US Removes Sanctions Against Tornado Cash: What the Treasury Decision Means

The Treasury delisted Tornado Cash in March 2025 after reviewing legal and policy issues, but the action did not declare all mixer use lawful or end warnings about illicit-finance risk.

The U.S. Treasury announced on March 21, 2025, that it had removed economic sanctions against Tornado Cash. It said the decision followed a review of novel legal and policy issues raised by sanctions in changing technological and legal environments—not that Tornado Cash, crypto mixers generally, or every transaction involving them is lawful or safe. Treasury also continued to warn about North Korea-linked cybercrime and urged U.S. persons to use caution around transactions that could benefit malicious cyber actors.

Why did the U.S. remove sanctions from Tornado Cash?

Treasury said it removed the economic sanctions after the administration reviewed “novel legal and policy issues” raised by applying sanctions to financial and commercial activity in evolving technology and legal environments. The March 21, 2025 announcement gives that as the reason; it does not describe the decision as a finding that the earlier illicit-finance concerns were unfounded.

The change followed a 2022 Office of Foreign Assets Control (OFAC) designation. In its August 8, 2022 release, Treasury described Tornado Cash as an Ethereum virtual-currency mixer that combines transactions to obscure their origin, destination, and counterparties. Treasury said the service had been used to launder more than $7 billion in virtual currency since its creation in 2019. Those amounts are Treasury’s published attributions, not independently adjudicated totals established by the cited releases.

What changed between the 2022 designation and the 2025 delisting?

Message to users The designation imposed economic sanctions. Treasury continued to warn about transactions that could benefit malicious cyber actors or North Korea and advised U.S. persons to exercise caution.

Is Tornado Cash legal in the U.S. now?

The delisting is not a blanket declaration that Tornado Cash or every use of a mixer is legal. Treasury’s March 2025 announcement says that it removed the economic sanctions against Tornado Cash; it does not say that all transactions involving the service are lawful, risk-free, or exempt from other laws. Whether a particular transaction is lawful can depend on its facts and on other applicable requirements. A person facing a specific legal or compliance question should consult a qualified attorney rather than treating the delisting as legal advice.

Does the delisting mean crypto mixers are no longer sanctioned?

No. The announcement is specific to the economic sanctions against Tornado Cash. It does not say that Treasury removed sanctions from every mixer, nor does it establish a general policy that mixer activity cannot be sanctioned. The relevant status of another service or person would need to be assessed separately.

What does Treasury still warn about?

Treasury said it remained “deeply concerned” about North Korea’s state-sponsored hacking and money-laundering campaign. It said it would continue to use its authorities against malicious cyber actors and monitor transactions that may benefit such actors or the Democratic People’s Republic of Korea (DPRK). Treasury advised U.S. persons to exercise caution before engaging in transactions presenting those risks.

  • Treasury cited more than $96 million from the Harmony Bridge heist as laundered through the mixer.

These are Treasury’s 2022 attributions. They explain the concerns cited in the original designation, but they do not change the narrower scope of the 2025 delisting announcement.

Did the decision clear Tornado Cash’s founders?

No. The Treasury announcement concerns economic sanctions against Tornado Cash; it does not say that its founders were cleared or that individual cases ended. In August 2023, OFAC designated co-founder Roman Semenov, and the Department of Justice unsealed charges against Semenov and Roman Storm. The March 2025 delisting announcement does not state that those individual matters were resolved.

What should U.S. users take from the announcement?

  • Do not interpret the delisting as proof that every transaction involving Tornado Cash is permitted or free of illicit-finance risk.
  • Take Treasury’s continuing caution about transactions that could benefit malicious cyber actors or the DPRK seriously.
  • Do not assume that the status of Tornado Cash determines the status of another mixer, an individual, or a separate transaction.
  • For a transaction with meaningful legal, sanctions, or compliance implications, seek advice based on its specific facts.
