thurrott’s account of the hearing and the Associated Press report provide contemporaneous context.

What Epic asked the court to require

Epic’s proposed injunction aimed to make rival stores and distribution channels viable, rather than leaving developers with a theoretical right to install apps outside Google Play. Its requests included:

  • Giving rival stores access to Google Play’s app catalog, subject to developer participation or opt-out provisions.
  • Restricting Google’s use of contracts and financial incentives to keep developers exclusive to Play.
  • Allowing alternative billing and developer communications about payment options.
  • Reducing technical and commercial barriers to distributing Epic Games Store on Android.

These were Epic’s requests, not a description of everything Donato ultimately ordered. Epic’s published remedy proposal sets out its requested relief.

Why Google objected—and what the judge’s response meant

Google argued that the proposed changes could weaken Android security, expose users to unsafe or illegal apps, require extensive engineering, complicate compatibility and catalog management, and burden identity, payments, malware detection, and developer support. It also warned that the remedy could force the court to supervise Android continuously and undermine incentives to invest in the platform. The hearing coverage records Google’s objections, including its claim that implementation could take more than a year.

Donato’s response was not that security or engineering work did not matter. It was that generalized difficulty could not be used to preserve the market structure the remedy was meant to change. His stated approach was to require meaningful competition without dictating every technical implementation detail. He contemplated independent technical monitoring to help address compliance disputes. The final order retained room for reasonable security and legality safeguards, rather than granting Google blanket control over rivals.

What the October 2024 injunction actually required

On October 7, 2024, Donato entered a permanent injunction. Its core provisions address rival-store distribution, access to Play’s catalog, and Google’s ability to use commercial arrangements to discourage developers from distributing elsewhere. The injunction and accompanying order are the operative source for its terms.

Rival stores and Play catalog access

The order bars Google from prohibiting third-party Android app-distribution platforms or stores from being distributed through Google Play, subject to the order’s terms. It also addresses rival stores’ access to the Play catalog. That matters because permission for a store to exist is less useful if it cannot offer developers and users a competitive range of apps. The Ninth Circuit later identified catalog access and third-party app-store distribution as central elements of the remedy. The Ninth Circuit’s decision describes those provisions.

Developer freedom and commercial restrictions

For the injunction’s three-year period, Google may not condition payments, revenue shares, or access to Google products on a developer’s promise not to launch on a rival Android store or not to offer a different version elsewhere. This is not a guarantee that every developer will distribute on every store; it limits certain means of discouraging them from doing so.

Billing and payment choices

The case arose in part from Google Play Billing requirements and the commissions associated with them. Epic sought room for alternative billing and for developers to communicate payment options. The remedy should not be read as a promise that every app will offer another payment method or that prices and fees will fall. Those outcomes depend on developers’ choices and the commercial terms of the available options.

Security and legality safeguards remain

Google may take reasonable measures to protect computer systems and security, prevent illegal goods or services in the United States, and enforce applicable content standards. The injunction therefore does not require Google to distribute every app without review or make Android unmoderated. A continuing practical question is whether a particular requirement is a proportionate safeguard or a way to recreate the barriers the order is meant to remove.

How the appeals changed the timeline

On July 31, 2025, the Ninth Circuit affirmed the jury verdict and the core injunction while addressing Google’s challenges to the verdict, market definition, remedy, and implementation. A later Ninth Circuit order addressed implementation timing and the appellate mandate. The September 12, 2025 order is part of that timeline.

On October 6, 2025, the Supreme Court denied Google’s application for a partial stay. The Supreme Court docket records the denial. The appellate rulings did not end the implementation and compliance process; proceedings continued in the district court.

Where the case stood in August 2026

Google’s developer guidance says U.S. third-party app-distribution platforms could begin onboarding to its “Third-party App Store on Play” program on July 15, 2026. The guidance identifies September 12, 2025 as the date the Ninth Circuit upheld the relevant changes. Google’s official developer guidance is the current implementation signal.

Onboarding is a milestone, not proof that every rival store is already available on every Android phone. Store participation, developer decisions, implementation, device and regional conditions, and the terms of the operative order all affect what users can actually access. The guidance concerns developers and platforms serving users in the United States; it should not be treated as a worldwide change to Android distribution.

The district-court docket remained active, so later compliance filings or modifications may affect implementation. The court’s case docket is the place to check for subsequent orders.

What the remedy could mean for users and developers

For Android users

  • More stores could create additional ways to find and install apps, and competition may increase pressure to improve prices, selection, or service.
  • Multiple stores can also mean separate accounts, update systems, refund rules, parental controls, privacy policies, and support channels.
  • Installing from unfamiliar sources can increase exposure to malicious or deceptive apps, so users should consider the store’s reputation and security practices.

The injunction changes the rules under which stores may compete; it does not guarantee lower prices, better apps, or a successful rival store.

For developers

More distribution options can provide leverage and access to different audiences, but a lower stated store commission does not necessarily mean lower total cost. Developers may need to support separate signing, update, analytics, payment, fraud-prevention, and customer-support systems. Before adding a store, they should compare its actual reach and services with the costs of operating another channel, and determine whether catalog distribution is opt-in or subject to an opt-out.

For rival stores

Legal access alone does not create a competitive storefront. A rival needs a useful catalog, reliable installation and updates, user trust, discovery tools, developer support, payments and refunds, malware defenses, and enough users to attract developers. The injunction can reduce structural obstacles, but it cannot supply those network effects by itself.

How long does the injunction last?

The specified three-year restrictions on certain exclusivity arrangements run through November 1, 2027, absent later modification or extension. That date applies to those restrictions; it should not be read as a prediction that every part of the Android app-store ecosystem will revert on that day. The injunction sets out the period and terms.
