Elon Musk said in early February 2025 that DOGE was moving to stop payments it considered improper, including payments to federal contractors. But that did not give Musk personal authority to cancel any federal payment he disliked. Treasury said its initial review had not suspended payment instructions or delayed Social Security and Medicare, and later court orders restricted DOGE-linked access to sensitive Treasury systems. Whether a particular payment could lawfully be paused or terminated depended on the responsible agency, the governing law and agreement, and court orders.
What did Musk say about stopping payments?
In early February 2025, Musk publicly claimed that DOGE had identified allegedly improper federal payments and was rapidly stopping payments to contractors and organizations it viewed as problematic. Fortune reported his claim that DOGE was stopping payments to federal contractors, including amid controversy involving a faith-based refugee organization. (Fortune)
Those were claims about DOGE’s actions and judgments, not proof that recipients had committed fraud or that payments had actually been canceled. The phrase “payments he doesn’t like” is a characterization of the apparent breadth of the effort, not a verified verbatim quote. The claim that “no one can stop it” is likewise not an established statement of law; courts did restrict parts of the Treasury access arrangement.
What Treasury said the payment-system review involved
The Treasury Department’s February 4, 2025, letter said DOGE-affiliated staff working with Treasury official Tom Krause had read-only access to coded payment-system data. Treasury said the review had not suspended or rejected payment instructions and had not delayed or rerouted Social Security or Medicare payments. It also said the agency responsible for a payment—not DOGE—drove the payment process. (Treasury Department)

Treasury described the Bureau of the Fiscal Service as handling nearly 90% of federal payments, more than 1.2 billion transactions a year. Those figures are Treasury’s own description of the service’s workload, not an independent audit finding. The scale helps explain why system access drew scrutiny; it does not mean every user with access could decide which payments were legally due.
How a federal payment generally moves
- The agency determines the obligation. The agency administering a benefit, contract, grant, or other program determines whether a payment is due under the applicable law and agreement.
- The agency submits payment instructions. An agency-originated instruction enters the payment process through established procedures.
- Treasury processes the transaction. The Fiscal Service executes payment operations subject to system rules, security controls, and applicable law.
Technical access to payment data or systems is not, by itself, legal authority to cancel an agency’s obligation. Nor does a review label—such as “suspicious”—establish that a recipient committed fraud.
What later court records said about DOGE-linked access
Treasury’s February 4 description was not the only account of the access arrangement. A later filing in a District of Maryland case described a January 24 engagement plan for a four-to-six-week DOGE engagement. It said the plan contemplated access to payment-system source code and development access for technical personnel; it also reported that a DOGE-linked Treasury employee had access to the Payment Automation Manager (PAM), Secure Payment System (SPS), and Automated Standard Application for Payments (ASAP), and could observe payment-processing staff. That account makes the dispute more complex than either “read-only audit” or “Musk took control of Treasury.” The record describes different personnel, permissions, and stages of the arrangement. Reading coded data, reviewing source code, developing or testing technical changes, and having authority to release or cancel a particular payment are distinct capabilities. The filing documented technical access arrangements; it does not establish that Musk personally had unrestricted power to initiate or stop transactions.
Which payments were at issue—and what is different about each?
Contemporaneous coverage and litigation raised concerns about federal contractors, USAID-related payments, foreign aid, grants, and organizations Musk or DOGE accused of receiving improper funds. The Associated Press reported that DOGE workers sought access connected to stopping USAID payments, a development that conflicted with assurances that the Treasury review was only an audit or integrity assessment. - Investigation: Officials examine a payment or recipient. An inquiry alone does not prove wrongdoing or cancel an obligation.
- Contract or grant change: An agency modifies or terminates an agreement under its legal authority and the agreement’s terms.
- Payment pause: An agency or payment office temporarily holds a transaction, for example while checking documentation or complying with a court order. The legal basis matters.
- Nonpayment of an amount already due: Refusing to transmit money owed for completed work or another established obligation can raise different contract, statutory, and appropriations questions from ending future work.
- Direct individual benefits: Social Security and Medicare payments were specifically addressed by Treasury, which said on February 4 that its review had not delayed or rerouted them.
The White House’s February 26, 2025, executive order later defined covered discretionary contracts, grants, loans, and related instruments for review, while excluding direct assistance to individuals. It also provided exceptions, including for law enforcement, military, public safety, intelligence, emergency spending, and other agency-designated exclusions. (Executive order) That later framework should not be mistaken for evidence that all such payments had already been stopped in early February.
Could DOGE legally stop a federal payment?
DOGE could review spending, identify questions, and make recommendations. The February 26 order directed agency heads, working with DOGE team leads, to create systems recording payments under covered contracts and grants, including written justifications. It also authorized agencies, where appropriate and consistent with law, to modify or terminate covered agreements. The order made implementation subject to applicable law and the availability of appropriations, preserved agency heads’ legal authority, and did not itself create enforceable rights. Those qualifications matter. Reviewing an expenditure, directing an agency to examine a contract, pausing a transaction for a lawful procedural reason, and terminating an agreement under its terms are not the same as refusing to spend money Congress appropriated or withholding a payment already owed. The legality of a specific stoppage turns on the governing statute and appropriation, the contract or grant, the agency’s authority, and any applicable court order. A claim that spending is wasteful or politically objectionable does not, without more, establish that it is unlawful.

