USDC has a clearer route through EU-regulated crypto-asset providers than USDT: Circle says its French electronic money institution is authorised to issue USDC as a MiCA-regulated e-money token in the European Economic Area (EEA). ESMA guidance led prominent EU exchanges to delist USDT, whose issuer was not authorised under the relevant MiCA stablecoin rules. That affects services offered by regulated providers; it does not establish a blanket ban on privately holding or self-custodying USDT.
For either token, check three separate things before acting: the issuer’s status, the provider’s authorisation, and whether that specific provider currently supports the action you need in your country.
USDC vs. USDT in the EU at a glance

What MiCA compliance means—and what it does not
MiCA classifies a token that references one official currency as an e-money token. Offering an EMT to the public or seeking its admission to trading is subject to issuer authorisation and white-paper requirements under the regulation’s terms and exceptions. Circle’s disclosures say its French EMI is authorised to issue USDC as an EMT in the EEA; this is the basis for describing USDC’s issuance route as MiCA-compliant. It is not a regulator’s endorsement of USDC or a guarantee about its value, redemption, reserves, operations or blockchain risks.
There is a separate authorisation requirement for firms providing crypto-asset services. Under MiCA Article 59, a person generally cannot provide those services in the Union unless authorised as a crypto-asset service provider (CASP) or operating under one of the specified regulated-entity routes. The issuer’s status and the provider’s status answer different questions: an authorised issuer does not make every exchange authorised, and an authorised exchange does not have to offer every token.

Check the provider as well as the token
ESMA’s MiCA register page was reported last updated on 9 September 2026. Check the provider’s exact legal entity there and confirm its status with the local regulator. ESMA says the EU-wide CASP transitional period ended on 1 July 2026. A provider relying only on an expired transitional route should not be described as authorised. ESMA also cautions that clients using unauthorised providers do not receive MiCA safeguards, including client-asset protections. Is USDT banned in Europe?
The evidence supports a narrower answer than “USDT is illegal to own.” ESMA’s January 2025 guidance addressed services that CASPs provide involving non-MiCA-compliant asset-referenced tokens and EMTs, including trading availability. It did not establish a general prohibition on private possession or self-custody. Rules for an individual situation can depend on the jurisdiction and facts, so do not treat exchange restrictions as proof that every form of holding USDT is prohibited.

In its 17 January 2025 guidance and accompanying statement, ESMA said national competent authorities were expected to ensure CASP compliance as soon as possible and no later than the end of Q1 2025. The statement expected trading platforms to stop making non-compliant tokens available for trading, and addressed services such as order reception and transmission, order execution and exchange. It allowed a longer sell-only period through the end of Q1 2025 so investors could liquidate or convert positions. That was a historical transition, not a continuing general permission.
Can you still buy, sell, deposit or withdraw USDT?
There is no reliable single answer for every EU country and venue. ESMA’s September 2025 risk report documented prominent EU exchange delistings of USDT following its regulatory guidance. Delisting narrows access through regulated providers, but a provider’s current support can still depend on where your account is registered and which service you want to use.

Check the actions individually. A token may be tradable while deposits or withdrawals are paused; a provider may support transfers on one blockchain but not another. A listing or trading pair does not confirm that you can deposit, withdraw or exchange the token. Review the provider’s current asset page, notices and transfer network details before placing an order or sending funds.
Practical checks before using a venue
- Identify the legal entity. Match the company named in your account terms to the ESMA MiCA register and the local regulator’s register.
- Confirm the service in your country. Check that your account’s jurisdiction is eligible and that the provider offers the specific crypto-asset service you intend to use.
- Check the action separately. Look for current support to buy, sell, trade, deposit, withdraw or exchange USDC or USDT; do not infer one service from another.
- Match the network. Before transferring, confirm the exact blockchain and deposit or withdrawal route on both sides. A network mismatch can put funds at risk.
What the historical market figures can—and cannot—tell you
The ECB’s Financial Stability Review of May 2025 reported USDT at USD 149 billion market capitalisation and a 65% market share, compared with USDC at USD 62 billion and a 27% share. These are the ECB’s historical figures, not October 2026 values and not EU-specific market shares. They provide dated global market context, not a guide to current EU availability or a measure of which token is safer.

ESMA’s September 2025 risk report also recorded USDT’s relative share falling from 65% to 61% over the period it discussed. That is a report-period observation, not a current market share. The same report said euro-denominated stablecoins’ monthly traded volumes more than doubled over a year to EUR 426 million in June 2025, while accounting for 0.1% of total stablecoin traded volumes. Those figures describe the report’s market context; they do not decide whether USDC or USDT is accessible to a particular EU customer.

If your priority is access through a MiCA-regulated provider, USDC has the clearer issuance position based on Circle’s disclosures, while USDT has faced delistings and restrictions at EU-regulated venues. That is not a promise that a particular exchange supports USDC—or that every USDT service is unavailable. Confirm the provider and the exact action you need before choosing a token or transferring funds.

The available evidence establishes the regulatory and broad market distinction, not a live country-by-country listing matrix or an independent comparison of issuer reserves, redemption operations and technical risks. Neither token should be treated as risk-free simply because of its regulatory route or market size.
