A consignment shop sells items on behalf of their owners. The owner, called the consignor, leaves goods with the shop, or consignee, to offer for sale. If an item sells, the owner is paid according to the terms they agreed to with the shop; if it does not, the agreement determines what happens next.
How does a consignment shop work?
- The shop evaluates the item. It decides whether to accept the goods for resale.
- The owner and shop agree on terms. These should explain how the owner’s payout is calculated and what happens to items that do not sell.
- The shop offers the item to buyers. The shop handles the sale under the arrangement.
- The owner is paid if the item sells. The payout is based on the agreed terms. The University of Kentucky’s consumer guidance describes the owner receiving a percentage of the selling price after a sale, but the percentage depends on the shop and item; there is no universal rate established here.
- Unsold goods are handled under the agreement. The policy should explain whether and when the owner can retrieve them, or whether another outcome applies.
For example, the California Department of Tax and Fee Administration’s 2024 publication describes five bottles selling for $1,500, with $750 paid to the collector. That is a worked example, not a typical rate or industry average. California Department of Tax and Fee Administration, Publication 114
How is consignment different from an outright sale or donation?

An item’s presence in a secondhand shop does not, by itself, mean its owner donated it. The arrangement between the owner and seller determines whether the goods are consigned, bought outright, or donated.
What should you check before consigning an item?
Read the shop’s written agreement before handing over goods. At minimum, make sure you understand:

- How the payout is calculated and when payment is made.
- How long the shop will offer the item for sale.
- Whether the shop can change the price or apply discounts, if the agreement covers this.
- How the shop handles goods that do not sell, including when and how you can retrieve them.
- Who is responsible for the goods while the shop has them, if the agreement addresses that issue.
Terms vary by shop, and no standard commission or consignment period is established here. Ask questions about anything unclear and keep a copy of the agreement.
What should you know about tax and product safety?
Tax treatment depends on the jurisdiction and transaction details. California’s Department of Tax and Fee Administration explains that in a particular type of consignment transaction—where the consignee has possession or control and can transfer ownership to the buyer without further action by the owner—the consignee is treated as the retailer for sales-tax purposes. That is California-specific guidance, not a rule for every state or arrangement. Its Publication 114, revised July 2024, describes the distinction; consult current local rules for tax questions.

In the United States, consumer-product laws and regulations apply to consignment stores and other resellers, according to the Consumer Product Safety Commission. Applicable requirements and hazards depend on the product. The CPSC’s reseller product-safety guidance is directed at businesses screening goods for resale.

Do not assume that an online seller has the same return policy as a physical consignment store. For online marketplace purchases, the Federal Trade Commission recommends reviewing the listing and seller terms, checking shipping costs and the return policy, and using safer payment methods.
