If the custodian fails, segregation and contractual protections may support a claim that the bitcoin belongs to customers, but they do not guarantee prompt access or recovery. Neither FDIC nor SIPC protection applies to bitcoin held by a crypto custodian.
What can happen if a custodian is hacked?
A security breach can compromise private keys, interrupt withdrawals or trading, or result in bitcoin being stolen. Coinbase’s annual report says a loss of private keys or a wallet compromise could affect customers’ ability to access or sell assets; it says reimbursement could depend on the circumstances. A hack therefore does not automatically mean either that every customer loses bitcoin or that every customer is made whole.
After an incident, the practical outcome can depend on what assets were affected, how the custodian’s systems and records identify customer holdings, and what the customer agreement says about responsibility and remedies. Access may be disrupted even if the customer’s recorded claim is not immediately in dispute.
What can happen if the custodian goes bankrupt?
Bankruptcy raises a different question from a hack: whether the bitcoin is treated as customer property or becomes part of the custodian’s estate, and how customers can assert their rights. The answer depends on the account’s contract, legal structure, records, and applicable jurisdiction. The cited company and fund disclosures describe particular arrangements; they do not establish the outcome for every custodian or bankruptcy.

Segregation can help, but is not a guarantee
A Bitwise fund filing describes an agreement requiring client assets to be held in segregated wallets, separate from the custodian’s own assets and those of other clients, with no lien or security interest created over them. The agreement elects a UCC Article 8 framework intended to create a security entitlement and keep assets outside the custodian’s insolvency estate. Those are terms of that particular arrangement, not a standard feature readers can assume for every account.
A separate company filing warns that bitcoin may be delayed or unrecoverable if a custodian breaches its agreement, stops operating, becomes insolvent, or files for bankruptcy, even when assets are segregated. Segregation is a meaningful contractual and operational protection, but it does not by itself settle ownership disputes, ensure that records are complete, or set a recovery date.

Article 8 treatment remains unsettled for custodied crypto
Coinbase’s SEC filing says certain custody agreements address UCC Article 8. Coinbase states that it believes customer assets would not be part of its general bankruptcy estate, while also acknowledging that courts have not yet considered this treatment for custodied crypto assets. That is the company’s stated position, not a court-established rule for all bitcoin custody arrangements.
Does insurance cover a hack or theft?
Some custodians or funds may have commercial crime insurance intended to cover specified losses, but the existence of a policy does not mean each customer’s bitcoin is fully insured. A fund filing describes a policy intended to cover certain losses involving employee collusion or fraud, physical theft, damage to key material, security breaches or hacks, and fraudulent transfers. It also says the policy is shared among Coinbase customers, is not specific to the reporting trust, and may be unavailable or insufficient for all possible losses.

Coverage depends on the policy’s terms, exclusions, limits, and the facts of the incident. Do not assume that a disclosure about one fund’s or custodian’s policy applies to another provider, covers every kind of loss, or entitles an individual customer to a particular payment.
Is bitcoin held by a custodian covered by FDIC or SIPC?
No. The cited trust disclosure says the trust and its custodian are not FDIC or SIPC members and that the trust’s bitcoin is not covered by those programs. Bitcoin held in a crypto custody account is not the same as cash deposited at a bank or securities held in a qualifying brokerage account.

If an arrangement also involves cash held at a bank, assess that cash arrangement separately. Any pass-through deposit coverage has conditions and does not turn the bitcoin itself into an insured bank deposit.

Read the agreement for the exact legal entity holding or safeguarding assets, and consider the jurisdiction whose law and insolvency process may apply. The label “custody” or “segregated” alone does not answer who owns the assets, what the custodian may do with them, or what happens in a failure.

- Ownership and segregation: Look for language identifying customer or beneficial ownership and explaining how assets are separated and recorded.
- Lien, lending, and rehypothecation rights: Check whether the custodian can pledge, lend, or otherwise use customer assets.
- Insolvency framework: Identify any Article 8 or equivalent treatment, the procedure for asserting a claim, and how disputes are handled.
- Liability and insurance: Review liability caps and exclusions, and ask what the stated insurance covers, what it excludes, how limits apply, and whether coverage is shared.
- Records and access: Understand how holdings are recorded or reconciled, how withdrawals work, and what happens to account access if operations are interrupted.
- Termination: Check your withdrawal and termination rights, including any process for moving assets to another provider.
These dimensions vary across agreements, so a simple “insured” or “not insured” label is not a reliable substitute for reading the terms.
What should you do if there is a live incident?
- Use the custodian’s official incident and support channels. Confirm the account status and follow its published instructions for securing access or submitting a claim. Avoid sharing passwords, recovery phrases, or private keys with anyone claiming to help.
- Preserve your records. Save account statements, transaction history, custody agreements, withdrawal requests, and relevant communications. These materials can help establish what the account showed and what steps you took.
- Check the legal entity and jurisdiction in your agreement. A brand name may not identify the contracting entity responsible for the account, and the applicable process can depend on that entity and the circumstances.
- Get advice suited to the case. If assets are missing, withdrawals are blocked, or insolvency proceedings have begun, consult a qualified professional familiar with the relevant jurisdiction. The available remedies and deadlines cannot be inferred from a general description of custody.
Can a hardware wallet protect you from a custodian’s failure?
A hardware wallet can be part of a future move to self-custody, but it cannot retrieve bitcoin that is already inaccessible at a custodian. A company filing describes cold storage as a possible contingency if a custodian stops operating or becomes insolvent while a replacement is arranged. Self-custody means you must control and protect the private keys and recovery material; losing them can also make the bitcoin inaccessible.
