With rights of survivorship, the balance generally passes to the surviving owner or owners. If the owners held it as tenants in common, the deceased owner’s share generally passes to their heirs under a will or state succession law. Check the account agreement and ask the institution what ownership form it has recorded.
Who gets the money depends on the account’s ownership form
The Consumer Financial Protection Bureau (CFPB) explains that the outcome depends on how the owners chose to hold the account. The account title and agreement—not simply the fact that two people could use the account—are the starting point. The institution’s records and applicable state law also matter.

These are general descriptions, not a guarantee about every account or state. For example, Oregon law provides a rebuttable presumption about amounts remaining in a joint account as between surviving parties and a decedent’s estate; that is an Oregon rule, not a nationwide standard. Alaska court guidance likewise describes consequences under Alaska law and specific account forms.
Does a will decide who receives a joint account?
Not necessarily. Under a survivorship arrangement, the CFPB describes the funds as passing to the surviving owner or owners. By contrast, with a tenants-in-common arrangement, the deceased owner’s share passes to heirs under the will or state succession law. The account’s actual designation and the state’s rules determine how those principles apply; a will alone does not establish that a survivorship designation is overridden.

What should a surviving owner do?
- Find the account paperwork. Review the deposit agreement, signature card, or online account documents for survivorship language, a tenants-in-common designation, or a beneficiary designation.
- Ask the bank or credit union what it has on file. Confirm the recorded ownership form and ask for its current process and documentation requirements. Requirements can vary by institution, so do not assume a death certificate alone or any particular form will be sufficient.
- Keep copies of the records and the institution’s instructions. If the paperwork is unclear or conflicts with the estate plan, get advice from a probate or estate lawyer in the state involved before treating the balance as settled.
- Review deposit-insurance coverage separately. If balances or other accounts at the same bank are involved, ask how the ownership change affects coverage and review the FDIC’s rules.
Deposit insurance is not inheritance
FDIC deposit insurance addresses how much of a deposit is insured at an insured bank; it does not decide who owns the money after a death. The FDIC’s guidance describes a six-month period after an owner dies during which the deceased owner’s accounts continue to receive the treatment they would have received if that owner were alive, assuming the account titling is unchanged. Treat that as an insurance grace period, not a deadline or rule for transferring ownership.
The FDIC also describes a standard $250,000 coverage limit per co-owner for qualifying joint-account deposits. Coverage depends on meeting the joint-account category requirements and is aggregated across joint accounts at the same insured bank. It is not the amount a survivor inherits, and the insurance limit should not be confused with the account balance or the decedent’s estate share.

A power of attorney does not make someone a joint owner
An agent acting under a power of attorney (POA) is not thereby a co-owner of the account. The Office of the Comptroller of the Currency says POA authority generally expires when the account holder dies, subject to the POA’s terms and state law. Do not rely on a POA as authority to keep making transactions after the principal’s death; ask the institution what authority and documents it requires.

Consider consulting a probate or estate lawyer in the relevant state if the account says tenants in common, family members dispute ownership, the account records conflict with a will or other estate documents, or the title is unclear.
