What U.S. crypto guidance does—and does not—settle
For U.S. readers, the SEC announced an interpretation on March 17, 2026, joined by the CFTC for related guidance, addressing a taxonomy of crypto assets and the application of federal securities laws to certain assets and transactions. The SEC’s interpretive release page gives March 23, 2026 as its effective date and Federal Register publication date. The materials address topics including airdrops, protocol mining, staking, and wrapping.
That interpretation does not mean every crypto asset has a settled or identical legal status. The SEC’s educational explanation describes the Howey elements as an investment of money, a common enterprise, a reasonable expectation of profits, and profits derived from the essential managerial efforts of others. A crypto asset may not itself be a security while a particular offer or sale involving it may still be subject to an investment contract, depending on the facts.

A practical decision for December
- Set the scope. Decide how much you could lose without harming essential expenses, and whether your intended holding period is measured in weeks, months, or years.
- Choose candidates for a reason. Start with a stated network function or use case—not a social-media prediction, a recent price jump, or the assumption that a large market presence makes an asset safe.
- Apply the checklist consistently. Record the source and date for each candidate’s usage, liquidity, supply, risk, custody, and legal information. Do not compare a current figure for one coin with an old or differently measured figure for another.
- Decide what would change your mind. Identify the facts that would make you avoid or exit the position, and consider in advance how you would respond to a sharp decline.
- Do not mistake a December date for a reason to buy. A calendar boundary does not establish a catalyst or make a particular coin suitable. If the evidence you need is unavailable, waiting or declining to buy is a valid decision.
