Default can lead to credit damage, collection costs, limits on federal aid, and involuntary collections—but it does not mean every consequence starts at once, and there are official ways to get out of default. Private student loans follow different rules set by the loan contract and applicable state law. First confirm which loans you have and their status through StudentAid.gov or the notice from your loan holder; then contact that holder about options for your specific account.
What student loan default means
Default is a status that follows failure to meet the loan’s repayment terms. For covered federal Direct Loans and Federal Family Education Loan (FFEL) Program loans, Federal Student Aid generally defines default as being at least 270 days behind on scheduled payments. Contact your servicer as soon as payments become unaffordable rather than waiting for that threshold.
As an Amazon Associate I earn from qualifying purchases.
The 270-day rule is not a universal student-loan rule. Private-loan contracts determine when missed payments—or, in some contracts, other events—count as default. Federal rehabilitation and consolidation rules do not automatically apply to private loans.
Federal Student Aid describes the consequences of default as serious legal and financial consequences, but the exact next steps depend on the loan and its status. A borrower who is behind but has not reached default may still have time to contact the servicer about the account before it moves into default. If you are already in default, focus on confirming who currently holds the loan and which resolution options fit that specific loan.

Default is not the same as collections
Default is the loan’s status; collections are steps that may follow to recover the debt. Federal Student Aid says a defaulted federal loan may be transferred to the Department of Education’s Default Resolution Group. Some FFEL loans may instead be handled by a guaranty agency. The transfer or later collection action is not the same event as reaching the 270-day threshold.
That distinction matters because the day a covered federal loan enters default is not necessarily the day wages are garnished or a tax refund is withheld. Involuntary collection involves a later process and notice rights. A collection notice should be read separately from an earlier delinquency notice: it may identify the current holder, explain proposed action, and set a deadline for responding.
How to check your loan status
- Check your federal loan information through StudentAid.gov and identify whether each loan is Direct, FFEL, Perkins, or private. Do not assume all loans in a single education account share the same status or recovery options.
- Read the latest notice from the loan holder or servicer. It should identify the loan, its status, and any response deadlines or instructions.
- Contact the listed official loan holder or servicer to confirm the status, balance, payment history, and available routes out of default. If the notice directs you to a different official holder or agency, verify that information through StudentAid.gov or another official notice before sending money or personal information.
When you call, have the notice and account details available. Ask whether the loan is delinquent, in default, or in collections; who is authorized to handle it now; what the current balance includes; and what choices are available for that loan type. Ask for the payment amount, eligibility conditions, required documents, and the effect on collections while you complete any process. Keep copies of notices, agreements, and payment confirmations so you can refer back to the terms you were given.

What can happen after a federal loan defaults
Federal Student Aid identifies several possible consequences. They do not necessarily happen in a fixed order or to every borrower. In particular, reaching day 270 does not mean that wages are garnished immediately; involuntary collection involves a later process and notice rights.
- Credit history: A reported default can harm your credit. The default notation and earlier late-payment history are separate: completing rehabilitation can remove the default record, but delinquency reported before default may remain.
- Federal aid and loan benefits: While in default, you may lose eligibility for additional federal student aid and certain federal loan benefits.
- A larger amount owed: Collection costs may be added to the balance, and some recovery routes can increase the amount owed through interest capitalization or collection costs.
- Involuntary collection: Federal Student Aid says administrative wage garnishment may reach up to 15% of pay. Treasury offset may withhold a tax refund or certain federal payments. These are possible collection tools, not an automatic result of the 270-day threshold.
Federal Student Aid’s default and collections guidance describes rights to request debt documents and, in specified situations, request a hearing. Pay close attention to the instructions and dates in the notice you receive. Its FAQ describes a 30-day deadline for a hearing request to avoid wage garnishment and a 65-day deadline associated with disputing a Treasury offset. The notice and circumstances matter, so follow the directions on your own notice and seek qualified help if you dispute the debt or cannot understand the process.
If a notice says you may request a hearing or dispute a debt, do not set it aside while deciding whether to pursue a longer-term repayment option. A hearing or dispute request concerns the collection action or debt described in the notice; rehabilitation or consolidation is a separate route for resolving eligible federal default. Use the notice’s contact information and deadlines, and ask the official holder to explain how to request the documents or hearing that applies to your situation.
How to get out of federal student loan default
For eligible defaulted federal loans, the principal recovery routes described by Federal Student Aid are rehabilitation and consolidation. They solve different problems: rehabilitation takes a sequence of qualifying payments and can remove the default notation; consolidation can resolve default more quickly in some cases but may leave that notation on your credit history and increase the balance. Ask the loan holder what applies to your loan before choosing.

