What the $500 Million Boeing 737 MAX Victim Compensation Fund Means

Boeing’s 2021 DPA designated $500 million for beneficiaries of the 346 people killed in two 737 MAX crashes. The agreement left individual payment recommendations to an administrator and final approval to the DOJ.

The $500 million figure was part of Boeing’s January 2021 deferred prosecution agreement (DPA), not a newly announced 2026 award. It was designated for the heirs, relatives, and legal beneficiaries of people who died in Lion Air Flight 610 and Ethiopian Airlines Flight 302. The agreement did not promise the same payment to every family: a claims administrator was to recommend recipients and amounts, subject to U.S. Department of Justice approval.

What the $500 million covered

On January 7, 2021, the U.S. Department of Justice (DOJ) announced a DPA with Boeing that included $500 million for beneficiaries of the 346 passengers who died in the two 737 MAX crashes. The agreement calls this the “Crash-Victim Beneficiaries Compensation Amount” and defines beneficiaries as victims’ “heirs, relatives, and/or legal beneficiaries.” The DOJ announcement described the amount as intended to provide some measure of compensation to the families and beneficiaries. The fund concerned deaths in two separate crashes: Lion Air Flight 610 crashed on October 29, 2018, killing all 189 people aboard, and Ethiopian Airlines Flight 302 crashed on March 10, 2019, killing all 157 people aboard, according to the DOJ. DOJ case history.

How the three DPA payment categories differed

The $500 million was only one component of the DPA’s stated $2,513,600,000 criminal monetary amount. The agreement separated payments by purpose and recipient:

Did every family receive the same amount?

No equal per-family payment is specified in the DPA. Boeing was required to deposit the full $500 million beneficiary amount into escrow. A claims administrator was to recommend who should receive payments and in what amounts, but the DOJ Criminal Division’s Fraud Section had to approve escrow payments and retained final decision-making authority. The agreement therefore establishes the fund’s total and decision process, not an individual payment schedule or a guaranteed amount for each family. DPA filed January 7, 2021.

What later happened in Boeing’s criminal case

The criminal-case context changed after the 2021 DPA. The DOJ says it notified the court on May 14, 2024, that Boeing had breached specified obligations under that agreement. On May 29, 2025, the DOJ and Boeing entered a non-prosecution agreement (NPA), and on November 6, 2025, the district court granted the government’s motion to dismiss the criminal information. In 2026, the Fifth Circuit denied victim representatives’ mandamus petitions. In its account of the appellate decision, the DOJ says the court concluded that Boeing’s 2024 breach meant the DPA “no longer bound the contracting parties and any challenge based on its terms became moot.” The DOJ also reports the court concluded that the district court correctly found no violation of the Crime Victims’ Rights Act in the Department’s handling of the NPA. What is known about payments from the fund

The DOJ’s 2021 release and DPA document the fund’s amount, intended beneficiaries, and administrative framework. The DOJ case-history page describes later criminal proceedings, but these materials do not state how much of the beneficiary fund has actually been paid out. The escrow requirement alone does not establish whether payments were made or remain outstanding.
