Choose a Bitcoin custodian by checking who controls the private keys, how customer assets are protected and treated, what happens if the provider fails, what every fee costs, and whether you can withdraw bitcoin to an external wallet. Compare the same written terms for each provider; a low trading fee or a security claim alone does not tell you whether custody is suitable.
First decide whether you want third-party custody or self-custody
A wallet does not hold bitcoin itself; it manages the private keys that control access to bitcoin recorded on the network. With a third-party custodian, such as an exchange or dedicated custody provider, the provider controls access to those keys. With self-custody, you control the keys and take responsibility for protecting and recovering them. The SEC’s retail custody bulletin, published December 12, 2025, describes these trade-offs for retail crypto assets generally; it is not a ranking of Bitcoin providers.

A hardware wallet is an optional tool for self-custody, not a custodian and not a way to improve a third-party provider’s custody. For example, Ledger’s Bitcoin wallet documentation describes a device-based self-custody option. Manufacturer descriptions are not independent comparisons of products.
What self-custody adds to your responsibilities
A recovery or seed phrase can restore a wallet after loss or damage, so it must be stored securely and never shared. The SEC warns that losing a private key can permanently remove access. When making a transaction, check the destination address and amount before approving it. A device by itself is not a substitute for a secure, usable backup.

Check how the custodian safeguards access to keys
Do not rely on broad claims such as “institutional-grade” or “secure storage” without asking what they mean in practice. Ask each provider who can authorize access to keys, where keys are held, whether the provider uses hot wallets, cold wallets, or a mix, and which outside providers or subcontractors are involved. Ask about physical safeguards, cybersecurity controls, access permissions, and how the provider handles incidents.
- Who can access or authorize transactions involving customer bitcoin, and how is that access controlled?
- What share or type of assets may be kept in hot storage versus cold storage, and how does that affect withdrawals?
- What physical and cyber controls protect the keys and the systems used to manage them?
- Are other companies involved in custody, and what role do they play?
Compare specific, written explanations rather than treating a provider’s security language as proof of a particular level of protection. The SEC’s custody guidance outlines questions retail investors can ask about key access and safeguards.

Understand asset treatment and what failure could mean
Ask whether customer bitcoin is segregated, lent, or reused
Find out whether the provider keeps customer assets separate or commingles them, and whether it can lend customer assets, rehypothecate them, or use them as collateral. If any such use is allowed, check whether your explicit consent is required and what the agreement says about your rights. Read the terms that apply to your account rather than assuming that an exchange balance is held on the same basis as assets with a dedicated custody service.
Read the failure and insurance terms
Ask what happens to access to your bitcoin if the provider becomes insolvent, suspends service, or suffers a security incident. Check the legal and operational arrangements described in the account agreement, including what happens to customer assets and how claims are handled. If the provider mentions insurance, identify what events and assets are covered, exclusions, coverage limits, and who may receive payment. A general insurance claim does not by itself guarantee reimbursement to each customer.

Treat proof-of-reserves as limited evidence
A proof-of-reserves report is not a complete picture of a custodian’s financial position. The SEC’s proof-of-reserves bulletin cautions that such a report does not include a complete set of financial statements or disclose the entity’s complete liabilities. It is therefore not, by itself, proof that a provider can meet every customer claim. Consider what a report does and does not establish, rather than treating the label as a guarantee.
Verify that you can withdraw bitcoin to your own wallet
If you may want to move bitcoin off the platform, confirm that external-address withdrawals are supported for your account, jurisdiction, and asset. Check the current written terms before depositing: withdrawal features, limits, holds, and review procedures can vary by provider and account type. A displayed balance is not enough to establish how quickly or on what terms you can withdraw.

- Can you withdraw bitcoin to an address you control, or are withdrawals restricted to specified destinations?
- What minimum withdrawal, daily or other limits, and identity or security checks apply?
- Can the provider place a hold or delay a withdrawal, and in what circumstances?
- What processing windows apply, and how are provider charges distinguished from Bitcoin network fees?
- What steps are available if a withdrawal is pending, rejected, or sent to an incorrect address?
There is no provider-by-provider comparison of current withdrawal limits or processing times established here. Verify these details in the latest terms for the specific service and the location and account type you would use.

Custody costs can appear in several places. Compare the applicable charges across providers and account types, and check whether a quoted fee is recurring, transaction-based, or conditional. The SEC identifies several fee categories to examine, but does not set a typical market price for them.

- Annual custody or other asset-based fees.
- Trading or transaction fees, if you plan to buy or sell through the provider.
- Bitcoin withdrawal or external transfer charges, plus any separate network fee.
- Account opening, transfer, or closure fees.
Use current provider fee schedules and terms for your jurisdiction. Do not assume a low trading fee means the overall cost of holding and moving bitcoin is low.
Check account access, recovery, privacy, and applicable oversight
Custody involves access to an account as well as protection of keys. Review how login recovery works, what happens if you lose access to your email or authentication device, and how customer support handles account-security problems. Use stronger authentication where available; Fidelity’s custodian guidance points to authenticator apps as an option to consider.
Read the privacy terms to understand what information the provider collects, how it uses that information, and when it may share it. Check the provider’s background and the rules that apply to the specific legal entity and service in your location. Regulatory status is not a universal label: identify the relevant entity, activity, regulator, and jurisdiction before drawing conclusions.
The SEC’s December 12, 2025 retail custody bulletin reflects staff views and is not a rule or regulation and creates no new obligations. Use it as investor guidance, not as a substitute for checking the laws and provider terms relevant to your location.

- Key control: Identify who controls access to keys, the storage approach, safeguards, and any outside custody providers.
- Asset treatment: Establish whether customer bitcoin is segregated or commingled and whether lending, rehypothecation, or collateral use is permitted.
- Failure and coverage: Read the insolvency and service-interruption terms; verify what any insurance covers, excludes, and caps.
- Withdrawal path: Confirm external withdrawals and the current minimums, limits, holds, fees, review steps, and processing windows that apply to your account.
- Total cost: Add up custody, transaction, transfer, and account charges rather than comparing one advertised fee.
- Account and privacy: Review authentication, recovery, support, data practices, and oversight relevant to the provider’s entity and your jurisdiction.
Record answers from current written terms, not only marketing pages or verbal assurances. If a provider will not clearly explain key access, asset treatment, withdrawal rules, or fee conditions, that uncertainty is itself relevant to your choice.