The original DOGE executive order established a temporary organization with a scheduled termination date of July 4, 2026. That date was the order’s stated schedule; it does not by itself establish what later action was taken or what authority any DOGE-linked personnel had in a particular payment dispute. - Courts: A Southern District of New York order barred Treasury from granting DOGE-affiliated personnel access to payment records and systems containing personally identifiable or confidential financial information, subject to specified legal and security conditions. The court did not grant the broadest requested relief prohibiting every process intended to halt Treasury payments. (Court order)
- Treasury leadership and career officials: Treasury controlled system permissions and operational procedures, within applicable law and court orders.
- Agency heads: Agencies responsible for programs and agreements generally make or authorize the underlying payment decisions; Treasury said the originating agency drove the process.
- Congress: Congress sets appropriations, conducts oversight, and can legislate. Executive officials cannot treat political opposition to a program as a substitute for statutory authority.
- Inspectors general and other watchdogs: They can investigate alleged misuse of funds, conflicts, security failures, or violations of law.
- Employees, contractors, and grantees: They may raise concerns through internal channels or challenge particular actions through available legal processes. Contract and administrative law can provide remedies when the government breaches obligations or improperly terminates an agreement.
The New York order is a concrete answer to the “no one can stop it” framing: judicial limits were imposed on access. But an access restriction is not a final ruling on every payment dispute, and it does not establish that every proposed pause or termination was unlawful.
Why the access dispute mattered beyond payment processing
The dispute involved sensitive financial and personal information, cybersecurity and system integrity, and the boundary between political appointees or temporary technical personnel and career officials who administer payments. It also raised a governance question: whether access intended for review could influence or implement decisions about which recipients receive public money. The later filing’s account of source-code and development access made the issue materially different from a purely passive review of records. (District of Maryland filing)

There are two common analytical errors to avoid. “Read-only” does not necessarily mean a review has no operational influence: reviewers can identify targets or recommend changes to officials who do have execution authority. Conversely, access to sensitive data or technical systems does not automatically confer authority to approve, cancel, or redirect a legally due payment.
What the record supports about Musk’s power
Musk and DOGE had political influence and DOGE-linked personnel had meaningful access to Treasury operations, though the public descriptions of that access differed over time and courts imposed restrictions. The record does not support the stronger claim that Musk personally possessed unlimited authority to cancel any federal payment he disliked. Formal payment decisions remained tied to agency authority, appropriations and other law, contractual obligations, Treasury procedures, and judicial oversight.
