Elon Musk and America PAC offered money in 2024 to eligible voters who signed a political petition and to people who referred signers. Later lawsuits alleged that some promised payments were not made in full. A federal judge’s January 7, 2026 ruling let one amended complaint proceed past dismissal and allowed another to proceed in part; it did not decide whether the plaintiffs’ payment claims were true. The court records available here do not establish that Musk admitted the campaign was a mistake or realized it had gone badly.

What was the “paying voters” campaign?

In October 2024, Musk and America PAC promoted a petition asking people to pledge support for the First and Second Amendments. The campaign targeted eligible registered voters in Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania, and Wisconsin. The federal court opinions describe an offer of $47 to eligible voters who signed, later raised to $100 for Pennsylvania voters, with additional payments offered for referrals. The opinions also record a goal of one million signatures; that is a stated program target, not an independently audited count of signatures.

In this context, “paying voters” refers to offers tied to signing or referring people to sign a petition. The records cited here do not describe an offer to pay people to cast a particular ballot.

What did the lawsuits allege?

Several participants sued Musk and America PAC, alleging they were not paid all the amounts promised for signatures or referrals. Those statements are plaintiffs’ allegations, not findings that the defendants owe the sums claimed.

The January 7, 2026 opinion in Maglietta et al. v. America PAC et al. addressed amended complaints and motions to dismiss. Chief Judge Wendy Beetlestone wrote: “For the reasons that follow, Defendants’ Motion to Strike shall be denied, their Motion to Dismiss the Doe Amended Complaint shall be granted in part and denied in part, and their Motion to Dismiss the Maglietta Amended Complaint shall be denied.” In practical terms, the Maglietta amended complaint survived dismissal; the Doe complaint survived only in part. The court dismissed Group America without prejudice from the Doe complaint and dismissed Doe’s Pennsylvania wage-law claim. These were pleading-stage decisions, not a trial or final ruling establishing that the alleged unpaid amounts were owed. Read the January 7, 2026 opinion.

Were the $1 million drawings the same thing?

No. The petition-signing and referral offers should be distinguished from separate drawings advertised as giving away $1 million. In October 2024, Philadelphia District Attorney Larry Krasner filed a Pennsylvania case challenging those drawings as an allegedly unlawful lottery. That filing states the prosecutor’s allegation; it is distinct from the later participants’ claims about promised petition and referral payments. Read the Pennsylvania filing.

Did Musk say he realized he made a mistake?

The court records cited here do not establish that Musk acknowledged a mistake, said the campaign had gone badly, or explained a change in his view. The headline’s suggestion that he “appears to have realized” is an interpretation, not a conclusion supported by these rulings. The established legal development is narrower: participants brought payment claims, and a judge ruled on whether their amended complaints could proceed, without resolving the underlying allegations.

  • The campaign offered money for signing a political petition and for referrals; it was not, on the court record described here, a documented payment for casting a particular vote.
  • The signing amounts described in the federal opinions were $47, later $100 for Pennsylvania signers. These are reported program terms, not proof that every participant qualified or was paid.
  • The lawsuits allege incomplete payment, but the January 2026 ruling did not determine that the defendants owe the amounts claimed.
  • The separate Pennsylvania challenge to the $1 million drawings was an allegation by the district attorney, not a ruling in the payment-contract cases.
