Eli Lilly Sues 4 GLP-1 Telehealth Startups Over Compounded Tirzepatide Marketing

Eli Lilly’s lawsuits allege that four telehealth brands misrepresented compounded tirzepatide products. Here’s how the allegations differ from court findings and later FDA action.

Eli Lilly sued Mochi Health, Fella & Delilah Health, Willow Health and Henry Meds over how they marketed compounded tirzepatide, according to WIRED’s April 23, 2025 report. Lilly alleged that the companies’ products or claims blurred the line between patient-specific compounding and offerings prepared or promoted at scale. Those allegations are not proof of wrongdoing. Later developments include an FDA announcement of 30 warning letters to telehealth companies over compounded GLP-1 marketing and a court ruling that allowed some of Lilly’s claims against Mochi to proceed past dismissal.

What did Eli Lilly allege?

Lilly’s lawsuits challenged marketing and compounding practices involving tirzepatide, the active ingredient in its FDA-approved medicines Mounjaro and Zepbound. WIRED’s 2025 account described these claims against the four named telehealth brands:

  • Mochi Health: Lilly alleged that doses and formulations were changed for patients in batches, including formulas with niacinamide or pyridoxine.
  • Fella & Delilah Health: Lilly alleged that patients were switched to a product containing added amino acids.
  • Henry Meds: Lilly alleged that the company’s marketing implied that clinical-trial evidence for Lilly’s medicines applied to its compounded products.
  • Willow Health: Lilly alleged that certain products were marketed as custom-prepared even though they were mass-produced.

These are summaries of Lilly’s allegations as reported by WIRED, not findings that the companies did what Lilly claimed. A lawsuit is a party’s account of a dispute; the claims must be evaluated through the legal process.

How are compounded tirzepatide and Mounjaro or Zepbound different?

Compounded medicines are not FDA-approved copies of Mounjaro or Zepbound. The distinction matters: sharing an active ingredient does not establish that a compounded preparation is clinically equivalent, has the same evidence behind it, or is being compounded lawfully. WIRED described the growth in compounded GLP-1 use during the shortage period and the dispute over when a medicine is genuinely customized for an individual patient rather than prepared or offered at scale. The table summarizes the distinction at issue, not a complete account of federal or state compounding law.

Question Mounjaro and Zepbound Compounded tirzepatide
Regulatory status FDA-approved tirzepatide medicines, as described by WIRED (April 23, 2025). Not FDA-approved copies of those medicines, as described by WIRED (April 23, 2025).
Preparation at issue The lawsuits do not allege that Lilly’s branded medicines were patient-specific compounded preparations. The legal dispute includes whether products were individualized for a patient or prepared or promoted at scale, according to WIRED’s report of Lilly’s allegations.
Evidence and claims The 2025 WIRED report identifies Mounjaro and Zepbound as Lilly’s approved medicines; it does not set out a full clinical-evidence comparison here. The lawsuits challenge, among other things, alleged marketing claims and formulations. The report does not establish clinical equivalence between compounded products and the approved medicines.

WIRED reported that the shortage contributed to broader use of compounded GLP-1 medicines. A trade group representing compounders estimated that at least 2 million people in the United States were taking compounded GLP-1 medicines as of November 2024; that is a trade-group estimate reported by WIRED in 2025, not an FDA count.

What happened after the 2025 lawsuits?

FDA announced 30 warning letters in March 2026

On March 3, 2026, the FDA said it had issued 30 warning letters to telehealth companies over false or misleading claims on their websites about compounded GLP-1 products. The agency-wide action addressed marketing across the category; it does not establish that any particular company named in the 2025 Lilly report received a letter. FDA Commissioner Marty Makary said: “Compounded drugs can be important for overcoming shortages or meeting unique patient needs—but compounders should not try to compound drugs in a way that circumvents FDA’s approval process.”

A judge allowed some Mochi claims to continue

On April 20, 2026, the U.S. District Court for the Northern District of California ruled on the Mochi defendants’ motion to dismiss Lilly’s amended complaint. The court found that Lilly had plausibly alleged standing and claims under California’s Unfair Competition Law and the federal Lanham Act, but had not plausibly alleged civil conspiracy. This is a pleading-stage ruling, not a final determination that the challenged marketing occurred or that Lilly proved its claims.

What should consumers make of the dispute?

Cost is part of why shoppers may notice compounded offerings: WIRED reported that some telehealth companies offered tirzepatide vials for under $100 during the period covered by its April 2025 story. That is a historical price reported in that article, not a current price or a general market rate. Price alone does not establish a product’s regulatory status, quality, safety or equivalence to an FDA-approved medicine.

Separately, Lilly’s June 20, 2024 statement warned about products advertised as tirzepatide that it said had sterility, impurity, color or chemical-identity problems, and said counterfeit products could contain incorrect or no medicine. Those are Lilly’s claims and warnings, not independent testing results for every compounded product. The statement also described FDA-approved tirzepatide as an under-the-skin injection and said no regulator had evaluated oral versions at that time; because that was a dated company statement, it should not be treated as a current, comprehensive regulatory update.

This is a litigation and marketing dispute, not individualized medical advice. Anyone weighing a treatment change should discuss it with a licensed prescriber rather than stopping a prescribed medicine or substituting an unverified product based on an online offer.