Do not select a route based only on which sounds fastest. Compare the time required, the payment you can realistically make, what will happen to the default entry on your credit history, and any interest or collection costs that could increase what you owe. The holder can confirm whether your particular loan is eligible and explain the documents needed to start.
Federal rehabilitation
For Direct Loan and FFEL borrowers, rehabilitation generally requires signing an agreement and making nine on-time, voluntary payments within a 10-consecutive-month period. Perkins loans have a different rule: nine consecutive payments. Do not assume one program’s schedule applies to another loan type.
The standard rehabilitation payment is calculated as 15% of annual discretionary income divided by 12. The loan holder should calculate and confirm your actual payment and tell you what income information or other documentation it needs. If the resulting amount is unaffordable, ask the holder about the calculation and required documentation rather than simply missing a payment.
Before signing, make sure you understand what counts as a qualifying payment, when each payment is due, and what to do if your income or circumstances change. The nine-payment requirement is tied to a time window for Direct and FFEL loans, so a missed or late payment can affect the path to completion. Keep your agreement and proof of each payment, and contact the holder promptly if you believe a payment was not credited correctly.

Successful rehabilitation removes the loan’s default status, stops collections, and restores eligibility for federal student aid. Federal Student Aid says the Department of Education requests removal of the default record after the ninth qualifying payment. This does not erase late-payment history reported before the default.
Involuntary collection may continue while rehabilitation is underway until the loan is out of default or until at least five rehabilitation payments have been made, according to Federal Student Aid’s rehabilitation guidance. Confirm how collections will be treated in your case and keep records of the agreement and payments.
Federal consolidation
Consolidation is another way to resolve eligible defaulted federal loans. It may be faster than completing a rehabilitation payment sequence, but speed is not the only consideration. Interest capitalization and collection costs can increase the amount owed, and a default record may remain on your credit history for up to 10 years after consolidation, according to Federal Student Aid. Confirm eligibility, the terms, and the expected balance with Federal Student Aid or the loan holder.

Ask what the new balance is expected to be and how interest capitalization or collection costs affect it. Also confirm the repayment terms and the steps needed to complete consolidation for your account. The fact that consolidation is an available federal route does not mean every defaulted loan or borrower qualifies under the same terms.

| Question | Rehabilitation | Consolidation |
|---|---|---|
| How does it work? | Sign an agreement and make nine qualifying payments. Direct and FFEL loans generally require nine on-time, voluntary payments within 10 consecutive months; Perkins loans require nine consecutive payments. | Resolve eligible defaulted federal loans through a new consolidation loan. Check your loan’s eligibility and terms with Federal Student Aid or the holder. |
| How soon can default be resolved? | After completing the required payment sequence. | May be faster than completing rehabilitation; timing depends on eligibility and processing. |
| What payment is required? | The standard calculation is 15% of annual discretionary income divided by 12. The holder calculates and confirms the amount and documentation. | Terms and payment depend on eligibility and the consolidation terms confirmed for your account. |
| What happens to the credit record? | After the ninth qualifying payment, ED requests removal of the default record. Earlier reported delinquency may remain. | The default record may remain for up to 10 years after consolidation. |
| What could happen to the balance or collections? | Involuntary collections may continue until the loan is out of default or at least five rehabilitation payments have been made. Ask the holder how this applies to your case. | Interest capitalization and collection costs may increase the balance. Confirm the amount and collection treatment before proceeding. |
The most useful comparison is account-specific: ask about time until default is resolved, the required payment, the credit-report result, any added balance or costs, and what happens to collections during the process. Get the terms and documentation requirements from the official holder rather than relying on a general estimate.
For many borrowers, the credit-report distinction is an important part of that comparison. Rehabilitation can lead to removal of the default record after the ninth qualifying payment, although earlier reported delinquency may remain. Consolidation may resolve default sooner, but Federal Student Aid says the default record may remain for up to 10 years after consolidation. Neither route should be described as erasing every negative mark from a credit history.
What happens if a private student loan defaults
There is no single federal 270-day threshold or federal recovery program that governs all private student loans. The promissory note and applicable law determine when default occurs and what the lender may do. The Consumer Financial Protection Bureau (CFPB) says some contracts may treat missed payments as default and some may specify other events that can trigger it.
Depending on the contract and applicable law, a private lender may report the default, collect directly, use a collection agency, or sue within the applicable state statute of limitations. That legal deadline varies by state; do not rely on a nationwide deadline or assume that a lender will offer a particular payment arrangement.
Private and federal consequences should not be mixed together. The federal 15% wage-garnishment figure, federal rehabilitation payment schedule, and federal consolidation pathway described above do not automatically describe what a private lender can do or what a private borrower can arrange. For a private loan, start with the note, the lender’s notices, and the state law that applies. If the lender says a legal deadline applies, seek qualified advice about that specific notice and jurisdiction.
Steps for a private-loan borrower
- Review the promissory note and recent account notices to identify the contract’s default terms, the current balance, and any response deadline.
- Contact the lender or servicer promptly. Ask whether it will consider a repayment arrangement or settlement, what terms it would require, and whether any agreement will be provided in writing. These options are not guaranteed.
- If there is a cosigner, tell them what is happening. The CFPB notes that missed payments and default can affect both borrowers’ credit records, and the cosigner may be pursued for payment.
- If you receive a lawsuit or other legal notice, do not ignore it. Deadlines and legal rules depend on the state and circumstances; consider qualified legal help rather than applying federal-loan procedures to a private loan.
A cosigner should not be treated as a backup contact who can be notified only after the lender acts. If the contract makes the cosigner responsible, the lender may pursue them for payment, and the missed payments or default may affect their credit as well as the borrower’s. Discuss the notice and proposed next steps with them, while confirming account details directly with the lender.

