US and India Tax Residency: What Returning Green-Card Holders Need to Know

Returning to India does not automatically end U.S. tax residence. Understand the separate U.S. and Indian tests, possible overlap, treaty limits and green-card exit considerations.

Moving back to India does not, by itself, end U.S. tax residence or cancel a green card. You may be resident under U.S. rules while also qualifying as resident under India’s separate rules. To determine what you must file and where income may be taxed, assess each country’s rules for the relevant year, then consider whether a treaty position is available.

The key facts are your U.S. immigration history, travel days in both countries, Indian residence history, income and filing records. This is an orientation, not an individual calculation: the result depends on those details and the law applicable to each tax year.

Why a move to India does not settle your tax status

U.S. and Indian tax residence are separate domestic-law determinations. A return to India can affect your status under Indian rules, but it does not automatically end U.S. residence. In particular, a person who still holds lawful permanent-resident status generally continues to meet the U.S. green-card test unless that status is relinquished, revoked or determined to have been abandoned.

The two systems also work on different timelines. U.S. federal residence is generally evaluated by calendar year. India applies its own tax-year framework and assesses residence under domestic law for the relevant year. A move partway through a year can therefore require separate calculations for the same period, rather than one worldwide “residency date.”

It is useful to distinguish three questions: whether you are resident under each country’s domestic rules; how each country treats your income given that status; and whether a treaty position can resolve overlapping residence for a particular U.S. tax computation. Immigration status and tax residence are related, but they are not interchangeable.

How U.S. tax residence is determined

The Internal Revenue Service generally treats a noncitizen as a U.S. resident alien for a calendar year if the person meets either the green-card test or the substantial-presence test. Meeting one test is enough; moving abroad does not erase a result already established by the applicable rules.

The green-card test

If you are a lawful permanent resident, the IRS generally considers you to meet the green-card test while that status remains in effect. IRS Tax Topic 851 says: “You continue to have resident status under this test unless the status is taken away from you or is administratively or judicially determined to have been abandoned.” This is guidance about the U.S. green-card test, not treaty language.

Relevant events can include voluntarily surrendering the green card or renouncing immigrant status, administrative revocation, or judicial revocation. Simply leaving the United States, establishing a home in India or filing an Indian return is not the same thing as taking one of those steps. If you have not ended permanent-resident status through a legally relevant event, do not assume that your U.S. tax residence ended on your departure date.

The substantial-presence test

Even when the green-card test is not met, a noncitizen may meet the substantial-presence test. IRS guidance uses a weighted count across the current calendar year and the two preceding calendar years. The test requires at least 31 days of presence in the United States during the current year and at least 183 weighted days in total:

  • Count every day of presence in the current calendar year.
  • Add one-third of the days of presence in the first preceding calendar year.
  • Add one-sixth of the days of presence in the second preceding calendar year.

For example, someone who is in the United States for 90 days in the current year, 120 days in the prior year and 120 days in the year before that would count 90 + 40 + 20, or 150 weighted days. That example illustrates the arithmetic only; it does not determine an individual’s status or account for every statutory rule or exception. Keep a day-by-day travel record, because the weighted count includes days from more than one year.

What U.S. residence can mean for income

The IRS generally taxes U.S. resident aliens in the same manner as U.S. citizens, including on worldwide income. By contrast, nonresident aliens are generally taxed on U.S.-source income and income effectively connected with a U.S. trade or business, subject to exceptions. This distinction can make the residency determination consequential even after you have moved: the location of your home alone does not establish which U.S. treatment applies.

Residence is not the only issue in a return. Income source, timing, applicable exceptions and other filing rules matter too. A cross-border adviser may need to examine each income item and the relevant year rather than infer tax treatment from your mailing address or the country where you spent most of the year.

India uses its own residence rules

India determines an individual’s residential status under Indian domestic law. The framework considers days of presence in India and includes statutory exceptions and a separate resident-but-not-ordinarily-resident (RNOR) classification. Your result can depend on the current Indian tax year, prior residence history and circumstances that affect the applicable rule.

Do not reduce the analysis to “182 days means nonresident.” A single day-count figure is not a universal answer for every returning green-card holder. Depending on the applicable provision, relevant facts can include whether you are an Indian citizen or a person of Indian origin, the purpose of travel or return, your India days in the current and prior years, Indian income, and whether you are liable to tax elsewhere. The applicable threshold and any exception must be checked against the law for the specific tax year.

RNOR is a distinct Indian classification, not another name for nonresident. Whether it applies is determined under the applicable statutory conditions and history; it cannot be inferred just from the fact that you returned after living abroad. Identify the right category first, then confirm the income and filing consequences that attach to it under the rules for that year.

Check which Indian law and forms apply

Official Indian Income Tax Department material available for the 2026–27 assessment-year guidance refers to provisions under the Income-tax Act, 1961, while official material also reflects a transition to the Income-tax Act, 2025. Because of that transition, do not carry forward an old section number or form assumption without checking which law and filing requirements apply to your particular tax year. A rule described for one year may not be the right citation or procedure for another.

How the two systems can overlap

It is possible to satisfy domestic residence rules in both countries for a period. That is not a contradiction: each country applies its own definition. The overlap means you need to establish your status under each system separately before deciding what relief or disclosure may be relevant.

