What Are the Biggest Risks of Investing in Online Sports Betting Companies?

Sports betting companies face risks from fragmented regulation, market-access costs, customer acquisition, unpredictable game outcomes, and digital operations. The exposure varies by operator.

The central risk is that a sportsbook’s growth does not automatically translate into durable profit. Investors need to weigh legal access and market costs against customer economics, uneven results from sports outcomes, and the reliability of the company’s digital operations. The exposure differs by operator and jurisdiction.

Why legal access is a basic business risk

An online sportsbook can operate only where it has the required legal authorization and has met that jurisdiction’s licensing and implementation rules. Legalization is fragmented: a jurisdiction may permit some form of sports betting without allowing online wagering, and rules, interpretations, or product restrictions can change. Adoption may also occur in fewer jurisdictions or more slowly than an operator expects; state-run models can limit opportunities for private companies.

DraftKings reported that 39 U.S. states, the District of Columbia, and Puerto Rico had legalized some form of sports betting as of February 10, 2026. That count does not mean online betting was live or available in all those places. It is a dated status reported by one company, not a forecast of future expansion. See DraftKings’ 2025 Form 10-K.

How taxes and market-access costs can squeeze returns

Revenue from a market is not the same as profit from it. Jurisdictions can impose different product restrictions and taxes, and an operator may incur additional costs to obtain access. Headline tax rates are not necessarily comparable when the taxable bases differ, so investors should examine the relevant rules and company disclosures market by market.

In its 2025 Form 10-K, filed February 13, 2026, DraftKings described a U.S. federal excise tax of 25 basis points of the amount of each wager for online sports betting, in addition to state taxes. This is the issuer’s description; investors should confirm the tax treatment and applicability for the company and period they are evaluating. The filing also notes that state taxes vary. Read the filing.

Why partner dependence can interrupt a market’s revenue

Some laws require an online operator to work through a retail casino, tribe, racetrack, or another local partner. Such an arrangement can enable market access, but it also adds costs and makes continued operation dependent on the relationship. DraftKings says that losing a required partner relationship could prevent it from operating in that jurisdiction until it establishes a replacement. This is a company- and market-specific exposure, not a structure that applies identically to every sportsbook.

When comparing operators, check which markets depend on partners, how concentrated that dependence is, the renewal and termination terms, and whether a replacement arrangement is realistically available. The company’s SEC filing describes this risk for DraftKings.

Competition can make customer growth expensive

Sportsbooks compete with other betting operators and with other forms of entertainment. Winning and retaining customers may require ongoing investment in product, technology, marketing, and promotions. A larger customer base therefore does not, by itself, show that customer acquisition is profitable or that growth will remain profitable once incentives change.

Demand is also exposed to household budgets. If consumers cut discretionary spending, or if a product loses popularity, activity may weaken. DraftKings identifies competition, changes in consumer spending, and the risk that products may not retain popularity in its 2025 Form 10-K. The filing does not establish a sector-wide level for promotional spending or customer acquisition costs, so compare each operator’s own disclosures rather than assuming one company’s economics apply to all.

Why game results can make earnings volatile

Sports outcomes influence an operator’s win or hold rate—the share of wagering activity the business retains—and can move results even when underlying customer activity has not changed much. DraftKings states: “The success, including win or hold rates, of existing or future sports betting and iGaming product offerings depends on a variety of factors, including sport outcomes, and is not completely controlled by us.” The statement appears in its 2025 Form 10-K.

For investors, the implication is to distinguish short-term outcome effects from changes in customer activity and operating performance. A single favorable or unfavorable reporting period is not enough on its own to establish a durable trend; consider the company’s explanations and measures over longer periods.

Cybersecurity and outages can damage service and trust

An online betting business depends on functioning platforms and on network, software, hardware, payment, and other technology services. A cyber incident, system failure, or third-party disruption could interrupt service, expose data or property, generate legal and remediation costs, and undermine customer confidence. The risk includes both the operator’s own systems and services it relies on.

DraftKings said prior cyber risks and attacks had not materially affected it as of its 2025 Form 10-K, while warning that future incidents could have an impact. That historical disclosure is not an assurance that future incidents will be immaterial. Investors can review company disclosures for incident history and assess the resilience of cybersecurity, privacy, geolocation, payment, and compliance systems. DraftKings’ filing sets out the issuer’s discussion.

How to compare the risks across operators

Do not treat one operator’s risk disclosures as a complete picture of the sector. DraftKings’ filing is a useful issuer-disclosed example, but it does not establish that every listed sportsbook has the same exposure. For each company, compare:

  • Regulatory exposure: jurisdictions where it is licensed and live, approval dependencies, product restrictions, and concentration in a small number of markets.
  • Market access: reliance on casino, tribal, racetrack, or other partners; contract terms and renewal timing; and replacement options.
  • Tax burden: applicable tax rates and tax bases in each jurisdiction, plus any federal taxes, rather than headline rates alone.
  • Customer economics: acquisition and promotional spending, retention, cross-selling, and whether growth appears dependent on continued incentives.
  • Earnings variability: product mix and sensitivity to sports outcomes, customer activity, and win or hold rates.
  • Operational resilience: cybersecurity, privacy, geolocation and payment infrastructure, third-party dependencies, compliance systems, and incident history.
  • Financial resilience: liquidity, cash generation, financing needs, and the capacity to fund technology and customer acquisition. These require company-specific financial disclosures; a single issuer’s risk filing does not provide peer-comparable metrics.
