For U.S. federal income tax purposes, selling, swapping, or spending cryptocurrency held as a capital asset may realize a capital gain or loss. Receiving crypto is different: it may create an income question, while a later sale or exchange can create a separate capital gain or loss. The answer depends on the asset’s tax classification, its basis, and the transaction details—not simply on whether crypto moved between wallets.
Which crypto transactions may realize a capital gain or loss?
The IRS treats digital assets as property for federal tax purposes, so general property-transaction rules apply. A disposition of crypto held as a capital asset can produce a gain or loss when the amount realized is compared with the asset’s adjusted basis. A gain is not guaranteed, and a loss is possible. The result can differ if the crypto is inventory or other property that is not a capital asset.

| Transaction | Potential capital-asset treatment |
|---|---|
| Sell crypto for U.S. dollars | The sale may realize a gain or loss by comparing the amount realized with adjusted basis. |
| Exchange one digital asset for another | The asset given up may be disposed of, potentially realizing a gain or loss. A token swap is not automatically tax-free. |
| Buy goods or services with crypto | Using a capital asset as payment may be a disposition; the value received and the asset’s basis are relevant. |
| Pay a transaction-service fee in crypto | The units used to pay for services connected to a purchase, sale, disposition, or transfer may themselves be disposed of and may realize a gain or loss. |
These are potential tax consequences, not a promise that tax is owed. The asset’s classification, basis, amount realized, and any applicable losses all affect the result. See the IRS digital-assets guidance and its digital-asset transaction FAQs.

It may be. The IRS says exchanging digital assets for other property—including digital assets that differ materially in kind or extent—can recognize a capital gain or loss when the asset given up is a capital asset. This applies to the outgoing asset: calculate its result using the applicable amount realized and basis. Do not assume a swap is tax-free because no dollars changed hands, or because the asset received is a stablecoin.

Is spending crypto a taxable event?
Potentially. Paying with crypto held as a capital asset can dispose of that asset, just as a sale or exchange can. The value of the goods or services received is relevant to the amount realized, and the crypto’s adjusted basis is needed to work out a gain or loss. This is separate from the merchant’s tax treatment of the payment.
Fees also deserve attention. The IRS’s current FAQ specifically addresses digital assets paid for transaction services connected to a purchase, sale, disposition, or transfer. The units used for such services may be a separate disposition. That guidance should not be stretched into a universal rule for every fee or protocol interaction.

Are staking rewards or other crypto receipts capital gains?
Not necessarily. Receiving crypto and disposing of it later are separate events. Crypto received for work or as a reward, through mining or staking, or in connection with a hard fork may raise an income question when received. If the recipient later sells, swaps, or spends those units, that later disposition may separately produce a capital gain or loss if the asset is held as a capital asset. The exact treatment depends on the facts and type of receipt; a reward receipt should not automatically be labeled a capital gain.
The IRS includes questions about digital-asset receipts and related activity in its digital-assets guidance. A wallet-to-wallet transfer by itself should not be casually treated as a sale; ownership and transaction mechanics matter. Bridges, wrapped assets, liquidity-pool deposits, protocol rewards, and unusual fee arrangements can require fact-specific analysis rather than a blanket answer.

How do you calculate a crypto capital gain or loss?
In broad terms, subtract the adjusted basis of the disposed asset from the amount realized. The amount realized and any transaction costs can depend on the transaction and exchange. The IRS identifies these records as useful for calculating the result:
- Type of digital asset
- Transaction date and time
- Number of units involved
- Fair market value in U.S. dollars at disposition
- Basis in the units disposed of
Keep acquisition and disposition records, exchange statements, and wallet records—not just a year-end balance. Do not assume all units of the same token have the same basis or acquisition date. The IRS explains the information needed in its digital-assets guidance and transaction FAQs.

How does the holding period affect the result?
For a capital asset, a gain or loss is generally short-term if the asset was held for one year or less, and long-term if held for more than one year. The IRS says the holding period starts the day after acquisition and ends on the day of sale or exchange. Apply the period to the specific units disposed of rather than assuming every unit in a wallet has the same acquisition date. See the IRS digital-asset FAQs.
How are digital-asset transactions reported?
For an individual disposing of a digital asset held as a capital asset, IRS instructions direct taxpayers to use Form 8949 to calculate the capital gain or loss and Schedule D to report it. Separately, the digital-asset question on an individual return is broader than whether a taxable capital gain occurred: the IRS says digital-asset transactions must be reported whether or not they result in a taxable gain or loss. Answer that question and calculate any gain or loss as distinct tasks. Consult the instructions for the specific tax-year return and the IRS digital-assets page.

Covered broker reporting on Form 1099-DA applies to transactions on or after January 1, 2025, according to the IRS. That is an information-reporting start date, not the date crypto transactions first became taxable. Taxpayers remain responsible for their returns and records.
Which IRS guidance applies before and after January 1, 2025?
The IRS’s current digital-asset transaction FAQ addresses transactions on or after January 1, 2025; some answers are marked as added December 15, 2025. The separate legacy virtual-currency FAQs generally apply to transactions completed before January 1, 2025. Check the guidance for the relevant tax year rather than blending the two FAQ sets without regard to their stated date boundary.