Question United States India
Time period Generally assessed by calendar year. Assessed under India’s tax-year framework; confirm the applicable year and law.
Main residence triggers Green-card status or a weighted U.S. presence count, subject to applicable rules. Presence in India and statutory rules that can depend on circumstances and residence history.
How status ends or changes Green-card-test residence generally continues until a legally relevant relinquishment, revocation or abandonment determination; the substantial-presence test is assessed under its own annual calculation. Residential status is assessed for each relevant tax year under Indian domestic law.
Possible overlap relief A treaty tie-breaker may be relevant to a dual-resident taxpayer’s U.S. income-tax computation; verify the U.S.–India treaty text and required filings before relying on it. Any India-side treaty treatment or procedure must be checked against the treaty and applicable Indian rules.

Treaty relief is a separate question, not an automatic change of status

IRS guidance recognizes that a dual-resident taxpayer may, in some circumstances, use a treaty tie-breaker to be treated as resident in the other country for computing U.S. income tax. IRS materials also say a treaty-based return position may require disclosure on Form 8833. That possibility does not itself cancel a green card or establish that a particular person qualifies.

The precise U.S.–India treaty provision and procedure should be checked directly before you take a treaty position. Do not assume the ordered tests or notification requirements from another country’s treaty are identical. Whether a position is available depends on the treaty text, the facts and applicable filing rules; seek qualified U.S.–India advice before relying on one. A treaty claim and an immigration decision are different actions, with different consequences.

The closer-connection exception is narrow

The U.S. closer-connection exception is not a general rule that lets someone stop being a U.S. tax resident by moving abroad. IRS guidance lists conditions that include fewer than 183 days of U.S. presence in the current year, a tax home in a foreign country for the year, and a closer connection to that country. It also requires that the person not have taken steps to obtain lawful permanent-resident status or have an application pending. A timely Form 8840 is generally required to claim the exception.

Someone who already holds a green card should not assume that the closer-connection exception displaces the green-card test. The interaction of the rules and the person’s status need to be assessed against their facts. If you may be eligible for an exception, establish the filing deadline and requirements for the particular year rather than treating the move itself as a claim.

Before giving up a long-held green card, check expatriation rules

Ending permanent-resident status can have tax consequences beyond the final year of ordinary residence. The IRS defines a long-term resident using an 8-of-15-tax-year test: broadly, the person must have been a lawful permanent resident in at least eight tax years within the relevant 15-tax-year period. The 2025 Instructions for Form 8854 identify reporting obligations for individuals ending long-term-resident status and require a certification of federal tax compliance for the five preceding tax years in the Form 8854 context.

Long-term-resident status is not by itself the complete expatriation analysis. Before relinquishing status, determine whether you meet the long-term-resident definition, which covered-expatriate tests apply, what Form 8854 reporting is required and whether you can certify compliance for the required prior years. The relevant tax years and your filing history matter. A person who discovers missed or incomplete returns should get advice on the available steps before signing a certification or taking an irreversible immigration action.

Build the fact record before calculating either country’s result

A reliable analysis starts with a timeline, not a guess based on the date you landed in India. Assemble the records for both countries and organize them by tax year so an adviser can apply the correct domestic rules and identify possible treaty issues.

  • Day-by-day travel records for the United States and India, including arrival and departure dates for the current year and relevant prior years.
  • Green-card issue date and records showing any surrender, renunciation, revocation or other status determination.
  • Your India arrival date and the purpose of the return or travel.
  • India residence history for the relevant prior years, along with facts that may matter to a statutory exception or RNOR classification.
  • Income details, including when and where income arose, as well as relevant source information.
  • Copies of U.S. and Indian returns, notices and supporting records for the years under review.
  • Any prior Forms 8833, 8840 or 8854 and records of treaty claims or tax-compliance issues.

These records help identify which tests and filings need attention; they do not replace a year-by-year computation. If records conflict, resolve the dates and status history before relying on a conclusion.

A practical order of operations

  1. Set the years under review. List each U.S. calendar year and corresponding Indian tax year affected by the move. Note the applicable Indian law and forms rather than assuming earlier-year instructions still apply.
  2. Determine U.S. domestic status. For each calendar year, check green-card status and calculate the substantial-presence count where relevant. Do not treat one test as a substitute for checking the other when the facts make both relevant.
  3. Determine Indian domestic status. Apply the correct Indian residence provisions using the relevant day counts, personal circumstances, income facts and prior residence history. Assess RNOR separately where applicable.
  4. Map income and filing obligations. Once each status is established, review income source and the filing treatment in each country. Separate the question “where am I resident?” from “how is this particular income treated?”
  5. Evaluate any treaty position. Verify the actual U.S.–India treaty text and disclosure requirements before making a claim. IRS guidance points to Form 8833 for certain treaty-based positions; obtain advice on whether it applies to your facts.
  6. Review exit rules before changing immigration status. If you are considering giving up a green card, determine whether the 8-of-15-year long-term-resident rule, Form 8854, covered-expatriate tests or the five-year tax-compliance certification are relevant.

For individualized advice, use a qualified professional experienced with both U.S. and Indian tax rules, particularly before claiming treaty relief or relinquishing a long-held green card. The critical work is to apply each system to the right tax year and documented facts—not to infer a result from the move alone.
