A floating holiday is a policy-defined day off that can be scheduled on a flexible date instead of a date fixed on an employer’s holiday calendar. Whether it is paid, who qualifies, and when or how it can be used depend on the employer’s policy or agreement.
How a floating holiday works
An employer may provide a floating holiday as a paid personal day, a way to observe a cultural or religious occasion not on its standard calendar, or an additional flexible day off. The employee may be able to choose the date, but the policy may require advance notice, manager approval, or use by a deadline. There is no single definition that sets the terms for every workplace.
For example, Montana State University’s policy, effective January 1, 2019 and revised January 15, 2025, provides eligible full-time employees one scheduled day off per calendar year. Eligible part-time employees receive a prorated day based on FTE. The benefit is capped at eight hours and must be used all on one day; short-term and student workers are excluded, and employees covered by a collective bargaining agreement are directed to that agreement. A Connecticut Office of Legislative Research report describes selected state-employee policies in which floating or personal holidays are paid days off that may be used for any reason, including a religious holiday not recognized as a paid holiday by the employer. Is a floating holiday paid?
It may be paid if the employer’s policy or agreement provides for pay. Under the general federal baseline, the Fair Labor Standards Act does not require payment for time not worked, including holidays. The U.S. Department of Labor says, “The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations or holidays (federal or otherwise).” It adds that these benefits are generally a matter of agreement between an employer and employee or their representative. This is not a rule covering every circumstance: the Department notes that particular fringe-benefit requirements may apply to covered federal contracts under the Service Contract Act or Davis-Bacon and Related Acts. The Department’s FLSA advisor also explains that the law does not require employers to provide holiday time off, with or without pay, and that state law may affect whether holidays or other leave must be granted. Floating holiday vs. company holiday vs. PTO

These are typical distinctions, not universal categories. In particular, a floating holiday may be separate from PTO or handled within another leave arrangement; the written policy controls.
Is a floating holiday the same as a federal holiday?
No. Federal holidays are designated by statute and relate to federal employees’ holiday and leave rules. A floating holiday offered by a private employer is a workplace benefit whose terms generally come from the employer’s policy or an agreement. Read the employee handbook or any collective bargaining agreement that applies to you. If the policy is unclear, ask HR or your manager these specific questions:
- How many floating days are provided, and which employees qualify?
- Can you choose any date, or only a date tied to an approved observance?
- How much notice is required, and can a requested date be denied for staffing reasons?
- Can the day be split into hours, or must it be used as one full day?
- Does it expire at year-end, carry over, or get paid out when employment ends?
- Is it a separate benefit or part of your PTO balance?
These details are policy-specific. Federal guidance does not establish universal carryover or payout rules, and employer examples show that eligibility and usage restrictions can vary.
