It is not, by itself, a final adjudication order. The company should check the tax period, legal provision, calculation, supporting material and the exact reply instructions in the notice.
What the notice does—and does not—decide
Under the Central Goods and Services Tax Act, a notice in a demand proceeding sets out an alleged short payment or non-payment of tax, an erroneous refund, or wrongly availed or used input tax credit, and asks the person concerned to show cause. Section 73(1), for example, requires the proper officer to state why the specified amount should not be paid along with applicable interest and penalty. Read the CGST Act published by CBIC.

For a company, this means the department has put forward a case that needs a considered response; it does not mean the proposed amount has already been finally determined. The officer may consider the company’s representation and the proceeding may continue to a later order. Do not treat the amount in the notice as a final demand merely because it is stated in an electronic form or summary.
First establish the period and section
The financial year and provision cited affect which demand framework applies. The Finance (No. 2) Act, 2024 amended sections 73 and 74 so they apply to tax pertaining to periods up to FY 2023-24, and inserted section 74A for periods from FY 2024-25 onward. Section 73 concerns cases other than the specified fraud, wilful-misstatement or suppression grounds; section 74 addresses cases involving those grounds. See the Finance (No. 2) Act, 2024.
These provisions are not interchangeable labels for guilt. Read the alleged facts and legal basis in the notice rather than assuming that an allegation itself proves the conduct. The enacted amendment sets the FY boundary; the commencement position and relevant rules should be checked for the particular proceeding. State and union territory GST enactments generally mirror the central framework, but the actual notice and competent authority govern the case.
Know whether the document is DRC-01 or DRC-01A
DRC-01: electronic summary of a show cause notice
DRC-01 is an electronic summary associated with a formal show cause notice, not a substitute for reading the full notice and its annexures. Its prescribed fields include a reference number, tax period and financial year, the Act and cited section, brief facts and grounds, and a breakdown of tax and other dues, including interest and penalty. Compare those details with the narrative and calculations in the full notice. The CGST Rules prescribe the relevant forms.
DRC-01A: pre-notice intimation in specified proceedings
DRC-01A is a pre-notice intimation used in the specified demand process. The rules provide for communication of amounts ascertained by the officer and, in the prescribed setting, a submission in Part B. It is distinct from the formal notice and its DRC-01 summary. Check the document’s label and stated purpose before deciding what response is called for.

What the company should inspect
Make a record of the following before drafting a response. These checks help identify what the department is alleging and what evidence may be relevant; they do not determine whether a notice is legally valid.
- Identity and authority: issuing officer, reference number, company name and GSTIN.
- Period and provision: tax period, financial year, Act, section and subsection cited.
- Allegations: the facts asserted, legal grounds and transactions or records said to support them.
- Amount: the working for tax, interest, penalty and any other dues; compare the summary with the detailed notice and annexures.
- Service and response instructions: date and method of service, stated reply deadline, filing method, hearing information and required attachments.
- Evidence: relevant returns, ledgers, invoices, credit records, correspondence and other source documents that can be reconciled to the allegations.
Preserve a copy of the notice, annexures, response and attachments, along with proof of submission. If the period, amount or facts appear inconsistent, identify the specific discrepancy and supporting record; a discrepancy does not automatically invalidate the notice.
How to respond and what happens next
The rules identify form DRC-06 for a representation or reply in the specified proceedings. The GST Portal describes a process that can include a show cause notice being issued, a reply being submitted, a hearing notice being issued and an appeal order being passed. The exact deadline, materials and portal filing path depend on the notice, governing provision and current portal directions. Follow the instructions in the actual notice and verify the applicable procedure rather than relying on a single deadline for all GST notices. See the GST Portal guide to demands and recovery.
Rank #4
- Read the full notice: use DRC-01 as a guide to the case, then check the complete notice and every cited annexure.
- Reconcile the claim: map each allegation and amount to company records, and note what is admitted, disputed or needs explanation.
- Prepare the representation: address the notice’s specific grounds, attach relevant records and use the reply method and deadline stated for that proceeding.
- Retain filing proof: save the acknowledgement and copies of all submitted material, and monitor the portal for further communications or a hearing notice.
Because the consequences and available routes turn on the provision, period and facts, a company may want a qualified GST practitioner, chartered accountant or tax lawyer to review the notice and proposed response. Do not assume that paying the proposed amount is always the right course: the Act and rules provide specified payment routes and consequences in particular circumstances, so check the applicable provision before choosing one.
A notice is different from an appealable order
A show cause notice calls for a response within the proceeding; an appeal is a possible later remedy against an order. The GST Portal lists demand orders under sections 73, 74 and 74A among categories of assessment demand orders that taxpayers may appeal. That does not make an appeal a substitute for replying to the notice. If an order is issued, check its specific appeal procedure and time limit. See the GST Portal guide to assessment orders.