Where to get official help—and how to spot fee-based promises
For ED-held federal loans in default, Federal Student Aid identifies the Default Resolution Group as the official servicer and MyEdDebt.ed.gov as its account portal. Confirm contact information through StudentAid.gov or official notices so you know you are dealing with the right holder.
Federal Student Aid says the Department of Education’s Default Resolution Group does not charge a fee for its services. It warns borrowers to be wary of outside companies demanding enrollment, subscription, or maintenance fees to help them exit default. A company’s promise does not replace confirming eligibility and terms with the official loan holder.
Be cautious if a company presents a paid enrollment as necessary to access a federal default-resolution option, pressures you to act before you can read the terms, or asks you to pay recurring fees for help that the Default Resolution Group provides without charge. Verify who holds the loan and what the official process requires before giving a company money or sensitive account information. The route out of federal default is an administrative process with the official holder, not a product purchase.
The CFPB identifies free, qualified credit-counseling organizations as a possible source of help. Ask any organization whether it is qualified to advise on student-loan default and whether its service is free before sharing financial information. A counselor is not automatically endorsed by the government, and paid debt-relief companies are not a required step in federal recovery.
If you are approaching default, act before it happens
For a covered federal Direct or FFEL loan, contacting the servicer before 270 days of missed scheduled payments gives you a chance to discuss the account before it generally enters default. Explain what you can afford, ask what options apply to your loan, and keep copies of communications and notices. If your loan is private, use the lender’s contract and applicable law as the guide; the federal 270-day threshold does not establish your private loan’s status.
If you are already in default, first establish whether the loan is federal or private and who handles it now. For federal loans, ask the official holder to explain rehabilitation and consolidation side by side, including payment, timing, credit reporting, and collection treatment. For private loans, review the contract, communicate promptly with the lender, and respond to legal notices by their stated deadlines. In either case, keep records and avoid making decisions based on a general rule that may not apply to your account.

Frequently Asked Questions
How do I know if my student loans are in default?
Check federal loan records through StudentAid.gov and review the latest notice from your loan holder or servicer. Ask the official holder to confirm the loan type, status, balance, and who currently handles it. For covered federal Direct and FFEL loans, default generally begins after at least 270 days without scheduled payments; private-loan timing depends on the contract and applicable law.

What is the difference between default and collections?
Default is a status resulting from not meeting repayment terms. Collections are steps that may follow to recover the debt. A federal loan may be transferred to the Department of Education’s Default Resolution Group, while some FFEL loans may be handled by a guaranty agency. Reaching the federal 270-day threshold does not itself mean wage garnishment or tax-refund offset begins immediately.
Can the government take my wages or tax refund if I default on a federal student loan?
Federal Student Aid says administrative wage garnishment may reach up to 15% of pay, and Treasury offset may withhold a tax refund or certain federal payments. These are possible collection actions, not a guaranteed immediate consequence for every borrower. Notices describe rights and deadlines; follow the instructions on your own notice. Federal Student Aid’s FAQ describes a 30-day deadline for a hearing request to avoid wage garnishment and a 65-day deadline associated with disputing Treasury offset.
Does rehabilitation remove a student loan default from my credit report?
For eligible federal Direct and FFEL loans, successful rehabilitation requires nine on-time, voluntary payments within a 10-consecutive-month period. Federal Student Aid says the Department of Education requests removal of the default record after the ninth qualifying payment. Earlier delinquency history reported before default may remain. Perkins loans have a different requirement of nine consecutive payments.
Is consolidation faster than rehabilitation?
Consolidation may resolve eligible federal default more quickly than completing the rehabilitation payment sequence, but timing depends on eligibility and processing. It may increase the balance through interest capitalization or collection costs, and the default record may remain on the credit history for up to 10 years. Compare the payment, timing, credit outcome, and costs with the official holder before choosing.
Can a private student loan be rehabilitated or consolidated under federal rules?
Federal rehabilitation and consolidation rules do not automatically apply to private loans. The private loan contract and applicable law govern when default occurs and what options the lender may offer. Review the promissory note and contact the lender or servicer; repayment arrangements or settlements are not guaranteed.
Can a cosigner be held responsible for a private student loan?
A cosigner may be pursued for payment if the contract makes them liable. The CFPB notes that missed payments and default can affect both the borrower’s and cosigner’s credit records. Review the loan contract and notify the cosigner about account notices and proposed steps.
Should I pay a company to get me out of federal student loan default?
The Department of Education’s Default Resolution Group does not charge for its services. Federal Student Aid warns borrowers about outside companies that demand enrollment, subscription, or maintenance fees to help exit default. Confirm the official options and contact details through StudentAid.gov or official notices before paying a company or sharing account information.
