Was Caroline Ellison’s “Diary” Evidence in the FTX Case?

Reported excerpts from Caroline Ellison’s private Google documents became part of a pretrial controversy. They are not the same as her sworn trial testimony, and available sources do not establish that the writings were admitted as trial evidence.

Caroline Ellison’s reported private writings became part of the FTX case’s pretrial public controversy, but the available sources do not establish that the writings themselves were admitted as evidence at trial. The word “diary” is shorthand: 2023 coverage described selected excerpts from private Google documents and other personal writings, not a complete, formally titled diary.

What did the reported writings say?

A report published July 20, 2023, reproduced selected excerpts attributed to Ellison’s private Google documents. One February 2022 excerpt said, “I have been feeling pretty unhappy and overwhelmed with my job.” (Business Insider)

That is a reported passage from a document, not a view of the complete writings. It should not be treated as a diagnosis or as an explanation for the fraud. The available account does not establish that the published excerpts represented the full documents or the full range of Ellison’s thoughts.

Why did the writings become a legal controversy?

In August 2023, prosecutors alleged that Sam Bankman-Fried shared Ellison’s private writings with a New York Times reporter to discredit her and affect the public climate around the coming trial. Bankman-Fried’s lawyers disputed the prosecution’s characterization. The dispute arose in proceedings over his detention, before the trial. (Associated Press)

Judge Lewis Kaplan described the excerpts as deeply personal. As AP reported his remarks, he said material someone in a relationship “would be very unlikely to share with anybody, lest The New York Times, except to hurt, discredit, and frighten the subject of the material.” That was the judge’s characterization during the detention proceedings; it is distinct from a finding that the writings proved the charged conduct.

Were the writings admitted as trial evidence?

Public disclosure and courtroom evidence are different things. The excerpts were reported in the press and discussed in pretrial litigation. The sources available here do not establish that the Google documents or reported excerpts were admitted as exhibits for the jury. So it would be inaccurate to call them a key trial exhibit or say they proved the crimes.

Ellison’s sworn testimony is a separate matter. She testified at Bankman-Fried’s October–November 2023 trial. In a September 2024 sentencing letter, prosecutors called her testimony a “cornerstone” of the case and said it helped explain the crimes’ “what,” “how,” and “why.” Her defense submission said she testified over three days. Those descriptions concern her testimony and cooperation, not the evidentiary status of her private writings. What happened to Ellison after the trial?

On September 24, 2024, Ellison was sentenced to two years in prison. Kaplan credited her cooperation while saying imprisonment was warranted by the seriousness of the fraud. AP reported that he told her, “I’ve seen a lot of cooperators in 30 years here. I’ve never seen one quite like Ms. Ellison.” The sentence and praise for her cooperation are part of the later sentencing outcome, not evidence that her private writings were used at trial.
